RECOMMENDED ACTION:
Motion to adopt a resolution rescinding Resolution 2004 -111 and approving the final plat
for Harmony in place of Reflections.
ACTION:
ISSUE
On September 21, 2004, the Council approved the final plat for Reflections, the first phase of
housing for the Brockway development area. The approval included a subdivision agreement
for construction of private and public improvements. The Developer then took the final plat
to Dakota County for recording. The County rejected the plat based upon another
development in the metro area also having the name "Reflections. As a result, Contractor
Property Developers Company (the Developer) has chosen "Harmony" as the new name for
the Brockway area.
The City must take several actions to accommodate the name change. A new resolution
approving the final plat with the new name and rescinding the previous resolution needs to be
adopted. The Subdivision Development agreement will also have to be amended to
acknowledge the change. New mylars of the final plat have been provided by CPDC for
signatures. The mylars -have been checked against the approved final plat and found to be
consistent.
A new resolution has been prepared. The previous resolution approving the Reflections final
plat referred to a memo from the Parks and Recreation Director concerning specifics of the
park dedication The attached resolution for Harmony includes the specifics of the parks
recommendation to avoid referring to the separate memo. As a result, the Harmony
resolution contains seven recommended conditions of approval instead of the four included
with the Reflections resolution 2004 -111.

City Council Action: Approved Final Plat for Reflections 9 -21 -2004.
SUMMARY
The renamed Harmony final plat has been compared with the conditional approval for
Reflections (Brockway phase 1) and is consistent. Staff supports the renaming and final plat
approval as needed.

RESOLUTION 2004 -
A RESOLUTION RESCINING RESOLUTION 2004 -111 AND
APPROVING A REVISED RESOLUTION APPROVING THE FINAL PLAT FOR
HARMONY
WHEREAS, the Community Development Department of the City of Rosemount received an
application from Contractor Property Developers Company (CPDC) on August 9, 2004
requesting a Final Plat for the Brockway Reflections, legally described as:
Outlots B, C, D and F, OUTLOTS OF BROCKWAY, according to the recorded plat thereof, Dakota
County, Minnesota.
WHEREAS, on September 14, 2004, the Planning Commission of the City of Rosemount
reviewed the Final Plat for Brockway Reflections for the Brockway site eat of Highway 3,
between County Road 38 (132 "d Street) and Connemara Trail; and
WHEREAS, the Planning Commission adopted a motion to recommend that the City Council
approve the Final Plat for Brockway Reflections, subject to conditions; and
WHEREAS, on September 21, 2004, the City Council of the City of Rosemount approved the
Final Plat for Brockway Reflections after reviewing the Planning Commission's recommendation
and the Final Plat; and
WHEREAS, on November 30, 2004 CPDC requested that the City approve the renaming of
Reflections to Harmony based upon direction from Dakota County.
NOW, THEREFORE BE IT RESOLVED, the Council of the City of Rosemount hereby
rescinds Resolution 2004 -111.
NOW, THEREFORE, BE IT FURTHER RESOLVED, the Council of the City of Rosemount
hereby approves the Final Plat for Harmony, subject to:
1. Approval of the Dakota County Plat Commission.
2. Approval of the Minnesota Department of Transportation.
3. Execution of a subdivision development agreement to secure public
infrastructure and private improvements including landscaping.
4. Based on the approved preliminary plat Outlot L (labeled Park in the Final
Plat) will be dedicated with Harmony. Also based on the preliminary plat,

Outlot M ( Outlot E in the Final Plat) will be dedicated before June 1,
2005.
5. The total required park dedication is 24.96 acres. The City is giving credit
for 12.18 acres (Park as titled in the final plat is 10.39 minus .98 acres for
the pipeline easement and Outlot E is 3.97 minus 1.20 acres easement)
thus 12.78 acres will be paid as cash in lieu of land. Park dedication fees
shall be made in two payments. The first payment will be for $383,400
(6.39 acres at $60,000) to be paid with the Harmony final plat including
the area labeled Park. The second payment for the remaining 6.39 acres
and will be made prior to June 1, 2005 in conjunction with the dedication
of Outlot E, based on the park dedication fee at the time of payment.
6. The City shall coordinate construction of the public park areas.
7. This resolution will act as an amendment to the Subdivision Agreement
titled "Reflections" and will refer to the plat now titled "Harmony ".
ADOPTED this seventh day of December, 2004 by the City Council of the City of Rosemount.
