APPROVED BY: RECOMMENDED ACTION: Motion to adopt a resolution modifying Condition 6 of Resolution 2004 -81. ACTION: ISSUE The Rosewood Village 2 nd Addition final plat was approved on July 6, 2004 for a total of 56 detached townhomes. The resolution included a condition #6 "Security fencing and screening landscaping shall be installed prior to issuance of building permits ". The project was anticipated for two builders on either side of Blanca Avenue, south of 145 Street West. The west side intended for Keyland Homes has been divided into two phases. Public utilities and a paved road are installed in the northern half of the project, allowing for issuance of building permits. The southern half will be a second phase and no public infrastructure work has begun. The Developer has requested that the condition in the resolution be modified to align with the phases, as dictated by the public infrastructure work. The modified condition would require the screen or buffer landscaping in the first phase to be installed prior to issuance of building permits within the boundaries of the first phase. Similarly, building` permits would not be issued in the second phase until all landscaping was installed within the remaining portion of the project. Staff has informed the developer that all screen fencing must be installed prior to issuance of any building permit. Guide Plan Desig: Urban Residential Current Zoning: R1, Low Density Residential The original condition was recommended on the assumption that all of the buildings would be constructed in a single phase, as suggested by the approved final plat. However, the applicant has split the project into two phases and has requested a modification from the initial condition of approval. With approval of the modified condition, building permits can be issued within the first phase without requiring landscape installation in an area where public services are not as yet provided. It appears that the primary reason for the request was the lateness in the year for planting new landscaping. Staff had initially recommended the condition for fencing and landscaping due to problems with timeliness by the developer in previous phases. Staff has had to be involved with many of the landscaping decisions in the previous phases as new homeowners either request the plantings be installed, or they request modifications to the approved plans based upon their own desires. The condition would address these concerns by placing the landscaping on site prior to any buildings constructed, much less sold to private individuals. The landscaping involved is the buffer between the housing and Greif Bros., the railroad spur and 145 th Street West and Blanca Ave. This landscaping was critical in terms of separating the housing from the industrial land use as part of the PUD concept approval. Other project landscaping associated with the individual home sites will be installed in the usual manner, after the homes are built. Boulevard trees and individual or specimen trees that would be severely impacted by home construction would be installed prior to issuance of occupancy permits, or installed later guaranteed by a separate security (if off - season). Staff feels it is important for the security fencing to be installed along the entire length of the railroad spur with the first phase. Screening landscaping associated with the boundary line separating houses of phase 2 from the single family houses on the public cul -de -sacs would be required to be installed prior to issuing building permits for phase 2. CONCLUSION Staff believes the revised condition language is a good compromise that addresses the concerns of the city to ensure timely installation of fencing and landscaping within the project. Therefore staff recommends approval of the attached draft resolution. 2 CITY OF ROSEMOUNT DAKOTA COUNTY, MINNESOTA RESOLUTION 2004- A RESOLUTION MODIFING CONDITION 6. OF RESOLUTION 2004 -81 WHEREAS, the City Council adopted Resolution 2004 -81 approving the final plat for Rosewood Village 2 Addition with conditions concerning land legally described as follows: Outlots A and B, ROSEWOOD VILLAGE, according to the recorded plat thereof, Dakota County, Minnesota. WHEREAS, the developer informed the Community Development Department that the construction of the Rosewood Village 2nd Addition would be accomplished in two or more phases; and WHEREAS, condition 6 of Resolution 2004 -81 requires "Security fencing and screening landscaping shall be installed prior to issuance of building permits ", meaning that no permits would be issued until the fencing and landscaping is installed, WHEREAS, the requirement for landscaping can be proportionate to the first phase to mitigate the potential harmful effects of the adjacent industrial property; and WHEREAS, the security fencing along the railroad spur line is still required to be installed prior to issuance of any building permits in Rosewood Village 2nd Addition. NOW, THEREFORE, BE IT RESOLVED, the Council of the City of Rosemount hereby modifies condition 6 of Resolution 2004 -81 to read: 6. Security fencing shall be installed prior to issuance of any building permits for the entire plat and screening landscaping shall be installed prior to issuance of building permits based upon the attached phasing plan (Attachment 1) consistent with the areas designated for installation of public utilities. The plat is divided into the north and south area with the south area having public infrastructure installed first.
