SUMMARY
Tract A will remain an agricultural residential use, consistent with agricultural lot standards.
Tract B will be utilized for construction of a maintenance building by the applicant for
equipment used in the landfill. Tract B will be combined with the larger SKB site.
Lot standards Tract A Agricultural Minimums
Lot area 3.45 acres 12.5 acres
Lot width 652.8 feet 300 feet
The property has an existing non - conforming situation with respect to the existing house
setback from State Highway 55. The house is approximately 45 feet from the highway right -
of -way. The normal agricultural district setback is 50 feet. As a result, the northeast facing
elevation of the house, the portion of the building closest to the Highway 55 right -of -way is
non - conforming.
The resulting available building envelope is a triangle of about 8,400 sq. ft. contiguous with
and including most of the house. If the house is ever to be expanded care must be taken to
not increase the non - conformity. If the house is ever replaced, it would have to be setback
fifty feet from the right -of -way. An alternative building site with more flexibility would be in the
southeastern area of Tract A, which has a building envelope of approximately 70,300 square
feet.
As with other recent lot spI it/comb inations, the requested split does not cause or increase any
non- conformity. The non- conforming situation is a pre- existing condition, which is not going
to be solved by the spIit/combination.
RECOMMENDATION
Staff supports the lot split and combination requested by SKB as it will facilitate operations
related to the landfill. No non - conforming situations are a result of the action.

RESOLUTION 2004 -
A RESOLUTION APPROVING THE LOT SPLIT AND RECOMBINATION REQUEST
FROM SKB ENVIRONMENTAL, INC.
WHEREAS, the Community Development Department of the City of Rosemount received an
application from SKB Environmental, Inc. on September 17, 2004 requesting a Lot Split for the
property located at 13625 Courthouse Boulevard, legally described as:
All that part of the Northwest Quarter of the Southeast Quarter of Section 20, Township 115 North,
Range 18 West, described as follows: Beginning at point on the North and South Quarter section line
of said Section 20, 330 feet South of the intersection of said Quarter line with the Southerly right -of-
way line of S.T.H. No. 55, thence North along said Quarter line to the center of said highway, thence
Southeasterly along said centerline 660 feet, thence South and parallel with said Quarter line to a point
330 feet South of the Southerly right -of -way line of said highway, thence Northwesterly 652.81 feet to
the point of beginning, according to the United States Government Survey thereof and situate in
_Dakota County, Minnesota.
WHEREAS, on October 26, 2004, the Planning Commission of the City of Rosemount held a
public hearing to review the Lot Split and Combination at 13625 Courthouse Boulevard; and
WHEREAS, the Planning Commission adopted a motion to recommend that the City Council
approve,the Lot Split and Recombination requested by SKB Environmental, Inc. for the property
located at 136525 Courthouse Boulevard, subject to conditions; and
WHEREAS, on November 16, 2004, the City Council of the City of Rosemount reviewed the
Planning Commission's recommendation and the Lot Split and Recombination application and
agreed with the Planning Commission's findings;
NOW, THEREFORE, BE IT RESOLVED, the City Council of the City of Rosemount hereby
approves the Lot Split request and Combination request from SKB Environmental, Inc. of 13625
Courthouse Boulevard to split a parcel of land approximately 4,08 acreas, legally described as
follows:
Tract A:
All that part of the Northwest Quarter of the Southeast Quarter of Section 20, Township 115 North,
Range 18 West, described as follows: Beginning at a point on the North and South Quarter section
line of said Section 20, 300 feet South of the intersection of said Quarter line with the Southerly right-
of-way line of S.T.H. No. 55, thence North along said Quarter line to the center of said highway,
thence Southeasterly along said centerline 660 feet, thence South and parallel with said Quarter line to
a point 330 feet South of the Southerly right -of -way line of said highway, thence Northwesterly

NOW, THEREFORE, FURTHER BE IT RESOLVED, the Council of the City of Rosemount
hereby approves the Lot Split and Recombination request from SKB Environmental, Inc. of
13625 Courthouse Boulevard to split a parcel of land approximately 4.08 acres, subject to:
1. Recombination of Tract B with the SKB property adjacent to the west.
2. Dedication of standard drainage and utility easements.
3. Payment of G.I.S. fees.

Public Hearing:
6A. CASE 04 -68 -LS Lot Split and Recombination for SKB Environmental
City Planner Pearson reviewed the Staff Report. SKB Environmental has purchased a
4.08 -acre property adjacent to their non - hazardous waste containment landfill on State
Highway 55. The property will be split and the smaller 0.63 -acre parcel will be
recombined with the SKB landfill site. The property is zoned Agriculture and is
currently occupied by a single - family residential use.
Acting Chairperson Zurn asked for questions for Mr. Pearson. Commissioner Powell had
one question regarding right -of -way issues. Mr. Pearson indicated the State had no right-
of -way issues and that no additional traffic should be generated.
Chairperson Messner asked for comments from the Applicant. John Domke, Vice
President of SKB Environmental, gave a brief history of the purchase of the landfill.
There were no questions for the Applicant.
Acting Chairperson Zurn opened the public hearing.
Acting Chairperson Zurn asked for public comments. There were no public comments.
MOTION by Zurn to close the Public Hearing. Second by Schultz. Ayes:
Schultz, Zurn, Messner Humphrey and Powell. Nays; None. Motion carried-.
MOTION by Zurn to recommend to the City Council approval of the lot split
requested by SKB Environmental for the property at 13625 Courthouse Blvd
subject to the property owner combining Tract B with the adjoining SKB
property. Second by Powell. Ayes: Schultz, Zurn, Messner, Humphrey and
Powell. Nays: None. Motion carried.
Mr. Pearson indicated this item will be on the agenda for the November 16, 2004 City
Council Meeting.
