ACTION: ISSUE This proposed text amendment is staff initiated. The intent is to require home builders to position new single family homes on lots so that a third stall may be built in the future without need of variance. While the residential housing market more and more is requiring new home to include a three stall garage, the City has processed enough variance requests for third stalls that staff feels this amendment is warranted. BACKGROUND Over the past two years, staff has processed several setback variance requests to allow construction of a third attached garage stall. In most cases, the need for the variance could have been avoided if the original home builder had positioned the house on the lot with enough room on the garage side to accommodate a future third garage stall. In other words, the lot was wide enough to accommodate a house with a three car garage but the structure - placement precluded the addition without variance (see attached site plan). PLANNING COMMISSION The Planning Commission reviewed this item and held a Public Hearing during their August 22, 2004 meeting. There was no comment from the public. The Commission asked general questions regarding when this standard would take effect and how it would affect home construction. Staff indicated that this standard would take effect upon its publication and should have little affect on home construction. Currently, builders are required to submit a site survey showing the position of the house and garage on the lot. The survey will now need to show either a three stall garage or sufficient area to build a third stall in the future.. 11 ANALYSIS At present, the zoning ordinance requires single family homes to provide an attached two stall garage of a certain size and dimension but does not address future expansion needs. Currently, an attached garage must be a minimum of 440 square feet and not less than 20 feet wide in either direction. The maximum allowable size for an attached garage is 1,000 square feet in area. This text amendment would requireall future single family home permit applications, except those lots already approved by preliminary plat approval, to include a certificate of survey illustrating space for a future third stall. The amendment would require the area for the third stall to be a minimum of 10 feet wide and 20 feet deep or 200 square feet. That 200 square feet would be counted against maximum limit of 1,000 square feet for attached garage space. As a result, if a home builder chose to build only the required two stall garage it could not exceed 800 square feet in size. These new requirements would take effect after the published date of the ordinance and would not apply to single family lots platted before the effective date of this amendment. 2 City of Rosemount Ordinance No. B AN ORDINANCE AMENDING SECTION 4.15 OF THE ROSEMOUNT ZONING ORDINANCE B Single Family Dwelling Requirements THE CITY COUNCIL OF THE CITY OF ROSEMOUNT, MINNESOTA, ORDAINS AS FOLLOWS: Section 1 . Ordinance B, adopted September 19, 1989, entitled "City of Rosemount Zoning Ordinance," is hereby amended. Section 2 . Rosemount Zoning Ordinance B, Section 4.15.E is hereby amended by adding the following: F. All single- family dwellings shall be required to provide at least two attached enclosed garage parking spaces no less than four hundred forty (440) square feet in area and no less than twenty (20) feet wide in either direction. The maximum allowable size for attached garages is one thousand (1,000) square feet in area. Any single- family dwelling permit for properties receiving preliminary plat, lot division or Registered Land Survey approvals after the effective date of this ordinance (Insert publication date), shall include certificates of survey providing for the location of an attached third garage stall, whether or not construction is intended. The area allotted for the third stall shall be a minimum of 10 feet wide and 20 feet long. The combined area for the required two stall attached garage and the proposed third stall shall not exceed 1,000 square feet. Section 3 . EFFECTIVE DATE This Ordinance shall be in full force and effect from and after its passage and publication according to law. ENACTED AND ORDIANED into an Ordinance this 21 day of September, 2004. Public Hearing: Zoning Text Amendment for Three Stall Garages, City of Rosemount Assistant Planner Lindahl reviewed staff's request for a text amendment to the Zoning Ordinance to require home builders to position new single family homes on lots so that a third stall may be built in the future without the need of a variance. Staff indicated an increase in variance requests over the past few years. Mr. Lindahl stated the need for the variance could have been avoided if the house was positioned on the lot with room to accommodate a future third stall garage. The text amendment would require all future single family home permit applications to include a certificate of survey illustrating space for a future third stall. The new requirement would apply to single family lots platted after the publication date of the amended ordinance. Chairperson Messner confirmed the recording secretary has placed on file with the City all Affidavits of Mailing and Postings of a Public Hearing Notice and Affidavits of Publication concerning this public hearing. Chairperson Messner opened the public hearing. Chairperson Messner asked for public comments. There were no public comments. MOTION by Messner to close the Public Hearing. Second by Powell. Ayes: Messner, Humphrey, Powell, and Zurn. Nays: None. Motion carried. MOTION by Zurn to recommend that the City Council adopt an ordinance amending Section 4.15, of the Zoning Ordinance relating to Single Family Dwelling Requirements for three stall garages. Second by Powell. Ayes: Humphrey, Powell, Zurn, and Messner. Motion carried. This item will proceed to City Council on September 21, 2004. e 4.15: SINGLE- FAMILY DWELLING REQUIREMENTS: All single- family detached dwellings shall be constructed according to the following minimum standards: A. All single - family detached dwellings shall have a minimum width of twenty -four (24) feet in both directions and shall have, prior to issuance of a Certificate of Occupancy, a minimum gross finished floor area (excluding garage space) as follows: 1. In the RR -Rural Residential and RL -Very Low Density Single- 'Family Residential Districts, one thousand two hundred (1,200) square feet. 2. In the R -1 Low Density Residential District, one thousand (1,000) square feet. 3. In the R -1A Law Density Residential Districts, nine hundred eighty (980) square feet. B. All single-family detached dwellings shall have a permanent frost free foundation or equal, in accordance with the applicable building code. C. Main roofs shall have a minimum pitch, as follows: 1. In the AG- Agricultural, RR -Rural Residential, and RL -Very Low Density Single - Family Residential Districts, a 5 :12 minimum pitch per definition of the applicable building code. 2. In the R -1 Low Density Residential and R -1A Low Density Residential Districts, a 3:12 minimum pitch per definition of the applicable building code. D. Roofs shall be shingled with asphalt, wood, tiles or other comparable materials similar in appearance as approved by the applicable building code. E. Except for earth sheltered homes, all exterior vertical surfaces of a single- family dwelling and accessory structures shall be treated as a front and have an equally attractive, or the same, fascia. Any exterior building finish shall consist of a combination of the following materials: wood, brick, natural stone, aluminum and glass, steel, or vinyl siding. Steel siding with exposed panels exceeding sixteen (16) inches in width, shall not be permitted. F.
