EXECUTIVE SUMMARY FOR ACTION
CITY COUNCIL MEETING DATE: May 4, 2004
ISSUE:
Consider proposed settlement of assessment appeal and condemnation.
BACKGROUND:
As part of the Connemara Trail, Phase 2 project, eminent domain proceedings were
conducted for the acquisition of land necessary to complete the project. Also, special
assessments were levied as part of the project. At this time, City staff and the City
Attorney have reached a tentative settlement agreement with the property owners for
the eminent domain proceedings and special assessment appeal.
SUMMARY:
The City Attorney is requesting that Council convene to an executive session to discuss
the details of the pending litigation and proposed settlement.
