Subject: Waste Container Enclosure Update
The current status of the waste container enclosure enforcement initiative is as follows.
■ 44 commercial and multi- residential violations have been identified and issued
violation notices.
■ 29 commercial and multi - residential - violations have come into compliance or
currently have permits issued for work to come into compliance shortly. This
includes;
o Several downtown area businesses, Amoco, Polfus Implements, Body
Bronze Tanning, Celts, McDivot's, and the Marathon station.
o Also, the strip malls from the old Knowlan's property to Shannon
Parkway along 151 Street, and several multi residential sites throughout
the city.
■ 9 violations in the downtown area were suspended with the implementation of the
Downtown Redevelopment Moratorium, including:
o Terry's Ace Hardware, NAPA, Cha's Auto Repair, Dayna's Dog
Grooming, Shenannigan's, Save More Automotive, Rosemount Floral, It -
Figure's, and the Rosemount Mall. It should be noted that Shenannigan's
has changed ownership during this process and I have to reinitiate the
process with that owner when the moratorium expires.

o McDonalds, Topp's Pizza, and two properties with shared waste services,
considered as one violation, owned by Matthew Daniels Corp on the S W
corner of 151s and Carousel Way. The other two violations that are not in
compliance are newer multi- residential violations that are in the process
but not at the summons stage.
To this point it has not been necessary to issue any summons for these violations. I did
not feel that it was proper to issue summons to other businesses or properties that were
not in compliance on this issue while the moratorium was in place for the downtown area.
All of the businesses in the downtown redevelopment area (other than Shenannigan's as
previously noted), Topp's Pizza, McDonalds, and the Matthew Daniels properties are at
the stage of receiving a summons for the violation's they have received notice of when
the moratorium expires. I will make personal contact with all of the parties prior to
issuing any summons on this issue, if possible, some property owners have not responded
to any of my attempts at contact.
The ordinances allow us several options for enforcement. We can; cite the property
owner, the business /tenant producing the waste being stored in the unenclosed waste
container, and the waste hauler for placing a container without a proper enclosure. All of
our licensed hauler's have been notified of the ordinance requirements and that it is a
violation of their license to place any waste container without a proper enclosure present.
