Klassen's term would have expired at the end of 2004. Council needs to take action to fill this vacancy. The Special Election ordinance adopted in November 2002 specifies that an election must be held within 60 to 90 days of the vacancy — which in this case is between Tuesday, February 18, 2003 and Thursday, March 20, 2003. City Attorney Charlie LeFevere will be available at the meeting to advise Council on this new ordinance and options available to Council RECOMMENDED ACTION: Motion to set a Special Election to fill the remaining two (2) year term of the vacant City Council position for COUNCIL ACTION: CITY OF ROSEMOUNT COUNTY OF DAKOTA STATE OF MINNESOTA ORDINANCE NO. ORDINANCE RELATING TO SPECIAL ELECTIONS TO FILL COUNCIL VACANCIES; ADDING NEW SECTION 5 -1 -3 THE CITY COUNCIL OF THE CITY OF ROSEMOUNT, MINNESOTA, ORDAINS as follows: Section 1. Rosemount City Code is amended by adding new Section 5 -1 -3 as follows: ELECTION TO FILL VACANCIES: If a vacancy in the office of Mayor or City Council occurs with more than 365 days remaining in the term, the position will be filled for the unexpired term by a person elected at a special election to be held not sooner than 60 days or later than 90 day after the occurrence of the vacancy; provided, however, that if 3) the next general municipal election occurs within 365 days of the occurrence of the vacancy, and b) . the vacancy occurs before the first day to file affidavits of candidacy for that election, then the position will be filled by a person elected at a special election held concurrently with that general municipal election. Section 2. This ordinance shall be effective the day following its publication. Adopted by the City Council of the City of Rosemount, Minnesota the day of 2002.
