The Council is asked to consider amending the ordinance regulating the use of firearms and bows within the
City of Rosemount.. The ordinance currently divides the community into two areas - "Restricted" and "Non-
restricted." In the "Restricted" area the use of firearms is prohibited and bows may only be used for target
practice in accordance with specific provisions. In "Non- restricted" areas, the use of firearms and bows for
hunting and target practice is permitted in accordance with specific provisions.
The ordinance amendment proposes to allow archery hunting in some areas of the "restricted" zone. This
change is suggested primarily as a wildlife management tool. Bow hunting of deer is regarded as an effective
means to maintain, or in some cases reduce, the white -tail deer population in urban areas. Hunting in
accordance with existing state and federal laws may safely be done in several areas within the community. The
proposed amendment would make archery hunting legal in rural residential and agriculture zoned areas, as long
as the parcel is 2.5 acres or more in size.
The second primary amendment would create a third designated area for the use of firearms. The proposal is to
create an area in which hunting would be allowed with shotgun as the only permitted firearm. Additional
restrictions on shot type and manner of hunting is also included.
RECOMMENDED ACTION: This is the first reading of the ordinance resolution. If the changes are
desired, the ordinance will be brought back at a future Council meeting for adoption.

AN ORDINANCE RELATING TO BOWS AND FIREARMS;
AMENDING ROSEMOUNT CODE 7 -5
THE CITY COUNCIL OF THE CITY OF ROSEMOUNT, MINNESOTA ORDAINS
AS FOLLOWS:
Section 1. City Code 7 -5 -1, Definitions, is amended to include the following
additional definitions:
NON - RESTRICTED:
That area in the city in which the use of firearms and bow and arrows are
regulated only by state and federal statutes, without any further restrictions
of this ordinance.
RESTRICTED:
That area of the city in which the use of firearms, bows and
arrows is restricted by regulations included in this ordinance in addition to
state and federal statutes.
RESTRICTED SHOTGUN:
That area of the city in which hunting with a firearm is restricted to the use
of a shotgun.
Section 2 . City Code 7 -5 -2 is amended as follows:
DESIGNATED AREAS: For purposes of regulating the use of bows and firearms
within the City, all area within the corporate City limits is divided into certain
restricted (R) and nonrestricted (NR) areas. The area designated restricted (R)
shall be all portions of the City west of Akron Avenue and all areas within the
corporate City limits zoned residential or rural residential. The area designated
nonrestricted (NR) shall be all area within the City limits except that designated
restricted (R).
Within the (R) area, there is an area designated as restricted shotgun (SH). This
area includes all portions of land zoned agriculture in the area west of Akron
Avenue to Bacardi Avenue on the north side of County Road 38, and the area
west of Akron Avenue to the east of the southern half of the eastern section line of
Section 21, Township 115, Range 19 and the northern half of the eastern section
line Section 28, Township 115, Range 19 north of County Road 42 to County
Road 3 8.
Section 3. City Code 7 -5 -3 is amended to read as follows:
F. Bow and arrow use for hunting purposes is permitted on platted
parcels of a minimum of 2.5 acres that are zoned rural residential or
agriculture. All hunting must be done from an elevated stand of a
minimum of five feet. Hunting with a bow and arrow shall be in
accordance with all applicable state laws and regulations.
Section 4 . City Code 7 -5 -6 is added to read as follows:
PERMITTED USES OF SHOTGUNS WITH IN THE RESTRICTED (R)
AREA: The shooting or carrying of shotguns that are not encased or
dismantled is permitted under the following circumstances in designated
(SH) areas in accordance with applicable state and federal law:
A. Single projectile slugs are authorized only for deer hunting.
B. Shot up to #2 shot is authorized for all other hunting or target
shooting.
C. All hunting of deer must be done from an elevated stand of a
minimum of five (5) feet in height.
Section 5. This Ordinance shall be effective following its passage and
publication.
ADOPTED this day of 2003 by the City Council of the City of
Rosemount.
