This report addresses two alternatives for the extension of a lateral sanitary sewer line to serve properties located north of 160' Street, east of Trunk Highway (TH) 3, and west of Biscayne Avenue. The proposed improvements are a result of a signed petition from property owners. As the proposed project is a lateral sanitary sewer extension to provide service to the adjacent properties only, the project cost is proposed to be 100% assessed to the benefiting properties. Before a recommendation can be made, two separate informational meetings will be held. The first one is for affected persons that signed the petition along 160 Street. The second informational meeting will be for Biscayne Avenue residents that could possibly be affected by one of the proposed alternatives. Afterwards, input from residents will be considered and a recommendation will be made at the Public Hearing on April 3 rd The improvements outlined in this report are proposed to be completed in 2003.' COUNCIL ACTION: ry CITY OF ROSEMOUNT DAKOTA COUNTY, MINNESOTA RESOLUTION 2003 - A RESOLUTION RECEIVING THE FEASIBILITY REPORT AND SETTING THE PUBLIC HEARING FOR 160 STREET SANITARY SEWER EXTENSION AND APPURTENANT WORK CITY PROJECT 9365 WHEREAS, the City Council deemed it necessary and expedient that the City of Rosemount, Minnesota, construct certain improvements, to -wit: City Project #365, 160"' Street Sanitary Sewer Extension and Appurtenant Work, in the City as described in and in accordance with the feasibility report prepared by the City Engineer; and WHEREAS, the City Council has been advised by the City Engineer that said utility and street improvements, City Project #365 is feasible, and should best be made as proposed, and the City Engineer's report to this effect has heretofore been received by Council, and filed with the City Clerk on March 6, 2003; and WHEREAS, the statute provided that no such improvements shall be made until the Council has held a public hearing on such improvements following mailed notice and two publications thereof in the official newspaper stating time and place of the hearing, the general nature of the improvement, the estimated costs thereof, and the area proposed to be assessed, in accordance with the law. EXECUTIVE SUMMARY City Project No. 365 includes the extension of a lateral sanitary sewer line to serve properties ' located north of 160 Street, east of Trunk Highway (TH) 3, and west of Biscayne Avenue. The proposed improvements are a result of a signed petition from property owners located along 160 Street. The study includes the analysis of two alternatives to serve the properties along 160 Street for construction. Also identified in this report is the ability to serve properties along Biscayne ' Avenue and 160 Street by extending sanitary sewer southward along Biscayne Avenue. At this time, a recommendation cannot be made until further informational meetings with affected residents are held. A recommendation will be provided at the Public Hearing. Each alternative has an Opinion of Probable Cost for possible improvements. The estimate includes a 10% contingency factor and indirect costs in the amount of 30 %. The project is proposed to be 100% funded through special assessments. This project is feasible, necessary, and cost effective from an engineering standpoint. It is our recommendation that the City Council approve this feasibility study and order a public hearing. INTRODUCTION 2.1 Authorization ' On December 3, 2002, the Rosemount City Council, in response to a petition signed by 100% of affected property owners, authorized the preparation of a Feasibility Report to address infrastructure costs attributed to the 160` Street Sanitary Sewer Extension project. The signed petition and council resolution is included in Appendix A. This project has been designated as City Project No. 365. 2.2 Scope I � This report addresses the construction of sanitary sewer improvements to serve the area located north of 160` Street, west of Biscayne Avenue, and east of TH 3. GENERAL BACKGROUND 3.1 Project Location (Figure 1) ' The project is located north of 160` Street (County Road 46), east of Trunk Highway 3, and west of Biscayne Avenue. 3.2 Existing Conditions The terrain within the project consists of flat and rolling terrain. The land in the project area is mainly used for commercial and agricultural purposes. Sanitary sewer is present on the east side of realigned Trunk Highway 3 and on the south side of 160` Street, which currently serves the Dakota County Highway Facility. Service to the Dakota County Highway Facility was completed in 2002 as part of Dakota County Shop Sanitary Sewer Service Project, City Project No. 332. The sewer line connects into the Section 31 sanitary sewer system that eventually discharges to the Empire Wastewater Treatment Facility. According to the City's Comprehensive Plan, the area north of 160` Street is in the Empire Wastewater Sewer District and was planned to be served by sanitary sewer by 2005. The development of this area would not cause any capacity issues at the Empire Wastewater Treatment Plant. When the Dakota County Shop Utility Service project was designed, it was determined to use an 8 -inch line to discourage extension of sanitary sewer for further development south of 160` Street. Based on the projected usage of water at the Dakota County Highway Facility, there is still enough capacity at peak flow to serve the properties north of 160` Street. However, due to elevation and slope requirements, service from this sewer service to all parcels is difficult. The properties that wish to have sanitary sewer service are mostly commercial properties. One property is undeveloped at this time and is being used agriculturally. All buildings are slab on grade with their septic tank location varying between the front and back of each building. Highstone Limited Partnership and Metro Mosquito Control septic tank locations are on the south side of their buildings. All other septic tanks are located on the north side of each building. Most buildings have newer parking lots that were reconstructed during the 160` Street Reconstruction Project. Watermain exists along the north side of the new north frontage road that was built in 2002 during the reconstruction of 160` Street. Overhead power is also present on the north side of the frontage road. A high - pressure gas line crosses 160` Street approximately 1,200 feet to the east of TH 3 and continues to the northeast. PROPOSED IMPROVEMENTS 4.1 Sanitary Sewer (Figures 2 -4) The proposed sanitary sewer improvements include constructing an 8 -inch lateral sewer line to serve the project area and one service stub per property. Two alternatives have been reviewed. 4.1.1 Alternative I (Figure 2) This alternative would extend sanitary sewer from the existing sanitary sewer on the south side of 160` Street. A jacked crossing of 160` Street would be required to extend sanitary sewer to the north side of 160` Street. The sanitary sewer will then be installed through open cut construction along the north side of the frontage road to 700 feet west of Biscayne Avenue. The proposed alignment is situated entirely inside existing right -of -way; however, minor permanent easements and temporary construction easements would be necessary. The total estimated cost for Alternative 1 is $263,610. There are several issues that arise with this proposed alignment. Both private and public utilities are located along the proposed alignment that could potentially have to be relocated. The most easterly property, Dakota Enterprises, would not be able to be served with this alignment due to the lack of depth of the sanitary sewer. The aforementioned 8 -inch line limits the length of the extension due to minimum slope requirements, limiting potential development to the north. 4.1.2 Alternative 2 (Figure 3) This alternative was identified in the Section 31 sanitary sewer project, and is proposed to be aligned along the north side of the parcels included in the project area. The sanitary sewer would be connected to existing sanitary sewer that was installed as part of the Section 31 sanitary sewer project along TH 3. Most of the sanitary sewer could be installed by open cut the entire distance to Biscayne Avenue. The sanitary would need to be jacked underneath the gas line crossing because of the depth of the sanitary line that allows service to all properties. The total estimated cost for Alternative 2 is $242,080. Alternative 2 is the least expensive option in construction costs but there are several issues with this alignment that are noted as follows: ■ Permanent easements would need to be acquired resulting in splitting of Highstone Limited Partnership, Don Franco, and Metro Mosquito Control. Services from the lateral sanitary line to connect to the septic tank would be extremely long and costly to each business owner. Feasibility Report 166 Street Sanitary Sewer Extension and Appurtenant Work City Project No. 365 Rosemount, Minnesota WSB Project No. 1493 -00 Page 4 4.1.3 Biscayne Avenue Sanitary Sewer (Figure 4) The option of extending sanitary sewer along Biscayne Avenue was also considered as part of this feasibility because Alternative 1 did not provide service to the most easterly property, Dakota Enterprises. There is also a possibility of future development of the property north of Dakota Enterprises; the current fee ' owner of this property is RCD Real Estate Partnership. The Biscayne Avenue Sanitary Sewer extension would connect to the existing sanitary sewer at the intersection of Boulder Trail and Biscayne Avenue. The proposed 12 -inch sanitary sewer would be aligned down the middle of Biscayne Avenue and extend to 160` Street. The entire sanitary sewer line could be installed by open cut and all work would remain in existing right -of -way. The only existing utility present is a watermain that is located on the west side of Biscayne Avenue in the right -of -way. The total estimated cost for Biscayne Avenue sanitary sewer extension is $361,360. Assessments were calculated based on every property owner with frontage to the project being assessed with the exception of the University of Minnesota property. The estimated cost was calculated with no further improvements to Biscayne Avenue besides replacement of the road and the installation of sanitary sewer. If Alternative 1 and Biscayne Avenue were completed as one project to serve all properties, the total estimated cost would be $624,970. 4.2 Permits/Approvals The following permits would be required for the construction of the project: MPCA.................................................... ............................... Erosion Control 4.3 Right- of- Way/Easements The acquisition of temporary and permanent easements will be required for construction of the proposed sanitary sewer line for Alternatives 1 and 2. Easement acquisition for Alternative 1 would be minimal and is expected to be granted to the City. Easement acquisition for Alternative 2 would be more extensive than Alternative 1. Not all of ' these easements would be granted to the City. FINANCING 5.1 Opinion of Cost Detailed Opinions of Cost can be found in Appendix B of this report. The Opinions of Cost incorporate 2003 construction costs and include a 10% contingency factor and all related indirect costs. The indirect costs are estimated at 30% and include legal, engineering, administrative, and financing items. Based on the City's Assessment Policy, the assessments have been calculated using the front footage method. Estimated assessment rolls have been calculated and can be seen in Appendix D. FEASIBILITY AND RECOMMENDATION City Project No. 365 consists of the construction of sanitary sewer and appurtenant work as necessary to construct the extension of 160 Street sanitary sewer. It is the recommendation of WSB & Associates, Inc. that additional meetings be coordinated for affected land owners prior to the Public Hearing. We recommend construction of the proposed improvements based on the recommendation provided at the Public Hearing. Brotzler, P.E., City Engineer AGEN #- 6 f) R ATTACHMENTS: Petition, Resolution, Map APPROVED BY: At the November 5, 2002 Council meeting, a petition for the extension of sanitary sewer services to the properties along 160 Street between Trunk Highway 3 and Biscayne Avenue was presented to Council. The petition presented was signed by three of the six property owners that would be impacted by a sanitary sewer extension project. Following the discussion of this item, Council tabled the item and directed Staff to contact the property owners and advise the petitioners that an attempt shall be made on the part of the petitioners to secure signatures from 100 percent of the property owners that would be impacted by a project. Attached is a new petition that has been submitted by five of the six property owners. Through conversations with Mr. Jerry Anderson, Highstone Limited Partnership, it is Mr. Anderson's opinion that it will be difficult to obtain the signature of Car Nav Five on the petition. Mr. Anderson has requested that this item be brought before Council with the petition signed by five of the six property owners requesting the extension of sanitary sewer service to the area. RECOMMENDED ACTION: MOTION TO ADOPT A RESOLUTION RECEIVING A PETITION AND ORDERING A FEASIBILITY REPORT FOR 160 STREET SANITARY SEWER EXTENSION IMPROVEMENTS (EAST OF TRUNK HIGHWAY 3). This declaration is made in conformity to Minnesota Statutes, Section 429.035. (2) The petition is hereby referred to the City Engineer and that person is instructed to report to the Council with all convenient speed advising the Council in a preliminary way as to whether the proposed improvement is necessary, cost - effective, and feasible and as to whether it should best be made as proposed or in connection with some other improvement, and the estimated cost of the improvement as recommended.
