This item is on_ the agenda to request Payment No. 11 and final to Ryan Contracting Company in
the amount of $91,684.80 for the Evermoor e Phase 2 and Marcotte Pond Outlet, City Projects
#333 and #329.
Staff recommends that Council approve Payment #11 and final for the project and accept the
project for perpetual maintenance.
RECOMMENDED ACTION: MOTION TO APPROVE PAYMENT #11 AND FINAL TO RYAN
CONTRACTING COMPANY IN THE AMOUNT OF $91,684.80 FOR THE EVERMOOR 4 TH PHASE
2 AND MARCOTTE POND OUTLET, CITY PROJECTS #333 AND #329 AND ACCEPT FOR
PERPETUAL MAINTENANCE.

` Dear Mayor and Council Members:
Please find enclosed the final Construction Pay Voucher No. 11 for the above - referenced
project in the amount of $91,684.80. We recommend final payment subject to receipt of
the following items:
1. Satisfactory showing that the contractor has complied with the provisions of
Minnesota Statutes 290.92 requiring withholding state income tax.
2. Evidence in the form of an affidavit that all claims against the contractor by reasons
of the contract have been fully paid or satisfactorily secured.
3. Consent of Surety to Final Payment certification from the contractor's surety.
4. Two -year maintenance bond.
Please make payment in this amount to Ryan Contracting Co. at your earliest convenience.
