Action: City of Rosemount 1 /4 mile south of CSAH 42 @ Boulder Avenue Pahl Family limited Partnership 80 2 parcels, a ten acre parcel and a 70 acre remnant Business Park BP -1 Business Park Recommendation of Approval (4 -0) SUMMARY The City is acquiring land from the Pahl partnership on land south of the developed Rosemount Business Park for a well site, and a possible water treatment facility. The site is contiguous with the crescent shaped Outlot B, a remnant of the Business Park on the south side of Boulder Avenue. This outlot has been expected to be combined with other subdivided parcels, resulting in a number of lots with frontage on Boulder Ave. Eventually, Boulder Avenue will be extended southwest though the well site parcel, and even more frontage will be available. Parcels in the BP -1 Business Park district tend to be five acres or larger. There is no minimum lot frontage requirement, other than frontage along a public street (Boulder Avenue). The parcel for the well house meets all applicable standards for the Business Park District. PLANNING COMMISSION PUBLIC HEARING On April 8, 2003, the Planning Commission conducted a public hearing as required. No one from the audience commented on the proposal. The Planning Commission acknowledged that the items was city initiated. Subsequently, the Commissioners adopted a motion in support of the recommended approval. RECOMMENDED ACTION: Motion to adopt a resolution approving the lot split for the "proposed parcel of land for the well site ". CITY COUNCIL ACTION: r CITY OF ROSEMOUNT DAKOTA COUNTY, MINNESOTA RESOLUTION 2003- A RESOLUTION APPROVING THE LOT SPLIT FOR THE CITY OF ROSEMOUNT WHEREAS, the Planning Department of the City of Rosemount received an application from the City of Rosemount for approval of a division of property, said property legally described as: The North Half of the Southeast Quarter, South Half of the Northeast Quarter of Section 32, Township 115 North, Range 19 West, Dakota County, Minnesota. WHEREAS, the Planning Commission of the City of Rosemount conducted a public hearing on April 8, 2003, as required by the subdivision ordinance, for the purpose of receiving testimony regarding the requested lot division; and, WHEREAS, the Planning Commission adopted a motion to recommend approval of the lot division to the City Council with conditions; and, WHEREAS, on April 17, 2003, the City Council of the City of Rosemount reviewed the recommendation forwarded by the Planning Commission; NOW, THEREFORE, BE IT RESOLVED, the City Council of the City of Rosemount hereby approves the division of the above referenced parcel resulting in the following described parcels: Parcel A All that park of the Southwest Quarter of the Northeast Quarter of Section 32, Township 115, Range 19, Dakota County, Minnesota, described as follows: Beginning at the Northwest corner of said Southwest Quarter of the Northeast Quarter; thence North 89 degrees 26 minutes 13 seconds East, assumed bearing along the North line of said Southwest Quarter of the Northeast Quarter 1284.80 feet; thence South 00 degrees 20 minutes 03 seconds West 120.00 feet; thence South 89 degrees 26 minutes 13 seconds West 544.83 feet; thence South 44 degrees 53 minutes 08 seconds West 862.95 feet; thence South 00 degrees 20 minutes 04 seconds West 124.53 feet; thence South 89 degrees 26 minutes 14 seconds West 134.50 feet, to the West line of said Southwest Quarter of the Northeast Quarter; thence North 00 degrees 20 minutes 03 seconds East 850.00 feet, along said West line, to the point of beginning.
