This item is continued from the August 19, 2003 regular City Council meeting at which Council took action to
table the item. Please refer to the information provided with the Council packet for the August 19, 2003 regular
City Council meeting. Should you require additional copies, please notify Staff prior to the meeting and
additional copies will be provided.
During the discussion of this item at the August 19, 2003 regular City Council meeting, Council directed Staff
to obtain additional information on the following items:
Identification of area as a potential greenway corridor by Dakota County.
• This comment to the EAW was provided by the Dakota SWCD. In follow -up conversations with
County Staff, it appears that the intent of the comment was not to indicate that a greenway corridor
exists within the subject property, but to note the opportunity for the development of a greenway corridor
between UMore Park property and Northern Rosemount Area Lakes and Woodlands as identified in the
Dakota County Farmland and National Area Plan, a copy of which has recently been provided to Staff.
The intent of the Dakota County Farmland and National Area Plan is to identify natural areas and
potential corridors within Dakota County. Participation by property owners with this plan is voluntary.
2. Solicit EAW review comments from the DNR.
DNR Staff was contacted to solicit review comments for the EAW. The only verbal comment provided
was in regards to the proposed construction of apath and dock within the DNR protected wetland for
which a permit will be required. Staff is aware of this requirement and has been in discussions with the
DNR for specific requirements. No written comments were provided.
3. Additional information for the noted dumpsite (Site 5089 (Q -21)).
• The presence of a dump on the subject property has been discussed with the developer. Based on this
discussion, the developer has provided the attached information from a Phase I completed by Braun
Intertec for the site. The developer has indicated that Braun Intertec will be completing additional
fieldwork to determine the extent of the dump content and will be providing information to City Stall.
RECOMMENDED ACTION: MOTION TO ADOPT A RESOLUTION ISSUING A NEGATIVE
DECLARATION OF NEED.

RESOLUTION 2003 —
A RESOLUTION ISSUING A NEGATIVE DECLARATION OF NEED
WHEREAS, the preparation of the Minea Property Residential EAW and comments received on the
EAW have generated information adequate to determine whether the proposed mine site has the
potential for significant environmental impacts; and
WHEREAS, the EAW has identified areas where the potential for significant environmental effects
exist, but appropriate measures have or will be incorporated into the project plan and/or permits to
reasonably mitigate these impacts; and
WHEREAS, the Minea Property Residential Development is expected to comply with all the City of
Rosemount and review agency standards, and
WHEREAS, based on the criteria established in Minnesota R.4410.1700, the project does not have the
potential for significant environmental effects; and
WHEREAS, based on the Findings of Fact and Conclusions, the project does not have the potential for
significant environmental impacts.
NOW THEREFORE BE IT RESOLVED, the City of Rosemount has determined that an
Environmental Impact Statement is not required.

RE: Minea EAW — Parks and Recreation Staff Response to Dakota County Soil
Water Conservation District Comment #1
Parks and Recreation Staff have spoken to Brian Watson of Dakota County Soil
Water Conservation District (DCSWC) and Curt Chatfield of the Dakota County Planning
Department regarding DCSWC's comment #1 regarding the Minea EAW.
The DCSWC's comment states that there is a "potential" greenway corridor link between UMore
Park and the Northern Rosemount Area Lakes and Woodlands identified in the Dakota County
Farmland and Natural Area Plan. Greenway areas are identified within UMore Park and the
County plan but there is no link currently identified or proposed between the two areas. After
confirming this with Mr. Watson and Mr. Chatfield, both gentlemen agreed that the City could
attempt to create a link through use of parks, open space restoration, conservation easements or
ponding areas.

on the 6rte. Braun lntertec recommends that the water well is to be unused or inoperable, then the .vcll be
properly sealed by a licensed well contractor and the septic system be properly abandoned. 'Unused wells
can pose a risk of causing groundwater contamination. A well owner is not liable for contamination of
groundwater from a well that occurs after the well has been properly sealed and if the sealed well has not
been disturbed.
G. Conclusions and Recommendations
We have performed this Phase I ESA of the Site in general conformance with the scope and limitations of
ASTM Practice E 1527 -00. Any exceptions to, or deletions from, this practice are described in
Section A.3 of this report.
This assessment has revealed no indications of recognized environmental conditions in connection with
the Site.
• There are four pipelines located at the Site. The pipelines, transport natural gas and liquid
petroleum Three pipelines bisect the northwestern portion of the Site and trend in an east -west
orientation. One pipeline bisects the Site from the northwest comer to southeast corner. In
addition, there is another pipeline located on the adjoining property to the west.
The Chicago Northwestern Railroad dump was located adjacent and to the south of the Site.
The type of disposal suspected at the railroad dump was listed in the DCEMD as "unregulated
municipal, commercial, or light industrial dump; MMSW, demolition & construction debris,
other single or limited special wastes." The suspected railroad dump was listed with a ranking
of "low priority" and was currently "open." A Iow priority indicates that there is a "low risk

to environment and public, any known hazards confined to immediate site and resolvable,
conditional acceptable risk." An open status indicates the following: no investigation or
incomplete; no cleanup or site resolution.
H. Qualifications of Environmental Professionals
A Braun IntCrtec Statement of Qualifications for this Phase I ESA proj Oct will be provided to the User
upon request.
