During the recently completed legislative session, the Minnesota Legislature amended state law to allow the sale of alcohol at licensed, on -sale establishments until 2:00 a.m. Cities are allowed to have more restrictive hours. If adopted, this ordinance amendment would authorize the licensed on -sale establishments to be open until 2:00 a.m. The proposed amendment will result in Rosemount's City Code adopting the hours of sale as listed in Minnesota State Statute. City Code 3 -1 adopts the state law in the ordinance's first paragraph, except to the extent the provisions of the chapter are more restrictive. The ordinance currently regulates hours of sale in section 3 -1 -8, paragraphs D and E and would be more restrictive than the recently passed amendments to state law if these sections are not repealed. However, the hours and days currently in the ordinance are the same as the restrictions listed in state statute prior to this year's changes. By repealing those sections in city code 3 -1 -8, paragraphs D and E, hours and days of sale will be regulated by state law rather than the city's ordinance. Liquor license holders within the City have expressed a desire to have the hours extended to 2:00 a.m. as permitted by state statute. The businesses want to have the option to remain open, although at this time they do not anticipate remaining open on a nightly basis until 2:00 a.m. RECOMMENDED ACTION: Motion to amend City Code 3 -1: Liquor Regulations by repealing 3 -1 -8, Paragraphs D and E related to hours and days of sale. AN ORDINANCE RELATING TO LIQUOR REGULATIONS; AMENDING ROSEMOUNT CODE 3 -1 THE CITY COUNCIL OF THE CITY OF ROSEMOUNT, MINNESOTA ORDAINS AS FOLLOWS: Section 1. City Code 3 -1 -8 Paragraphs D and E related to the hours and days of sale of intoxicating liquor and 3.2 percent malt liquor are repealed. Section 2. This Ordinance shall be effective following its passage and publication. ADOPTED this day of 2003 by the City Council of the City of Rosemount.
