Cty. e0` At the May 6, 2003 City Council meeting, three project options were presented to Council for the above referenced project. Following the presentation of the three project options, Council adopted a resolution to order a public hearing for Option 2. This option consists of trail and sidewalk improvements on Chippendale Avenue between 145"' Street and a mill and overlay of the street surface. This option also includes the proposed improvements to Chippendale Avenue between 149 Street and 151 St Street and intersection improvements at the intersection of Chippendale Avenue and CSAH 42. The total estimated project cost for this option is $1,358,697. The project cost will be funded with a combination of Municipal State Aid (MSA) Funds, Dakota County Funds, Street CIP Funds, City Core Funds and special assessments. The proposed assessments are shown on the attached revised preliminary assessment roll. As shown on the attached preliminary assessment roll, the proposed assessments for the properties located on Chippendale Avenue south of CSAH 42 are the same as originally proposed. For those properties on Chippendale Avenue north of CSAH 42 proposed to be assessed, the proposed assessment is based on a rate of $13.63 per front foot. An issue that has been previously discussed is the construction of a median along Chippendale Avenue between CSAH 42 and 151 Street and the reduction of access to a right -in, right -out at the driveway to the Holiday /Chippendale Partners Property on the east side of Chippendale Avenue. The attached memorandum from the City's consultant traffic engineer provides an overview of the traffic issues associated with the construction of a median at this location. Traffic Engineer Date: May 15, 2003 Re: Chippendale Avenue — Carlson Property /Holiday Driveway Access City of Rosemount WSB Project No. 1399 -00 A Feasibility Report was prepared in March of 2002 for improvements to Chippendale Avenue between 151" Avenue and 145 Street in the City of Rosemount. As part of the original Feasibility Report, a median was proposed to be constructed between CSAH 42 and 151 Street; thereby, reducing the access at the Carlson Property/Holiday Driveway access to a right -in right -out. After further review of the traffic operation and crash data for this area, it was determined that a temporary median break could be allowed with certain criteria in place for closing the median break in the future. The Feasibility Report was then revised in March of 2003 and is the subject of the May 20, 2003 public hearing. As a result of several comments at previous meetings, a more extensive review of the existing and future traffic operations of the Carlson Property /Holiday Driveway access was conducted. A request was made by Carlson Property and Holiday to develop a revised design that would provide the longest potential time that the median break could be maintained. A revised option was developed by widening Chippendale Avenue south of CSAH 42 to accommodate an additional left -turn lane into the Carlson Property /Holiday Driveway. This alternative provides clear channelization of left - turning traffic into this driveway, as well as providing additional left -turn capacity at the CSAH 42 intersection. This widening would require approximately five to eight feet of additional right -of -way. It is estimated that this widening would cost an additional $30,000 excluding any right -of -way costs. The primary goal of our proposed improvements is to provide for the safest roadway possible for traffic in this area, as well as that traveling to and from the Carlson Property and Holiday Gas Station. City Engineer City of Rosemount May 15, 2003 Page 2 of 3 the Carlson Property /Holiday Driveway access at this time, a pro- active approach to providing the mechanism for closing the median some time in the future is recommended. Based on this goal, there are three options that the City has with respect to this issue. 1. Close the access to right -in right -out as indicated in the original Feasibility Report dated March 7, 2003. This will provide for the safest operation of the intersection now and in the future. 2. Provide the median break allowing the left turn-in movement from Chippendale Avenue to the Carlson Property /Holiday Station driveway access as illustrated in the revised Feasibility Report dated March 20, 2003. This alternative provides for a modified access allowing the left turn-in, but not allowing the left turn-out from the driveway. This option does create additional conflicts and potential for crashes and operational problems on Chippendale Avenue. 3. Widen Chippendale Avenue to provide an additional left -turn lane to the driveway access. This alternative provides for a full- movement access at the Carlson Property /Holiday Station driveway access. It does provide for better channelization and capacity at the intersection over what is allowed today. The conflicts that exist today will still be present with this alternative. With either Option 2 or Option 3 discussed above, it is recommended that a signed agreement be negotiated with the Carlson Properties and Holiday Property that outlines safety and operational criteria for potentially closing the median opening in the future. The recommended criteria are discussed below: ■ Any movement Level of Service E, according to the latest version of the Highway Capacity Manual. ■ Northbound P.M. peak -hour traffic on Chippendale Avenue of 675 vehicles per hour or more. ■ Average daily traffic of 11,500 vehicles per day or more on Chippendale Avenue. ■ More than two (2) crashes in one year at the Carlson Property/Holiday median entrances or crashes that were caused by the median opening, i.e., rear -end crashes or left -turn into oncoming traffic on Chippendale Avenue, etc. ■ Any documented queuing of traffic on Chippendale Avenue to CSAH 42 from the median opening during any time of the day, day of the week, time of the year, as advised by Dakota County. This assumes that Option 2 and Option 3 include the future median closing criteria. While we don't have jurisdiction over this roadway, operation this close to our signalized intersection is of concern. Based on review of this area and knowledge of Closing the median would be the best action now. I provide the following specific comments: A median opening in the center of the NB left turn bay is not desirable. Traffic looking to turn at the intersection does not expect traffic to be turning through an opening here. Southbound traffic will have difficulty turning into a driveway so close to the intersection especially since the driveway access would not have a refuge lane. This is difficult to quantify in terms of level of service. Southbound traffic that just came through the signalized intersection does not expect vehicles to stop again to make a left turn. At similar locations rear end collisions have resulted. Their closure is a roadway decision and thus, an agreement regarding it remaining open or not would not be appropriate. Several legal cases have happened in the manner of median openings -- my understanding is the ruling indicated median openings are not a property right. I'm sure the city's attorney can share more light on this issue. The term "remove when necessary" is vague. I would state based on the geometries the closure is needed now. It will become increasingly more difficult as volumes increase northbound. Once the northbound traffic blocks the median opening it will become a greater safety issue than the problems noted above. We were very encouraged by your willingness to continue discussing options related to the proposed median and access modifications at Chippendale Avenue and CSAH 42. As we discussed, the City's primary interest for this project is designing the safest road improvement possible. We recognize that our interest in safety does not perfectly align with your interests in maintaining ease of access for your customers, and we further recognize that language in the 1985 development agreement regarding access complicates this issue. If the City were to build this intersection new, today, design standards would not allow for a median cut and left -turn access so near the signal. However, this is a reconstruction project and there is clearly a pre - existing condition in place that requires us to work together. City Engineer Andy Brotzler and City Attorney Charlie LeFevere have previously provided recommendations for a revised agreement that identified a number of "triggers" related to safety which would cause the left -in access to be closed. We recognize that the safety issues upon which our assumptions are based, specifically traffic counts, are not in existence today. The City has offered a compromise on access restrictions that would leave a southbound left -in open on Chippendale Avenue until such time that any one of several safety related events occur. The left -in would be signed to prohibit left turns during peak traffic periods of 7:00 — 9:00 a.m. and 3:00 — 6:00 p.m. There would be no left-out to southbound Chippendale. The City feels this prohibition of movements during peak periods would eliminate the greatest potential for traffic accidents. In order to make this compromise work, the City offers this revised list of "triggers" (as we discussed) that reduces the chance of a closure in the near -term future and reduces the level of uncertainty you may experience about the future success of your business. • Total traffic count on Chippendale Avenue in excess of 11,500. • Northbound traffic count, during any hour, in excess of 675. • Service level E or worse at any point of the Chippendale /CSAH 42 intersection. • Any documented queuing of southbound Chippendale Avenue into the CSAH 42 intersection. • Two (2) accidents in one year that are specifically related to operational movements of the Chippendale access driveway. Accidents occurring as a result of a left -in turning movement during restricted time periods of 7 -9 a.m. or 3 -6 p.m. would not be counted against this total.
