Guide Plan Desig: Current Zoning: Planning Commission Action SUMMARY Flint Hill Resources 13020 Line Bend Trail Flint Hills Resources Approximately 7.8 Acres Two GI, General Industrial GI, General Industrial. Recommended Approval 5 -0 The applicant, Flint Hills Resources, requests a Simple Lot Division for the property located at 13020 Pine Bend Trail. The applicant proposes to split off approximately 210 feet from the adjacent northern lot and add it to the subject property to create a new five acre lot. This split is necessary to correct a property line which runs through an existing structure, to create a lot which meets the GI, General Industrial standards and to allow the current residents to purchase this property from Flint Hills Resources. Staff reviewed this application against the performance standards for properties in the GI, General Industrial District and Subdivision Ordinance. This review is detailed in the attached staff report dated September 18, 2003 and summarized below. • The subject property is guided and zoned GI, General Industrial while the existing land.use is single family residential. Therefore, this use is classified as legal non - conforming and will be allowed to exist in its current form and may be maintained but will not be allow to expand. Any expansion of this use or property will be required to conform with the GI, General Industrial District performance standards. • Parcel 2 conforms with the dimensional performance standards for the GI, General Industrial District; however, Parcel 1 becomes non - conforming regarding size and access. • Combine Parcel 1 with the property directly to the north to eliminate this non - conforming lot and allow access to a public street. • According to the City Engineer, no new drainage or utility easements are necessary as a result of this lot split. However, Dakota County may require a trail easement along Pine Bend Trail. The Planning Commission reviewed this item during their September 23, 2003 meeting. At that meeting, the Planning Commission held a public hearing and heard from the applicant. After receiving public comment and reviewing the staff report, the Planning Commission unanimously recomrnended that the City Council approve the Simple Lot Division request from Flint Hills Resources for the property located at 13020 Pine Bend Trail. RECOMMENDED ACTION: The Planning Commission and staff recommend that the City Council take the following action: Motion to adopt a resolution approving a Simple Lot Division for the property located at 13020 Pine Bend Trail. This recommendation is base on the findings made in the September 18, 2003 staff report and subject to the conditions outlined below. 1. Any expansion of the use or property will be required to conform with the GI, General Industrial District performance standards. 2. Combine Parcel 1 with the property directly to the north to eliminate this non- confornling lot and allow access to a public street. 3. Provide a trail easement to Dakota County along Pine Bend Trail. 4. Conform with all applicable utility standards as outlined by the Building Official. 5. Conform with all other requirements of City staff and pay all applicable development fees. CITY COUNCIL ACTION: CITY OF ROSEMOUNT DAKOTA COUNTY, MINNESOTA RESOLUTION 2003- A RESOLUTION APPROVING THE LOT SPLIT /COMBINATION FOR FLINT HILLS RESOURCES WHEREAS, the Planning Department of the City of Rosemount received an application from Flint Hills Resources for approval of a division of property, said property legally described as: The South 389.7 feet of the West 560.00 feet of the West Half of the Southwest Quarter of Southwest Quarter of Southwest Quarter of Section 17, Township 115, Range 18; AND The West 560.00 feet of that part of the West Half of Northwest Quarter of Section 20, Township 115, Range 18, lying North of the Pine Bend — Hastings Road. WHEREAS, the Planning Commission of the City of Rosemount conducted a public hearing on September 23, 2003, as required by the subdivision ordinance, for the purpose of receiving testimony regarding the requested lot division; and, WHEREAS, the Planning Commission adopted a motion to recommend approval of the lot division to the City Council with conditions; and, WHEREAS, on October 21, 2003, the City Council of the City of Rosemount reviewed the recommendation forwarded by the Planning Commission; NOW, THEREFORE, BE IT RESOLVED, the City Council of the City of Rosemount hereby approves the division of the above referenced parcel resulting in the following described parcels: Parcel A That part of the South 389.7 feet of the West 560.00 feet of the West Half of the Southwest Quarter of Southwest Quarter of Southwest Quarter of Section 17, Township 115, Range 18 lying North of the South 210.13 feet thereof. Parcel B The South 210.13 feet of the West 560.00 feet of the West Half of the Southwest Quarter of Southwest Quarter of Southwest Quarter of Section 17, Township 115, Range 18; AND The West 560.00 feet of that part of the West Half of the Northwest Quarter of Section 20, Township 115, Range 18, lying North of the Pine Bend — Hastings Road. BE IT FURTHER RESOLVED, the approval of this lot split is subject to: 1. Any expansion of the use or property will be required to conform with the GI, General Industrial performance standard. 2. Combine Parcel A with the property directly to the north to eliminate this non- conforming lot and allow access to a public street. RESOLUTION 2003- 3. MEMORANDUM TO: Rick Pearson, City Planner City of Rosemount Planning Commission FROM: Jason Lindahl, A.I.C.P., Assistant City Planner DATE: September 18, 2003 RE: Simple Lot Division — 13020 Pine Bend Trail BACKGROUND The applicant, Flint Hills Resources, requests a Simple Lot Division, for the property located at 13020 Pine Bend Trail. The applicant proposes to split off approximately 210 feet from the adjacent northern lot and add it to the subject property to create a new five acre lot. This split is necessary to create a lot which meets the GI, General Industrial standards and to allow the current residents to purchase this property from Flint Hills Resources. ISSUE ANALSIS Laud Use & Zoning. The subject property is guided and zoned GI, General Industrial. However, the existing land use is single family residential. Therefore, the property is classified as legal non - conforming. Staff informed both the applicant and the potential buyers of this classification. Both parties understand that due to this classification, the residential use may be maintained and will be allowed to exist in its current form but will not be allow to expand. Any expansion of the use or property will be required to conform with the GI, General Industrial District performance standard. Lots. The applicant proposes to split off approximately 210 feet from the adjacent northern property and add this land to the subject property to create a new five acre lot. The details of this split are illustrated in the table below. The result of this split is that Parcel 2 will conform with the dimensional performance standards for the GI, General Industrial District while Parcel 1 becomes non - conforming regarding size and access. Therefore, staff recommends that a condition of this approval require the applicant to combine Parcel 1 with the property directly to the north. This will eliminate Parcel 1 and create two lots which conform to the GI, General Industrial District dimensional performance standards. As proposed, Parcel 1 would not have access to a public street while Parcel 2 would have access to Pine Bend Trail via an existing gravel driveway. The access issue for Parcel 1 can be eliminated by requiring the applicant to combine Parcel 1 with the property to the north. Staff recommends that this be add as a condition of approval. Grading & Drainage. This lot split will not create any new dwellings or require any on site grading. Utilities. The applicant's site plan illustrates a well and two drain fields. The site will be required to meet all applicable utility standards as outlined by the Building Official. Easements. According to the City Engineer, no new drainage or utility easements will be required as a result of this lot split. However, Dakota County may require a trail easement along Pine Bend Trail. Park Dedication. This lot split will not create any additional lots and therefore the City will not require a park dedication fee. CONCLUSION AND RECOMMENDATION Staff recommends approval of a Simple Lot Division for the property located at 13020 Pine Bend Trail. The split is necessary to create a lot which meets the GI, General Industrial standards and to allow the current residents to purchase this property from Flint Hills Resources. Staff's recommendation is based on the information submitted by the applicant and findings contained in this report. This recommendation is subject to the conditions listed below. 1. Any expansion of the use or property shall conform with the GI, General Industrial District performance standard. 2. Combine Parcel 1 with the property directly to the north to eliminate Parcel 1 which is non - conforming lot and allow access to a public street. 3. Provide a trail easement to Dakota County along Pine Bend Trail. 4. Conform to all applicable utility standards as outlined by the Building Official.
