Council is asked to approve the amendment of City Code 3 -8, Adult Use Establishments. This ordinance was
reviewed when the Saunas and Massage Parlors ordinance was being reviewed, because saunas and massage
parlors were regulated as adult uses. The proposed change is only adding one definition to Adult
Establishment.
The definition change essentially states that if an employee or independent contractor of a business works or
performs in the nude or partial nudity, the business is an adult establishment. This language addresses any
business that may try to have workers performing duties topless or otherwise nude. It also provides another
means to address any illegitimate massage service that is actually a front for prostitution. For example, services
advertised in City Pages or other similar media.
City Attorney LeFevere has reviewed and approved the proposed amendment to the ordinance.
RECOMMENDED ACTION: Motion to amend City Code 3 -8 by adding a definition to section 3 -8 -2 of
the Code.

AN ORDINANCE RELATING TO ADULT USE ESTABLISHMENTS;
AMENDING ROSEMOUNT CODE 3 -8
THE CITY COUNCIL OF THE CITY OF ROSEMOUNT, MINNESOTA ORDAINS
AS FOLLOWS:
Section 1. City Code 3 -8 -2: Definitions, is amended to include the following additional
definition under Adult Establishment:
C. Any business that has employee(s) or independent contract(ors) working or
performing in the business and the employee(s) or independent contract(ors) are
nude or partially nude to expose the genitals, pubic region, buttock, female
breast(s) below a point immediately above the areola.
Section 2. This Ordinance shall be effective following its passage and publication.
ADOPTED this day of 2003 by the City Council of the City of
Rosemount.
