Planning Commission Action: Recommendation of adoption (4 -0) SUMMARY Irish Dome, L. L. C. has proposed constructing an inflatable dome on leased School District 196 property. The facility would be available for school use from 5:30 to 7:00 am, and 1:30 to 5:00 pm during school year. In return, the dome would be available to fee- paying customers during evenings and weekends. After the 20 -year lease expires, the dome would be donated to the Rosemount High School. The zoning issue is the Commercial recreation aspect of the use. It is likely that this arrangement enhances existing public facilities, and creates a facility available for public (ISD 196) use that would otherwise not get built — an obvious incentive for the City to explore the Irish Dome & ISD 196 partnership. It is important to note that Commercial zoned land is available elsewhere that may be more suited to the provision of accommodating access, parking, utilities, complementary commercial uses and of course, tax base. The strategy is to narrowly define what circumstances will permit the commercial venture without inadvertently opening up all public land for inappropriate commercial uses. Such a precedent might result in pressure for cheaper leased land, eroding the market demand for commercial land, increase the burden on public facilities such as parking, and, introduce incompatible commercial uses near residential uses. If the zoning amendment is adopted, the dome proposal will have to proceed through the Conditional Use Permit and Building Permit process to address all pertinent site development and code compliance issues. PLANNING COMMISSION PUBLIC HEARING Michael Manning and Jody Otto were present to discuss the facility. No one else from the audiance provided comment. Commissioners asked about the possibility of a stadium. Staff clarified that if it was completely public (non- profit) it would be permitted if it met standards. RECOMMENDED ACTION: Motion to adopt an ordinance amending the Ordinance B, the zoning ordinance to permit Commercial Recreation in the Public & Institutional District. Section 6.18.0 of Ordinance B - City of Rosemount Zoning Ordinance is amended to read as follows: 6.18.: C. Uses Permitted by Planned Unit Development (PUD): 1. Cemeteries. (Ord -43, 7 -5 -94) Uses Permitted by Conditional Use Permit (CUP) in accordance with Section 12.7, Conditional Use Permits (CUP): 1. Commercial Recreation, both indoor and outdoor by agreement or lease with a sponsoring governmental property owner fora facility that is jointly used by private and governmental entities. 2. Inflatable Domes Stadiums and Structures such as domes that are incompatible with residential districts shall be located a minimum of 500 feet from any residential district or use. 3. Cemeteries in accordance with the standards of Section 12.10 SECTION II. This ordinance shall be effective immediately upon its passage and publication according to law. You indicated that you would like the School District to express its support of the project in writing and to complete relevant portions of a Rezoning/Zoning Ordinance Text Amendment Petition. The School District is very interested in leasing its land to Irish Dome, L.L.C. for purposes of the operation of a domed recreational facility to be named the Irish Dome. School District administration is also supportive of a change to the City of Rosemount's zoning ordinance, if such a change is necessary to make the Irish Dome a reality. The proposed arrangement with Irish Dome, L.L.C. will provide ISD 196 school children with access to improved recreational facilities. In exchange for the lease of School District land, the School District will be entitled to use the dome for five hours per school day and additional hours during the month of August. In addition, ownership of the Irish Dome will pass to the School District at the conclusion of the twenty -year lease term. The School District is supportive of the project due to the benefits it will provide to ISD 196 students and intends to continue to pursue the matter with Irish Dome, L.L.C. The School District and Irish Dome, L.L.C. are currently negotiating the terms of a lease agreement. The first draft of the lease as proposed by Irish Dome, L.L.C. is identified as Exhibit F in the bound presentation prepared by Irish Dome, L.L.C. It is my expectation that the School Board will approve a revised version of the lease at its June 9, 2003 School Board meeting. As you requested, I have also enclosed a Rezoning/Zoning Ordinance Text Amendment Petition. Please let me know if I can provide you with additional information regarding this endeavor. The critical issues are: A. Rosemount High School Athletic Department retains the right to use the facility free of charge (including utilities) before and after school on days when school is in session. B. Rosemount High School Athletic Department retains the right to use the facility all weekdays in August free of charge at the start of the Fall Sport Season until school starts. C. At the end of the 20 -year lease, ISDLLC will make a complete charitable donation of the dome and permanent fixtures (Including the turf) to Rosemount High School. The dome fabric is anticipated to have a- useful life of 25 -30 years. The cost to replace the fabric in today's dollars is approximately $400,000.00, which the school district is aware of. The turf is professional quality outdoor athletic turf .(currently being installed outdoors at Minnetonka High School's football field and recently installed at Hopkins High School). If the school chose to not replace the dome the fields are intact and useable as outdoor fields. D. No exterior advertising and interior advertising subject to pre- approval by the High School. Expected Customer Count Usage Rates: The site currently has one softball field and one full size soccer field. The dome will encompass these fields resulting in the same usage of the site. The dome will have the capability to create two smaller soccer fields or two smaller softball fields, effectively increasing the amount of fields available for the high school and the community. Since soccer utilizes more players, we based our customer count usage rate on two indoor soccer teams on each of the two soccer fields. In the event a full -size field was being used, the player roster is approximately the same since there is only one field and two teams instead of two fields and four teams. The attached spreadsheet, Exhibit G, projects the Customer Count for each of the two primary sports. Parking and Access: As the High School does currently, we are asking for the right to use of the parking lot at Schwarz Pond and the over -flow lot adjacent to the park identified on Exhibit A. These lots currently accommodate approximately 120 -150 parking spots (depending whether parking in the center of the main lot is permitted as currently occurs now). These lots provide parking for one of the two soccer fields, the Rosemount High School Varsity Baseball Field, one softball field, and the park itself.. We estimate that at least 102 parking spots are necessary for the normal daily activities of the Dome. Attached is Exhibit H showing our calculation of this estimate. Soccer has a higher participant rate than softball, so we will use the highest figures for our assumptions. DWG. #: high school athletic department for several hours a day and we would operate the facility in the evenings and weekends for fee paying customers. Our proposal is as follows: We would be responsible for all: - Construction costs of the facility including utility hookups. Based upon the attached facility proposal our cost will be well in excess of $IM. - All interior and structural maintenance for the facility. All operational expenses including utilities. - Insurance for the structure, interior contents and liability insurance for non -high school events. Adequate staffing for operation of the facility. The high school (district) would provide: The land mentioned above on a 20 -year lease basis. The right to utilize the existing parking lot, which has in excess of 100 parking spots. - - Exterior grounds maintenance (lawn cutting/snow removal). In exchange for the above we would: - Provide access from 5:30 a.m. to 7:00 a.m. before school and from 1:30 p.m. to 5:00 p.m. after school during the school year to the facility for the Rosemount high school coaches and their participants. Based upon hourly rental rates at other local facilities we value this time at well over $1,000.00 per week. - Donate the dome to the Rosemount High School athletic department subsequent to the termination of the 20 -year lease. We believe in today's world of budget shortfalls and cutbacks that public- private partnerships similar to this concept will become more common. The Braemar Golf dome in Edina is an early example of a public - private partnership. The Fort Snelling Tennis Dome as well as the Nicollet Tennis Center are recent examples.
