On May 7, 2002, a public hearing was conducted for the Connemara Trail Phase 2 Improvements. The feasibility
report for the Connemara Trail Phase 2 Improvements project addressed the overall project, which consists of the
Connemara Trail Phase 2 Street and Utility Improvements, the Brockway Draw Trunk Sanitary Sewer and Storm
,Sewer Improvements, the Biscayne Avenue Street and Utility Improvements and the Keegan Lake Outlet
Improvements. Following the public hearing, Council ordered the improvements for the Brockway Draw Trunk
Sanitary Sewer and Storm Sewer Improvements, with the project being completed in 2002.
Upon review of past Council action associated with the Connemara Trail Phase 2 Improvements project, it has
been determined that for the Connemara Trail Phase 2 Street and Utility Improvement project and Biscayne
Avenue Street and Utility Improvement project, a new public hearing is required to allow Council to adopt a
resolution ordering the improvements prior to Council considering the award of a contract for the projects. The
adoption of this resolution is a necessary step in the Minnesota Statutes Chapter 429 process for local
improvements and special assessments for the City to retain the ability to bond for project costs and recover
project costs through special assessments.
As the bids for the Connemara Trail Phase 2 and Biscayne Avenue Street and Utility Improvements will be
received on May 16, 2003 and presented to Council on May 20, 2003, Staff is recommending Council action to
set a public hearing for the project on May 20, 2003.
RECOMMENDED ACTION: MOTION TO ADOPT A RESOLUTION SETTING THE PUBLIC
HEARING FOR CONNEMARA TRAIL PHASE 2 IMPROVEMENTS, CITY PROJECT #343.

RESOLUTION 2003 -
A RESOLUTION SETTING THE PUBLIC HEARING FOR
CONNEMARA TRAIL PHASE 2 IMPROVEMENTS
CITY PROJECT 4343
WHEREAS, the City Council deemed it necessary and expedient that the City of Rosemount, Minnesota,
construct certain improvements, to -wit: City Project #343, Connemara Trail Phase 2 Improvements, in the
City as described in and in accordance with the feasibility report prepared by the City Engineer; and
WHEREAS, the City Council has been advised by the City Engineer that said utility and street
improvements, City Project #343 is feasible, and should best be made as proposed, and the City Engineer's
report to this effect has heretofore been received and accepted by Council, and filed with the City Clerk on
April 2, 2002; and
WHEREAS, the statute provides that no such improvements shall be made until the Council has held a public
hearing on such improvements following mailed notice and two publications thereof in the official newspaper
stating time and place of the hearing, the general nature of the improvement, the estimated costs thereof, and
the area proposed to be assessed, in accordance with the law.
NOW THEREFORE IT BE FURTHER RESOLVED, by the City Council of the City of Rosemount that a
public hearing be scheduled to consider City Project #343, Connemara Trail Phase 2 Improvements be held on
Tuesday, May 20, 2003 at 7:30 o'clock p.m. or as soon thereafter as possible, in the Council Chambers of the
City Hall.
ADOPTED this 6 th day of May, 2003.
