AN ORDINANCE AMENDING THE ZONING ORDINANCE AND CITY CODE: PERTAINING TO THE STORAGE AND PARKING OF RECREATIONAL VEHICLES WITHIN THE CITY. The purpose of this ordinance is to promote and protect public health, safety and the general welfare by regulating the orderly storage of recreational vehicles, the location and composition of the surfaces they are stored upon and to reduce the visual impact to neighborhoods caused by storage of Recreational Vehicles. The elimination of encroachment on public right of ways, district setbacks and the risks posed to vehicular and pedestrian traffic caused by improper Recreational Vehicle storage near intersections or on streets will serve the public safety. THE COUNCIL OF THE CITY OF ROSEMOUNT ORDAINS AS FOLLOWS: Section. 1. Rosemount Zoning Ordinance, section 4.9:C, text is amended as follows: 4.9:C Except as otherwise permitted in this ordinance; 1. Recreational vehicles shall not be stored outdoors in any but the "AG" and "R" Districts. (Recreational Vehicle Storage accessory to multiple - family development shall be subject to Section 6.8.D.5. of this Ordinance or to an approved Planned Unit Development.) 2. Recreational vehicles shall not be parked on public property, public right -of -way or the boulevard. 3. Recreational vehicles shall not be parked on the street between the hours of 2 a.m. and 6 a.m. a. Seasonal parking restrictions (8 -2 -2 C, 1 and 2) shall also apply. 4. Parking setbacks must be followed as designated by district. 5. RV storage is limited to recreational vehicles owned by those residing on the premises. However, the temporary oversize RV storage permit issued by the community development department as outlined in this chapter shall allow the storage of one (1) guest oversize RV in single - family residential districts in compliance with permit requirements. 6. No RV may be used as a temporary residence, shop or office while stored or parked on any property within the city. a. Exception: Any RV or trailer unit used by police, fire, EMS, public works or any other agency registered with or requested by the city to provide assistance within the city in any emergency or disaster situation is exempt from these provisions as authorized by the city. l b. Exception: Construction job site, development or real estate temporary offices, shop, or sales trailers are allowed as authorized by the Building and planning departments. c. Exception: Authorized mobile services such as; bloodmobile, bookmobile, mobile clinics and labs or other public services are allowed as authorized by the community development department. 7. Within "R" Districts, recreational vehicles shall not be stored in any portion of the front yard. a. Exception, Driveway storage: Boats, personal watercraft, ATV's, snowmobiles, the trailers used to convey them, slide in campers, pop -up campers, utility trailers and RV's under twenty -three feet (23') in length and 6500 pounds (empty weight) may be stored in the driveway area of single- family residential property on an approved driveway surface. i. Storage of RV's in front yard single - family residential driveways must not extend closer than fifteen feet (15') to the curb line. H. At no time shall RV's stored in driveways block public sidewalks or paths. iii. Stored RV's must also meet the ordinance requirements for intersection sight triangle requirements at corners and intersections. iv. Only two (2) RV's may be stored outdoors on any single - family residential property. Only one (1) of those RV's shall be an oversized RV. A temporary oversize RV storage permit issued by the community development department does not create an exception for more than one oversize RV to be stored on the property. b. Exception, Oversize RV's: Those RV's over twenty- three feet (23') and/or 6,500 pounds empty weight shall not be stored in the front yard or front yard driveway area, past the front line of the residence in single - family residential districts. i. Exception, Temporary Loading: One (1) oversize RV may be stored in the front yard driveway area of single- family residential property for temporary loading. ii. Temporary loading storage of one (1) oversize RV in the front yard driveway areas of single - family residential property shall not - exceed forty-eight (48) .hours in duration. iii. One f 1) oversize RV may be stored in the side yard, street side yard, or back yard area of single - family residential property if all parking setback, surfacing, and screening requirements are met. iv. One (1) oversize RV may be stored in the front yard driveway area of single - family residential property if a temporary storage permit is obtained and displayed on the oversize RV while it is so stored. c. Temporary oversize RV storage permits. i. A temporary oversize RV storage permit may be issued by the community development department for the temporary storage of one (1) oversized RV in the front yard driveway area of a single - family residential property if all requirements for such permit are met and the required fee is paid. Fee to be set by council and reviewed annually. ii. The temporary oversize RV storage permit will allow the temporary storage of one (1) oversized RV fora period of ten (10) days. iii. No more than four (4) temporary oversize RV storage permits shall be issued for any single - family residential property in one (1) calendar year. iv. Temporary oversize RV storage permits may not run . consecutively, at least fourteen (14) days must elapse from the expiration date of any previous permit before another permit can be issued. v. Oversize RV's with a valid temporary oversize RV storage permit may be stored in the front yard driveway area of a single - family residential property if; all parking, setback and surfacing requirements are met; the oversize RV being stored is no closer to the curb line than fifteen feet (15'); and, all other zoning and code requirements are met. vi. The temporary oversize RV storage permit shall be displayed on the oversize RV and be visible from the street. d. Screening for oversized RV storage. i. Oversized RV storage in the side, street side, or backyard area of single- family residential property shall require screening to reduce the visual impact of oversized RV storage to abutting property as follows. ii. An oversized RV stored in a single- family residential property rear, side, or street side yard must be screened from the view of your immediately adjacent neighbor's, streets, common green space or ponding area, and any public park as required by this section. iii. Evergreen plantings shall be used to provide screening for oversized RV's. Such plantings shall be seventy -five percent (75 %) of the height of the oversize RV they are intended to screen at the time of planting and must completely screen the oversized RV from view when they reach maturity. iv. Combinations of fencing and plantings: Fencing shall be used to provide access and exit to and from the oversize RV storage via gates. Such fencing shall be six feet (6ft) in height, at least 85 % opaque and meet all requirements of the building code and zoning ordinances. v. Maintenance of screening: Plantings and fences used to screen oversized RV's stored on single - family residential property must be maintained. Any plantings that die must be replaced immediately as required for original plantings in this chapter. Any plantings that do not grow to a height sufficient to completely screen the oversized RV within three years must be replaced as required for original plantings in this section. All fencing must be maintained as required by the zoning ordinance, city code, and building codes. The eighty -five percent (85 %) opacity of the fencing as required by this section at installation must also be maintained. vi. Site plan review required. Review and approval of oversize RV storage area site plans for compliance by the planning, building, and engineering departments shall be required prior to installation of the oversize RV storage area 9. Within "Rural Residential" and "AG" districts RV's may not be stored in the front yard area other than on an established driveway or RV storage area. a. Oversized RV's stored on rural residential or agricultural property shall meet the requirements for screening of oversized RV's as described in this chapter if the oversize RV storage area is within three- hundred feet (300') of another residence, a road, or any lake, pond or river with authorized public access. g. Only three (3) RV's shall be stored outdoors on rural residential or agricultural property. Only one (1) of those RV's shall be an oversized RV. h. Maintenance of screening: Plantings and fences used to screen oversized RV's stored on rural residential or agricultural property must be maintained as follows. Section 2: Rosemount City Code, Section 8- 2 -2:I, text is amended as follows: 8 -2 -2:I Parking Surface: All parking must be on one of the following surfaces; 1. Concrete, 2. Bituminous, 3. Brick pavers, a. Exception: For RV parking only; in- single family residential rear, side, or street side yards, or; on agricultural property where district setback requirements can be met; b. Decorative rock, minimum class V (5), to a depth of four (4 ") inches with a commercial grade weed preventative mesh underlayment. c. Edging must be installed to prevent the rock from spreading from the designated parking area. d. The parking area must be at least equal in size to the RV being stored and completely covered with the proper surfacing material. e. Decorative rock and the required weed preventative mesh underlayment, allowed for RV storage, must be continuously maintained to prevent weed growth and deterioration. f. Screening as required in sections 4.9:C, 7, d, i -vi, and 4.9:C, 9, f, must be installed and maintained to screen oversized RV's. 6 Section 3: This ordinance will become effective from and after its date of publication. City Enacts New Recreational Camping Vehicle Ordinance On Tuesday, December 17th, the City Council voted to enact a new ordinance regarding recreational camping vehicles in the City. The ordinance prohibits the parking of any recreational camping vehicles on the street in a residential district. It also prohibits the parking of a recreational camping vehicle in the driveway of a home in a residential district that is greater than 10 ft in height, greater than 23 ft in length or greater than 6,500 lbs. in weight. Special temporary permits may be issued by the City. Please see the ordinance language for the permit requirements. This ordinance will go into effect upon publication on January 31, 2003.
