The Parks and Recreation Commission recently reviewed the 2003 Fees and Fee Schedule. The items listed below are two changes recommended by the Commission. Arena : The Commission recommended including language to protect against revenue loss from those who reserve ice and then attempt to cancel their reservation. The recommended language is shown in the attachment for arena fees. Parks Dedication: Attached is a copy of our current and proposed parks dedication fees, a survey reviewing parks dedication fees, a market value analysis report and the dedication portion of the state statute regarding parks dedication. The market value analysis provides typical land values for certain types of land values in our community. The park dedication fees we currently receive are used to pay for new park development, for the purchase of land or for other new park upgrades. Due to the rising cost of land and park construction, we need to keep our parks dedication fees updated based on the market value of land. Based on the proposed increases to the dedication fees, the per acre or per unit cost would be as follows: Residential $1,800 per unit or $45,000 per acre (no change) Industrial $2,250 per acre based on a 5% dedication amount Commercial $q,f00 per acre based on a 5% dedication amount On January 27, 2003 after reviewing the information regarding parks dedication fees provided to the Council, the Parks and Recreation Commission recommended that the Council increase the parks dedication fees from $40,000 to $45,000 per acre for Industrial development, $40,000 to $90,000 per acre for Commercial development, and continue to charge $45,000 per acre for Residential development. Staff also supports the Parks and Recreation Commission's recommendation. RECOMMENDED ACTION: Motion to approve a resolution to amend the 2003 Fees and Fee Policy. VWX COUNCIL ACTION: ATTACHMENT 1 Rosemount Parks & Recreation Fees and Fee Policy Appendix II — 2003 4. Gymnasium Fee class Full Gym Full Day Class 1 Fees based upon directly cleaning and set -up costs and other costs directly associated with the event. Class 2 $30 per hour $200 Class 3 $40 per hour $300 Class 4 $60 per hour $450 The Gymnasium Kitchen may be rented for $50 per day. Banquets or dance events in the gymnasium will be charged Banquet Room rates. Groups of 50 or more, using the gymnasium will be charged a custodial fee of $15.00 per hour of use. 5. Audiovisual Equipment Easels, paper and markers may be rented for $15 per use. (Easels are free of charge if no paper and markers are requested.) The remaining equipment including the overhead projectors, slide projector, and TVNCRs may be rented for $10 per use. There is no charge for use of microphones and lecterns. Portable LCD Project may be rented at $200 per use, subject to availability. 6. Arena Prime Time Ice $145 per hour (+ tax) Non Prime Time Ice $110 per hour (+ tax) Summer Ice $110 per hour (+ tax) Open Skating Fee Evening and holiday vacation $3.00 Daytime open skating fee $1.00 Skate Sharpening $ 3.00 Prime and Non -Prime Ice Season January, February, March, September, October, November, and December Summer Ice April, May, June, July and August. 5 Rosemount Parks & Recreation Fees and Fee Policy Appendix II — 2003 Dry Floor Event fees to be negotiated by management staff. Prime Time Monday -Friday 7:00 a.m.- 10:00 p.m. and Saturday and Sunday 6:00 a.m.- 10:00 p.m. Non Prime Time Monday -Friday 10:00 p.m. - 7:00 a.m., Saturday and Sunday after 10:00 p.m. The order of priority for scheduling of ice time to major users ( +200 hours per year) is as follows: 1. Community Center sponsored programs (open skating, learn to skate, events, etc.) 2. Rosemount High School Girls and Boys Hockey games and practices, based on limits mutually agreed upon. 3. Rosemount Area Hockey Association. 4. Other hockey associations or organizations requesting 200 or more hours per year. After the above groups have been scheduled consecutively, ice time for secondary users (less than 200 hours per year) will be scheduled on a first come first serve basis. S. Cancellations Cancellations will be subject to 50% of the rental fee. D. Deposits 1. Specific to banquet room events, a damage deposit of $300 is required two weeks prior to the event. As to Auditorium and Gymnasium, depending on the type of event and group size, a damage deposit of up to $300 may be added to rental charges. Pending the rental space does not incur any damages, the deposit will be refunded within 21 days after the event date. 2 Specific to the auditorium, banquet room and gymnasium, a non- refundable rental deposit of one half the fee is required within two weeks of permit issue. The renter will forfeit the reservation if the rental deposit is not received within two weeks after the permit issue date. The balance of the room fee is due two weeks prior to the event. Specific to the ice arena, a minim non- refundable deposit of $45 per hewuf 50% of the total contract price is required upon receipt of ice arena contract for use. The remainder of the contract shall be paid before the group gets on the ice. RAHA and RHS (ISD 196) are exempt from paying a deposit and will make full payment for the previous month's ice bill. 2 ATTACHMENT 2 PARK DEDICATION FEES Park dedication fees are outlined in City Ordinance No. XVIL 103 which states: In all new residential subdivisions, the City shall require that a sufficient portion of such land be set aside and dedicated to the public for parks, playgrounds or other public use exclusive of property dedicated for streets and other public ways. It shall be presumed that a sufficient amount of land has been dedicated for parks and playgrounds for the present and future residents of the subdivision, if the subdivider dedicates at least 1/25 of an acre per dwelling unit that can be constructed in the subdivision. The City upon consideration of the particular type of development proposed in the subdivision may require larger or lesser amounts of land be dedicated if the City determines that the present and future residents of the subdivision would require greater or lesser amounts of land for such purposes. The City shall determine whether cash in lieu of land dedication is more appropriate. The amount of cash dedication shall be determined by multiplying the number of acres otherwise required to be dedicated by the average value of comparable undeveloped land set by resolution by the City Council. In all new commercial and industrial subdivisions, it shall be presumed that a sufficient amount of land has been dedicated to serve the needs of the resident and working population if the subdivider dedicates at least five percent (5 %) of the land in the subdivision for parks, recreation and usable open space. Land must be dry upland with slopes less than 10% Richfield- City has no parks or trail dedication fee. They are considering such an ordinance. Note: Residential dedication fees are calculated per unit. Please note that these market value estimates are intended to reflect "typical" values for the selected uses within the City of Rosemount, and as such each is intended to represent a typical site and a typical value within a range of possible values for each intended use. The actual value of parcels intended for any given use can vary significantly depending upon current market conditions, location; size, topography, trees and foliage, etc.. Sections 471.345 and 574.26 do not apply to improvements made by a subdivider or a subdivider's contractor. The regulations may permit the municipality to condition its approval on compliance with other requirements reasonably related to the provisions of the regulations and to execute development contracts embodying the terms and conditions of approval. The municipality may enforce such agreements and conditions by appropriate legal and equitable remedies. Subd. 2b. Dedication. The regulations may require that a reasonable portion of any proposed subdivision be dedicated to the public or preserved for public use as streets, roads, sewers, electric, gas, and water facilities, storm water drainage and holding areas or ponds and similar utilities and improvements. In addition, the regulations may require that a reasonable portion of any proposed subdivision be dedicated to the public or preserved for conservation purposes or for public use as parks, recreational facilities as defined and outlined in section 471.191 playgrounds, trails, wetlands, or open space; provided that (a) the municipality may choose to accept an equivalent amount in cash from the applicant for part or all of the portion required to be dedicated to such public uses or purposes based on the fair market value of the land no later than at the time of final approval, (b) any cash payments received shall be placed in a special fund by the municipality used only for the purposes for which the money was obtained, (c) in establishing the reasonable portion to be dedicated, the regulations may consider the open space, park, recreational, or common areas and facilities which the applicant proposes to reserve for the subdivision, and (d) the municipality reasonably determines that it will need to acquire that portion of land for the purposes stated in this paragraph as a result of approval of the subdivision. Subd. 3. Repealed, 1980 c 566 s 35 Subd. 3a. Platting. The regulations may require that any subdivision creating parcels, tracts, or lots, shall be platted. The regulations shall require that all subdivisions which create five or more lots or parcels which are 2 -1/2 acres or less in size shall be platted. The regulations shall not conflict with the provisions of chapter 505 but may address subjects similar and additional to those in that chapter. Subd. 3b. Review,procedures. The regulations shall include provisions regarding the content of applications for proposed subdivisions, the preliminary and final review and approval or disapproval of applications, and the coordination of such reviews with affected political subdivisions and state agencies. Subdivisions including lands abutting upon any existing or proposed trunk highway, county road or highway, or county state -aid highway shall also be subject to review. The regulations may provide for the consolidation of the preliminary and final review and approval or disapproval of subdivisions. Preliminary or final approval may be granted or denied for parts http://www.revisor.leg.state.nin.us/stats/462/358.httnl 1/11/2002 CITY OF'ROSEMOUNT` DAKOTA COUNTY, MINNESOTA RESOLUTION 2003 - AMENDING THE RATES AND FEES FOR 2003, RESOLUTION 2002 -153 WHEREAS, the City Council has reviewed the 2003 fee schedule and recognizes the need to amend certain rates and fees for 2003; and WHEREAS, staff has found the need to amend the Park and Recreation Fees Policy and recommends changing the language as shown in Attachment 1; and WHEREAS, staff has found the need to amend the Park Dedication Fees and recommends increases as shown in Attachment 2; and NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Rosemount hereby approved the rates and fees for 2003 as outlined in Appendix I, Appendix II and further approves the amendment to the Park Dedication Fees and the Parks and Recreation Fee Policy.
