Brotzler, P.E., City Engineer AGENDA NO. 3.130. ATTACHMENTS: None APPROVED BY: In 2000, the City of Rosemount initiated the preparation of an update to the City's 1998 Stormwater Management Plan. The development of an Update to the 1998 Stormwater Management Plan was initiated to address several items as follows: 1. Stormwater Outlet for the City of Rosemount Currently, the City of Rosemount does not have a stormwater outlet from the corporate boundary. Stormwater is managed within the corporate boundary through the use of stormwater retention ponds and infiltration basins. As part of the City's 1998 Stormwater Management Plan, a stormwater outlet south to the Vermillion River was proposed to be constructed. During the Metropolitan Council Environmental Services (MCES) planning process for the expansion of their Empire Wastewater Treatment Plant (WWTP) and proposed increase in discharge to the Vermillion River, it was determined that an increase in discharge to the Vermillion River by either the WWTP or the City of Rosemount would not be acceptable due to the sensitivity of the Vermillion River. A significant portion of the Vermillion River has recently been designated as a protected trout stream by the Minnesota Department of Natural Resources. With this knowledge of the sensitivity of the Vermillion River and increasing restrictions for discharge of treated effluent and also stormwater runoff to the Vermillion River, alternatives for the construction of a stormwater outlet from the City of Rosemount were investigated.. The Comprehensive Stormwater Management Plan Update includes the development of a stormwater outlet from the City of Rosemount, east to the Mississippi River. 2. Inventory of Land and Water Resources As part of the Comprehensive Stormwater Management Plan Update, additional information has been developed and included as part of the Update. In 1999, the City of Rosemount completed a Wetland Protection and Management Plan which has been included in the Update. 3. Goals and Policies A major portion of the Comprehensive Stormwater Management Plan Update is the development of goals and policies as outlined in Section IV of the Update. These newly developed goals and policies address the need to effectively manage stormwater runoff and improve water quality while limiting public capital expenditures to control excessive volumes and rates of runoff. The major policy change in the Update is the reduction of allowable discharge limits from newly developed properties. 4. Assessment of Problems and Corrective Actions Following the "2000 storm" which resulted in a significant amount of localized flooding, the Update includes an assessment of problem areas and recommended actions to address these areas. Included in the Update is a capital improvement and prioritization plan for these areas. Through the development and completion of the. Comprehensive Stormwater Management Plan Update in the spring of 2002, a considerable amount of input from the Rosemount Utility Commission was incorporated into the Update. In July 2002, the Update was distributed for a 60 -day review /approval period. Following this review period, review comments that were; received were addressed and responded to. As the majority of the comments were received from Dakota County acting as the Watershed Management Organization, Staff committed a significant amount of time meeting with Dakota County and addressing their comments. Following a final meeting with Dakota County Staff in May 2003, final responses were prepared and the Comprehensive Stormwater Management Plan Update was submitted to the newly formed Vermillion River Watershed Joint Powers Organization ( VRWJPO). As you are aware, the VRWJPO was requested to take official action on the City's Comprehensive Stormwater Management Plan Update in accordance with State Statue. At the October 23 VRWJPO Board meeting, no action was taken by the board with regards to the City's plan. Based on the City Attorney's interpretation of State Statute, it is the position of Staff that the City of Rosemount's Comprehensive Stormwater Management Plan Update has been approved by the Vermillion River Watershed Joint Powers Organization by virtue of non - action within the constraints of the sixty (60) day rule. At this time and with the interpretation that the Comprehensive Stormwater Management Plan Update has been approved by the Vermillion River Watershed Joint Powers Organization, the next step in the process is for Council to consider the adoption of the Comprehensive Stormwater Management Plan Update. Pending adoption of the Update by Council, Staff will work towards the determination of fee adjustments to reflect capital improvement costs identified in the Update. NOTES: For discussion only.
