The Parks and Recreation, Public Works and the Engineering Departments have been working on a Trail and
Sidewalk Improvement Plan. Attached is a map that includes current trails /sidewalk and proposed
trails /sidewalks. The proposed trails /sidewalks section of the map identifies locations where small connections
need to be made. An example would be connecting a sidewalk on Canada Ave. from 147` St. W. to Camfield
Park. The map also indicates where additional trails are needed on larger streets. An example would be adding a
trail to the west side of Shannon Parkway or Chippendale Ave. -
The City has $125,000 in the 2003 CEP for improvements. Staff is recommending using the CIP funds for small
connections and to deal with safety concerns. The large expansion of trails or sidewalks could possibly be funded
through street reconstruction projects, grants, future development, parks dedication or future referendums. Staff
would ask that the Council discuss prioritizing where to start with the improvements and funding options.
The Parks and Recreation Commission discussed the Sidewalk and Trail Plan at their January 27, 2003 meeting.
Staff provided all of the Commissioners with a colored map and asked them to review the plan for connections
and provide input as to how we should prioritize improvements. The Commission felt that installing safe trails
and sidewalks because of safety concerns should be our first priority. The Commission also voiced some
concern about easements and right of way' The concern was based on how residents might respond the location
of some of the improvements. The Commission suggested sending out information with the monthly water bill
or put information in the City newsletter to educate residents on right -of -way and all types of easements that
might impact some properties. The Commission did not ask to have any changes made to the map but asked to
see more information as the plan further develops.

SUBJECT: Proposed Changes to the Leprechaun Days Service Contract
Attached is a copy of the draft 2003 Leprechaun Days Service Agreement between the City of
Rosemount and the Leprechaun Days Committee. The additions and deletions have been put in bold
writing.

SERVICE AGREEMENT
BETWEEN THE CITY OF ROSEMOUNT
AND LEPRECHAUN DAYS
THIS AGREEMENT is made the day of July 2003, by and between the City of
Rosemount, a Minnesota municipal corporation (hereinafter referred to as "City ") and
Leprechaun Days, a Minnesota association (hereinafter referred to as "Leprechaun Days ");
WITNESSETH:
WHEREAS, for a number of years Leprechaun Days has conducted an annual civic
community festival known as Leprechaun Days (hereinafter referred to as The Community
Festival); and
WHEREAS, the city council of the City has determined that it is in the best interest of
the City and its citizens to promote the City and its businesses and to provide recreational
opportunities for its residents by entering into a contract with Leprechaun Days to conduct the
Community Festival in 2003;
NOW, THEREFORE, on the basis of the premises and the mutual covenants and
agreements hereinafter set forth, it is agreed as follows:
1. Leprechaun Days will organize and conduct, in cooperation with the city staff, the
Community Festival for 2003, which shall run for ten days which shall be agreed
upon by Leprechaun Days and the city council, in accordance with practices and
standards of such festivals conducted in past years. Services shall include the
recruitment, selection, training, and managing of such employees and volunteers as
are necessary to conduct the Community Festival, and shall include but not be
limited to:
a. advertising and promotions including the design, production and distribution
of buttons, flyers and posters, and the development and installation of signs
and banners;
b. securing all necessary governmental permits and seeking approval of street
closings and other required City action and waives all fees;
c. soliciting financial support from individuals, businesses and organizations
including sponsorships of certain events; and

conducting the following events or arranging for them to be conducted by
other cooperating organizations, provided that events may be deleted or added
with the approval of the eity eouneil:

The City will make available Police Force and Public Works Department staff and
Park and Recreation Department staff at no cost to assist with event upon approval
of the City Administrator.
2. Leprechaun Days will undertake the work of this agreement as an independent
contractor, and Leprechaun Days officers, employees, volunteers, and agents shall not
be deemed agents or employees of the City for any purposes including, but not
limited to, income tax withholding, workers' compensation and unemployment
compensation.
3. As consideration for the services provided by Leprechaun Days, the City will pay
monies received as contributions in support of the Community Festival. The amount
actually paid will be limited to the amount of such contributions received. The City
will advise Leprechaun Days, on request, of the status of funds received and funds
reasonably expected to be received.
4. Leprechaun Days will maintain liability insurance providing the following coverages:
Commercial general liability with personal injury limits of not less than $1,000,000
per occurrence and a general aggregate limitation of not less than $2,000,000. The

City of Rosemount will be named as additional insured on all such policies and proof
of insurance will be provided to the City.
5. The Committee has the right to layout and organize events on City facilities that
are used during those events. The Committee will provide details to the City
Administrator for approval.
6. All services and activities conducted by Leprechaun Days shall be on a
nondiscriminatory basis and in full compliance with all state and federal civil and
human rights laws, regulations, and rulings.
7. Those possessing current peddlers' /solicitors' licenses cannot be part of Leprechaun
Days or Mid- Summer Faire events unless they have registered with Leprechaun Days
and have been approved by the committee.
8. Ability to use City Hall parking lot, Public Works parking lot, Community
Center parking lot, and streets, road right of ways, and sidewalks.
9. A list of vendors and solicitors will be provided to the City Clerk and fees
waived.
10. Licenses and fees required for Leprechaun Days will be waived and the
Committee will submit our approved list to the City Clerk.
