Kalstabakken, Chief of Polic AGENDA NO: Amy Baldwin, HR Intern ATTACHMENTS: Draft Policy APPROVED BY: The recent changes in state law regarding permits to carry firearms include provisions that allow employers to implement policies prohibiting the carrying of firearms by employees. Although local governments are not allowed to restrict the carrying of firearms by the public on public grounds or in public building, cities are able to restrict their employees' ability to carry firearms. at the workplace — even with a permit. Attached is a draft policy that is modeled after a policy drafted by the League of Minnesota Cities staff. This policy differs from the League policy in one regard. The League policy included a provision that any employee who must use their personal vehicle on city business may check the firearm at the Police Department for safekeeping. RECOMMENDED ACTION: Discussion d POLICY PROHIBITING FIREARMS AT WORK The City of Rosemount hereby establishes a policy prohibiting all employees and volunteers of the City, except sworn employees of the Police Department, from carrying or possessing firearms while acting in the course and scope of employment for the city. The possession or carrying of a firearm by employees other than sworn police officers is prohibited while working on city property or while working in any location on behalf of the city. This includes but is not limited to: • Driving on city business; • Riding as a passenger in a car or any type of mass transit on city business; • Working at city hall or any other city -owned work site; • Working off -site on behalf of the city; • Performing emergency or on -call work after normal business hours and on weekends; • Working at private residences and at businesses on behalf of the city; • Attending training or conferences on behalf of the city; When responding to on -call work from home after regular work hours, an employee is prohibited from bringing a firearm in their private vehicle unless the vehicle remains in a parking lot or is not needed to respond to the call. An exception to this policy is that city employees may carry and possess firearms in city- owned parking areas in accordance with state law if they have obtained the appropriate permit. During the employee's workday, the firearm must remain in the vehicle. The City is not responsible for the safekeeping of any firearm stored in the employee's vehicle. Employee's are responsible for the safekeeping of firearms and any other personal property stored in the employee's vehicle. The City encourages employees to purchase and install a lockbox in their vehicle if the employee will be storing a firearm in their vehicle. Violations of this policy are subject to disciplinary action in accordance with the City's disciplinary procedures policy.
