Applicant & Property Owner(s): Robert Kaufman & Jeanne Reuter, John Anderson ETAL Location: Two parcels along the west side of Bacardi Ave., north of 135 Street West. Nature of Request: South parcel gets seventeen feet from the northern property, thus solving an encroachment problem of two non - conforming accessory buildings. SUMMARY Robert Kaufman bought the former Phil's Auto Body site on the northwest corner of Bacardi Ave. and 135 Street. The site contains a number of outbuildings, many of which are non - conforming to current zoning standards. Two structures on the north west and east corners of the property actually straddle the property-line with the neighboring property to the north, still owned by the Anderson family members. This request will shift the property -line north, giving seventeen feet to the Kaufman property and solve the encroachment problem of the two small buildings. Approval of this action does not relieve the buildings of their non- conforming status, or grant any type of variance to the property. If the buildings are damaged beyond fifty percent of their value, they cannot be rebuilt without bringing them into conformance with current standards. Those standards include setbacks (30 feet); maximum aggregate area allowed (1,200 sq. ft. for all buildings on less than 20 acres or non - agricultural use); and building materials matching the house. The subdivision ordinance allows for this type of approval as an exception. In other words, this action is not technically a subdivision, therefore, it does not require a public hearing and Planning Commission review. RECOMMENDED ACTION: Motion to adopt a resolution approving the lot split / recombination or common boundary -line relocation between the Kaufinan and Anderson properties. CITY COUNCIL ACTION: CITY OF ROSEMOUNT DAKOTA COUNTY, MINNESOTA RESOLUTION 2003- A RESOLUTION APPROVING THE COMMON BOUNDARY LINE RELOCATION FOR ROBERT L. KAUFMAN AND JOHN ANDERSON WHEREAS, the Planning Department of the City of Rosemount received an application from Robert L. Kaufman and John Anderson to relocate the common boundary line separating the following described parcels: Anderson Property — The east 241.70 feet of the Southeast Quarter of the Northwest Quarter of Section 21, Township 115, Range 19, Dakota County, Minnesota, EXCEPT the south 391.70 feet thereof Kaufman Property — The east 241.70 feet of the south 391.70 feet of the Southeast Quarter of the Northwest Quarter of Section 21, Township 115, Range 19, EXCEPT the north 60.00 feet of the south 93.00 feet of the east 50.00 feet and EXCEPT road, Dakota County, Minnesota. WHEREAS, relocation of the common boundary line will not result in any variances or lot deficiencies in the Agriculture District; and WHEREAS, the Subdivision Ordinance allows for City Council approval of a common boundary line relocation if there are no new parcels created by the relocation; NOW, THEREFORE, BE IT RESOLVED, the City Council of the City of Rosemount hereby approves the relocation of the common boundary line separating the Anderson and Kaufinan properties by moving the common boundary line 17 feet north, resulting in the following legal descriptions: Anderson Property: The east 241.70 feet of the Southeast Quarter of the Northwest Quarter of Section 21, Township 115, Range 19, Dakota County, Minnesota, EXCEPT the south 408.70 feet thereof. Kaufman Property: The east 241.70 feet of the south 408.70 feet of the Southeast Quarter of the Northwest Quarter of Section 21, Township 115, Range 19, EXCEPT the north 60.00 feet of the south 93.00 feet of the east 50.00 feet and EXCEPT road, Dakota County, Minnesota.
