ATTACHMENTS: Proposed Ordinance Amendment APPROVE BY: As you are aware, the City currently has an ordinance that restricts the usage of water for lawn and landscaping maintenance. The ordinance restricts usage on an odd -even basis by house address. With the current ordinance, the enforcement of the ordinance is difficult as a violation of the ordinance is a misdemeanor. To improve the ability of the City to enforce the ordinance, it is proposed that the current ordinance be revised to allow for enforcement of the restriction by City Staff, particularly the Public Works Department. It is also proposed that the revision include a penalty structure as follows: 1 Violation Warning 2 °d Violation $200.00 Penalty 3 Violation $300.00 Penalty Each Violation Thereafter $400.00 Penalty The above amounts are proposed to be charged as penalties with quarterly water bills. Another proposed revision to the current watering restriction ordinance is to include an everyday, noon to 6:00 p.m. water ban as watering during these hours of the day is an inefficient use of resources. Staff has reviewed this item with the Utility Commission. The Commission was in support of the proposed revisions but did note that the proposed penalty amounts appear to be high. Attached is a copy of the proposed ordinance amendment and resolution that has been prepared by the City Attorney. Also attached is an excerpt from the City of Andover newsletter that includes a section of the watering restrictions used by the City. RECOMMENDED ACTION NOTES: For discussion only. CITY OF ROSEMOUNT DAKOTA COUNTY, MINNESOTA ORDINANCE NO. AN ORDINANCE RELATING TO LAWN SPRINKLING IN THE CITY; AMENDING ROSEMOUNT CITY CODE, TITLE 4 CHAPTER 1, SECTIONS 4 -1A -3 AND 4 -1A -6 The City Council of the City of Rosemount Ordains as follows: Section 1. City Code Section 4 -1A -3, paragraph B is amended to read as follows: B. Sprinkling And Other Limitations. In order to conserve our potable water supply, each water customer is required to comply with the following restrictions: 1. On odd numbered days of the month, only odd numbered addresses shall water lawns or landscaping, and on even numbered days, only even numbered addresses shall water lawns or landscaping. 2. No watering of lawns or landscaping is permitted between the hours of noon and 6:00 p.m. on any day. 3. Exceptions. The limitations of paragraphs 1 and 2 do not apply a) to the watering of lawns or landscaping for the first thirty (30) days after establishment or planting of such lawn or landscaping, or b) each year before May 1 St or after August 31 st Section 2. City Code Section 4 -1A -6 is amended by adding new paragraph C as follows: C. In addition to any other penalty or sanction provided for in this Article, the City Council may, by resolution, set penalties for violations of this Article. Such penalties shall be billed to the customer and collected as a part of the water bill. A customer may appeal the imposition of such a penalty to the Public Utilities Commission by serving a written notice of appeal on the City Administrator or City Clerk within ten (10) days of receipt of notice from the City that it is imposing a penalty. Such notice shall be in writing and shall state the grounds or basis for objecting to the imposition of the charge or penalty. No penalty that has been appealed will be levied or collected until the customer has been given an opportunity for a hearing before the Commission. Section 3. Droste, Mayor ATTEST: Linda Jentink, City Clerk Published this day of , 2003 in the Rosemount Town Pages. g: /misc /lawnsprinklingordinance 2 r CITY OF ROSEMOUNT DAKOTA COUNTY, MINNESOTA RESOLUTION 2003 - A RESOLUTION ESTABLISHING PENALTIES FOR VIOLATIONS OF CITY CODE SECTION 4 -1A -3 WHEREAS, Rosemount City Code Section 4 -1A -6 authorizes the Council to establish penalties for violation of Article A of Chapter 1 of the City's water code (Section 4 -1A -1 through 4- 1A -6); and WHEREAS, the Council has determined that it is in the best interest of the public to establish penalties for violation of Section 4 -1A -3. NOW, THEREFORE BE IT RESOLVED, by the City Council of the City of Rosemount, Minnesota: Penalties are established and shall be imposed in accordance with City Code Section 4 -1A -6 for violations of Section 4 -1A -3 paragraph B: 1. For the first violation in a one -year period: Written warning 2. For the second violation in a one -year period: $200 3. For the third violation in a one -year period: $300 4. Motion by: Voted in favor: Seconded by: Voted against: Public Works Department /Water Division The City of Andover has a sprinkling ban in effect beginning May 1 through August 31 as follows: 1. There will be NO WATERING in the City, (on the City Water System), odd or even, between the hours of 12:00 p.m. to 6:00 p.m. everyday. 2. The odd / even rule applies to all other hours. All property with an address that ends with an odd number may be sprinkled on odd numbered days (1st, 3rd, etc.). Properties with an address that ends with an even number may be sprinkled on even numbered days (2nd, 4th, etc.). 3. There will be only one written warning for violators of the sprinkling restrictions. The second and subsequent violations carry a penalty as set by City Council resolution. 4. Newly sodded or seeded yards will be exempt from the odd — even restriction for a period of two weeks only. Over seeding or spot patching of existing yards can be watered everyday with a hand controlled hose. NO WATERING from 12:00 p.m. to 6:00 p.m. Other exemptions are: car washing, filling of children's swimming pools, children playing in a hose operated sprinkler or water toy.
