At the time of this writing only one dog has been properly licensed with the City of Rosemount. If this requirement is not meet, then the license should be denied. Mr. Charles stated that the dogs were purchased for their four children. They have four pit bulls. The police department has had repeated contact with the Charles family and Police Chief Kalstabakken has made a recommendation in the attached memo to deny the request for this kennel license. Since the fencing around the yard is not able to contain at least one of the dogs, it would seem that the dogs are not under the control of its owners. The Animal Humane Society has also been investigating the Charles' after receiving complaints. Because we are trying to prevent anything bad from happening to the residents at large and the dogs, I agree that this kennel license should be denied which would only allow Lamario Charles to have three dogs at their home. I will not be attending this meeting and I have asked Police Chief Kalstabakken to present it. RECOMMENDED ACTION: Avenue. Motion to deny the kennel license for Lamario Charles, 14804 Crandall COUNCIL ACTION: 06/17/2002 10:51 FAX 612 953 4443 FOCUS FINANCIAL Z002 TO: CITY OF ROSEMOUNT CITY COUNCIL FROM: DON & ROBERTA THOMAS RE: KENNEL LICENSE APLICATION 14804 CRANDALL AVE Under normal circumstances, we do believe that a person does have a right to apply for a Kennel license if they are willing to comply with ordinances and general accepted behavior /actions to protect everyone including dogs. This becomes questionable if 1. General yard maintenance is not observed. (Do not care enough to mow their lawn) 2. General house maintenance is not observed. 3. Police supervision is apparently needed and repetitive. 4. Aggressive dogs are being raised (Pit Bulls)_ 5. Purpose for raising dogs is questionable. This is not a positive situation for the neighborhood. MEMORANDUM TO: Mayor and Council Members Administrator Burt FROM: Gary Kalstaba en Chief of Poli e DATE: June 13, 2002 SUBJECT: Kennel Application — 14804 Crandall Avenue Lamario Charles has applied for a kennel at his residence. The application states that it will be for four (4) dogs. Based on the number and type of complaints received about the dogs at this residence and the condition of the premises when it was inspected, it is recommended that this kennel application be denied for the following reasons: ■ Animal waste observed in the backyard on June 13 2002. ■ Animal waste observed in the home on June 11 2002. • Fencing is inadequate to contain the dogs, they have escaped by jumping the fence. ■ Citations have been issued and cases are pending due to barking dogs, dog at large and failure to provide adequate shelter in the yard for the dogs. ■ Additional complaints have been received for dog -at- large, barking and neglect. The premises were inspected on June 13 by a CSO and police officer. They observed three of the dogs running free in the fenced backyard of the property; they did not enter the fenced area. As they walked away from fenced area to leave, one of the dogs jumped over the wooden fence — approximately five feet in height — and followed them. The dog was placed back into the fenced yard by the CSO. As they again left the area, the dog again jumped over the fence. It was then impounded because there was apparently no one at the residence to take control of the dog and keep it confined. During the inspection, some animal waste was observed in the backyard. Although there was not a large amount of waste, this is of concern because of prior observations made at the property. On June 11 , police officers were at this residence on a call unrelated to the dogs. While in the home, officers observed dog feces in the home in several different areas. An agent from the Animal Humane Society has been investigating the applicant for possible neglect after receiving complaints. One complaint was regarding the dogs not having shelter and water as required by state statute when they are kept outside. As of June 13 shelter is still not being provided.
