The Mayor is the MVTA board member representing Rosemount has requested this item be
discussed by Council. The MVTA board has requested to change the .foint Powers Agreement
regarding appointment of the at -large commissioner and has asked member cities to review
paragraph 5.
The issue is, should the at -large commissioner be appointed by all five- member cities or only by
Burnsville, Eagan and Apple Valley. It must be approved unanimously by all cites to make the
change. The Mayor will be able to give more background on this issue.

Article X (formerly IX) has been revised to remove Section 2 as it authorized the
payment upon written consent of Board members, and this could be construed as a
violation of the Open Meeting Law.
There is no provision in the current Bylaws regarding an official newspaper, and
the practice has been to designate the official newspaper from all of the cities. The city
attorneys indicated that they had no objection to one official newspaper for MVTA in
order to reduce the cost of publication. It was the consensus that the newspaper for the
City of Burnsville should be designated as the official newspaper of MVTA and Article
X of the Bylaws has been added.
