Endres ProcessingAGENDA ITEM: Endres Processing AGENDA SECTION: Discussion PREPARED BY: Jim Parsons Community Development Director AGENDA NO. 3 a ATTACHMENTS: Notice of Violation from the MN Pollution Control Agency APPROVED BY: Background CITY OF ROSEMOUNT EXECUTIVE SUMMARY FOR ACTION PORT AUTHORITY WORK SESSION DATE: January 15, 2002 Staff members have been in communication with executives from Endres Processing and staff from Dakota County Environmental Management and the Minnesota Pollution Control Agency (MPCA) about problems with air and water pollution at the Endres plant Currently, Endres is on notice from MPCA regarding violations and the required corrective measures (see attachment) The Endres plant has violated both air and surface water quality standards MPCA fined Endres over S13,000 for pollution violations last year Dakota County declined to give Endres an annual renewal of its business license, instead giving the company only a 90 -day renewal, due to pollution concerns Clearly, the company must make the corrective measures to clean up its pollution performance in order to avoid further regulatory issues at the county and state levels Because the plant is not in compliance with county and state regulations, the Port Authonty may withhold payments to the company under the development agreement The Port Authonty may have several options concerning its contract with the company regarding tax increment financing (TIF) funds RECOMMENDED ACTION: For discussion only PORT AUTHORITY ACTION: EXECSUMEndres
