Guide Plan Design.: Agricultural Current Zoning: Agricultural SUMMARY The request is to use land for paintball games on two parcels of land located on the south side of Pine Bend Trail across from C. F. Industries. The Johnsons are asking for a Conditional Use Permit (CUP). There are two existing paintball games being run under different ownership within the area on separate parcels of land. This game would be played on land owned by Orrin Kirschbaum and Brian Kvasnik. Currently, the land is not being used for anything else. The proposed conditions of the CUP are based upon the conditions developed for the other two paintball groups, The Adventure Zone, and Splatball, Inc. The lifespan of the permit is three years, after which the permit must be renewed. As with other such permits, steps can be taken to revoke the CUP at any time there is unlawful activity such as a violation of the conditions or the zoning ordinance. On June 12, 2001, the Planning Commission conducted a public hearing regarding the renewal request. It should be noted that two separate neighboring landowners were present and voiced opposition. Nevertheless, the Planning Commission adopted a recommendation to approve the CUP for three years by a 2 -1 vote. RECOMMENDED ACTION: Motion to recommend the City Council approve the request for the CUP for Darrin and Lesley Johnson for a period of three years. COUNCIL ACTION: 2001 -2003 Conditional Use Permit Conditions for Darrin and Lesley Johnson Splat Tag, Inc. Commercial Outdoor Recreation Use located in the Agricultural District This Conditional Use Permit (CUP) is valid only for that part of the East Half of the Southwest Quarter of the Northeast Quarter (E %2 of SW '/4 of NE 1 /4); and that part of the East Half of the Northeast Quarter (E %Z of NE 1 /4) lying southerly of Pine Bend Trail, excepting therefrom the East 992.89 feet thereof, all in section Twenty (20), Township One Hundred Fifteen (115), Range Eighteen (18). 1. The permit shall be in effect for the calendar years of 2001, 2002 and 2003 from January 1, 2001 to December 31, 2003. 2. The permit shall be reviewed prior to renewal in 2004 for conformance with these conditions. Thereafter, the City Council will determine the appropriate time interval for the subsequent renewal procedure. 3. Violations of any specified CUP condition or otherwise unlawful activity may result in immediate revocation of the CUP. 4. All site improvements shall be reviewed by the City Engineer for approval prior to completion in accordance with City standards including grading permits. 5. The hours of operation shall be limited to 8:00 a.m. to sunset. 6. No parking is allowed in the Pine Bend Trail right -of -way. 7. All permits required by other applicable agencies must be obtained and copies submitted to the City. 8. All development and dimensional standards of the zoning ordinance apply to future improvements with the exception of paving requirements. 9. Parking areas must consist of a minimum of six (6) inches of compacted, crushed limestone or other such material acceptable to the City Engineer, and shall be maintained accordingly: 10. The gate at the entrance along Pine Bend Trail must remain closed and locked during non - business hours. 11. All structures must conform with the Uniform Building Code and City of Rosemount Zoning Ordinance requirements for materials and aesthetics. 12. Conformance with Dakota County Health standards for portable sanitary facilities. 13. Conformance with the City of Rosemount Sign Ordinance. I raise horses and the noise and people in there would make them nervous and high strung. We have experienced noise and commotion fromtthe other splatball place and do not want our horses startled as it could cause great damage if they went through fences and were cut up. We have called Dakota County and Rosemount police due to noise of guns being fired. There are already two places on Highway 55 to go for paintball now so we do not feel another one is needed. Purpose: The purpose of conditional use permits is to allow for those uses which are not generally suitable within the zoning district, but which under some circumstances may be suitable. The applicant for a CUP shall have the burden of proof that the use is suitable and that the standards set forth in this subdivision have been met. B. Application, Public Hearing, Notice and Procedure: The application, public hearing, notice and procedure requirements for CUPS shall be the same as those for amendments to the Zoning Ordinance, as identified in Section 16.2 of this Ordinance. CUPs may be granted only by a 415 vote of the entire Council. Specific submissions required to complete an application for a CUP shall address all standards applicable to the proposed use. The applicant shall provide information as required in the site plan review. C. Standards: The Commission shall recommend a CUP and the Council may issue such CUP if it finds that such use at the proposed location: 1. Will not be detrimental to or endanger the public health, safety, or general welfare of the neighborhood or the city. 2. Will be harmonious with the objectives of the Comprehensive Plan and city code provisions. 3. Will be designed, constructed, operated and maintained so as to be compatible or similar in an architectural and landscape appearance with the existing or intended character of the general vicinity and will not change the essential character of that area, nor substantially diminish or impair property values within the neighborhood. 4. Will be served adequately by existing (or those proposed in the project) essential public facilities and services, including streets, police and fire protection, drainage, structures, refuse disposal, water and sewer systems and schools. 5. Will not involve uses, activities, processes, material equipment and conditions of operation that will be hazardous or detrimental to any persons, property, or the general,welfare because of excessive production of traffic, noise, smoke, fumes, glare or odors. City of Rosemount Page 207 6. Will have vehicular ingress and egress to the property which does not create traffic congestion or interfere with traffic on surrounding public streets. 7. Will not result in the destruction, loss or damage of a natural, scenic, or historic feature of major importance and will comply with all local, state, and federal environmental quality standards. 8. These standards apply in addition to specific conditions as may be applied throughout this code. D. Conditions: In reviewing applications for CUPs, the Commission and the Council may attach whatever reasonable conditions they deem necessary to mitigate anticipated adverse impacts associated with these uses, to protect the value of other property within the district, and to achieve the goals and objectives of the Comprehensive Plan and City Code provisions. Such conditions may include, but are not limited to, the following: 1. Controlling the number, area, bulk, height, density, intensity, and location of such uses. 2. Regulating ingress and egress to the property and the proposed structures thereon with particular reference to vehicle and pedestrian safety and convenience, traffic flow and control, and access in case of fire or other catastrophe. 3. Regulating off - street parking and loading areas where required. 4. Specifying utilities with reference to location availability and compatibility. 5. Requiring berming, fencing, screening, landscaping or other facilities to protect nearby property. 6. Ensuring compatibility of appearance. In determining such conditions, special consideration shall be given to protecting immediately adjacent properties from objectionable views, noise, traffic and other negative characteristics associated with such uses. E. Revocation: Failure to comply with any condition set forth in a CUP, or any other violation of City Code provisions, shall also constitute sufficient cause for the termination of the CUP by the Council following a public hearing. City of Rosemount Page 208 F. Expiration: In any case where a conditional use has not been established within one (1) year of the date on which the CUP was granted, the permit shall be null and void. If the conditional use is discontinued for six (6) months, the CUP shall be null and void. G. Permittee: A CUP shall be issued for a particular use and not for a particular person. 12.8: INTERIM USE PERMITS (IUP): i i A.
