SUMMARY
Mr. Altendorfer owns 13.4 acres of land east of Bacardi Avenue. His access to Bacardi actually occurs over a
fragment of Mr. Bester's property that forms a gap between the Altendorfer property and the Bacardi Avenue
right -of -way. This is a result of Bacardi Avenue actually being constructed west of the half - section line that
separates the two properties. Mr. Altendorfer has arranged to purchase the "gap" fragment of land from Mr.
Bestor and combine it with his property. This action will allow him to sell his land to Mr. & Mrs. Schlukebier
without a non - conforming access issue.
The result of this process is a solution to an access problem and will not result in a new lot or parcel. As a
result, it is considered an exception to platting requirements and no public hearing or Planning Commission
review is required.
RECOMMENDED ACTION:
Motion to adopt a resolution approving the combination of land requested by Joe Altendorfer and Earl Bester.

A RESOLUTION APPROVING
THE LOT COMBINATION REQUESTED BY
JOSEPH ALTENDORFER
WHEREAS, the Community Development Department of the City of Rosemount received an
application from Joseph Altendorfer for approval of a lot combination concerning property
located on Bacardi Avenue in Rosemount, Minnesota, legally described as follows,* to-wit:
Parcel A
A tract of land in Government Lot 1, Section 9, and in the Northwest Quarter of the Northeast
Quarter of Section 16, all in Township 115, Range 19, described as follows: Commencing at the
northwest corner of the West Half of said Government Lot and running thence South along the
West line thereof and the West line of said Northwest Quarter of the Northeast Quarter to a point
825 feet North of the southwest corner thereof, thence East to a point on the East line of said
Northwest Quarter of the Northeast Quarter distant 825 feet North of the Southeast corner
thereof, thence North along the said East line and the East line of said West Half of Government
Lot 1 to the North line thereof, thence West to the point of beginning, except the North 330 feet
of the West 660 feet of said described tract together with an easement over the West 2 rods and
the North 2 rods of the aforesaid excepted North 330 feet of the West 660 feet of said described
tract, also said tract subject to an easement over the East 33 feet thereof, said tract containing
13.7 acres, more or less, according to the Government survey thereof.

The Northeast Quarter of the Northwest Quarter of Section 16, Township 115, Range 19 which is
described as follows: Beginning at a point of the east line of said Northeast Quarter of the
Northwest Quarter distant 825 feet north of the southeast corner thereof, said east line has an
assumed bearing of South 00 degrees 03 minutes 06 seconds West; thence South 89 degrees 47
minutes 02 seconds West 88.26 feet; thence North 01 degrees 21 minutes 21 seconds West
274.18 feet; thence North 89 degrees 53 minutes 45 seconds East 94.99 feet to said east line;
thence South 00 degrees 03 minutes 06 seconds West along said east line 273.95 feet to the
point of beginning. Subject to a public road easement for Bacardi Avenue.
WHEREAS, on June 18, 2001, the City Council reviewed the lot combination for Joseph
Altendorfer.
NOW, THEREFORE, BE IT RESOLVED, the City Council of the City of Rosemount hereby
approves the lot combination for Joseph Altendorfer, resulting in the following legal description:

the Northwest Quarter distant 825 feet north of the southeast corner thereof, said east line has an
assumed bearing of South 00 degrees 03 minutes 06 seconds West; thence South 89 degrees 47
minutes 02 seconds West 88.26 feet; thence North 01 degrees 21 minutes 21 seconds West
274.18 feet; thence North 89 degrees 53 minutes 45 seconds East 94.99 feet to said east line;
