Centex Homes has requested the vacation of a portion of the drainage and utility easement for
Lot 15, Block 1 Bloomfield Addition. This lot has the majority of the backyard contained within
easement that was originally intended for ponding. This pond was not incorporated into the
final grading plan, but the easement was still provided. Due to a modified house elevation
some grading revisions are necessary and will be completed prior to the hearing. A copy of the
lot will be provided prior to the public hearing.
The easement to be vacated includes all drainage and utility easements except for the following
drainage and utility easement. over the northerly 10 feet, the northeasterly 5 feet, the
northwesterly 5 feet, the southwesterly 5 feet and the southeasterly 43 feet of Lot 15, Block 1
Bloomfield according to the recorded plat thereof, Dakota County, Minnesota.
Because the easement was dedicated for public use (drainage and utilities), a public hearing is
required to vacate it. Staff is recommending approval of the easement vacation.
RECOMMENDED ACTION: MOTION TO ADOPT A RESOLUTION CAUSING EASEMENT
VACATION FOR LOT 15, BLOCK 1 BLOOMFIELD.

A RESOLUTION CAUSING EASEMENT VACATION IN
LOT 15, BLOCK 1 BLOOMFIELD
WHEREAS, a public hearing was scheduled and held before the City Council of the City of Rosemount
on August 7, 2001 after due publication as required by law, and all interested persons were given an
opportunity to be heard; and
WHEREAS, it appears the current easement serving a public purpose is based upon the property in a
predevelopment state, and will be replaced by a modified easement for public purpose that will be
incorporated with the development plat.
NOW THEREFORE BE IT RESOLVED, that the following drainage and utility easement hereby
vacated, to wit:
Vacate all drainage and utility easements except for the following drainage and utility easements
over the northerly 10 feet, the northeasterly 5 feet, the northwesterly 5 feet, the southwesterly 5
feet and the southeasterly 43 feet of Lot 15, Block 1, Bloomfield, according to the recorded plat
thereof, Dakota County, Minnesota.
BE IT FURTHER RESOLVED, that the City Attorney shall prepare a notice of completion of the
proceedings and necessary Quit Claim Deeds which shall contain the name of the City, identification of
the vacation and a statement of the time of completion thereof, and shall present the same to the County
Auditor and then file a copy with the County Recorder.

NOTICE IS HEREBY GIVEN, that the City Council of the City of Rosemount will conduct a
public hearing on Tuesday, August 7, 2001 in the Banquet Room of the Community Center,
13885 South Robert Trail, beginning at 7:30 p.m. or as soon thereafter as possible. The purpose
of this hearing is to consider a public easement vacation affecting the following legally described
property:
Vacate all drainage and utility easements except for the following drainage and utility.
easements over the northerly 10 feet, the northeasterly 5 feet, the northwesterly 5 feet, the
southwesterly 5 feet and the southeasterly 43 feet of Lot 15, Block 1, Bloomfield,
according to the recorded plat thereof, Dakota County, Minnesota.
Such person(s) as desire to be heard with reference to the above item will be heard at this
meeting.
