Action: SUMMARY Church of St. Joseph's 13730 Biscayne Ave. Jeffery & Katherine Nelson 56.33 acres total Parcel A — 26.74 acres and Parcel B — 29.59 acres Urban Residential R -1, Low Density Residential Recommendation of approval (4 -0) This application concerns the division of the Nelson property on the east side of Biscayne Avenue, north of Biscayne Pointe. The northerly (smaller) half will remain as essentially a hobby farm for Mr. Nelson. The southerly (larger) half will be the future site of the Church of St. Joseph and education center. The two parcels will be split by an extension of Connemara Trail, extending east across the property from Biscayne Avenue. The split is consistent with the subdivision requirements, and the Interim City Engineer has made recommendations regarding the 80 ft. wide easement for Connemara Trail split between the two parcels. Essentially, the easement will be wider along the south side to accommodate a bike trail. Both properties will be platted if they are subdivided in the future. Parcels of five acres or less are required to be platted, at which time most of the development fees are charged. PLANNING COMMISSION PUBLIC HEARING On July 24, 2001, the Planning Commission conducted the required public hearing. No comments were made by the half dozen residents in attendance. Gary Mitchell and Bill Broback were present representing the Church of St. Joseph. RECOMMENDED ACTION:. Motion to adopt a resolution approving the lot split of the Nelson property of the Church of St. Joseph. CITY COUNCIL ACTION: 0 f CITY OF ROSEMOUNT DAKOTA COUNTY, MINNESOTA RESOLUTION 2001- A RESOLUTION APPROVING THE LOT SPLIT FOR CHURCH OF ST. JOSEPH WHEREAS, the Planning Department of the City of Rosemount received an application from Church of St. Joseph for approval of a division of property, said property legally described as: That part of the West Half of the Southwest Quarter of Section 21, Township 115, Range 19, Dakota County, Minnesota lying south of the following described line: Commencing at the southeast corner of said West Half of the Southwest Quarter; thence North 00 degrees 08 minutes 33 seconds East (assumed bearing) along the east line thereof 1753.82 feet to the point of beginning of the line to be described; thence North 79 degrees 32 minutes 50 seconds West 1337.44 feet to the west line of said West Half of the Southwest Quarter and said line there terminating. Excepting therefrom the right of way of the Chicago, Milwaukee, St. Paul and Pacific Railroad right of way contained therein. Containing 56.33 acres. WHEREAS, the Planning Commission of the City of Rosemount conducted a public hearing on July 24, 2001, as required by the subdivision ordinance, for the purpose of receiving testimony regarding the requested lot division; and, WHEREAS, the Planning Commission adopted a motion to recommend approval of the lot division to the City Council with conditions; and, WHEREAS, on August 7, 2001, the City Council of the City of Rosemount reviewed the recommendation forwarded by the Planning Commission; NOW, THEREFORE, BE IT RESOLVED, the City Council of the City of Rosemount hereby approves the division of the above referenced parcel resulting in the following described parcels: Parcel A: That part of the West Half of the Southwest Quarter of Section 21, Township 115, Range 19, Dakota County, Minnesota lying southerly of Line 1 and northerly of Line 2 and excepting therefrom the right of way of the Chicago, Milwaukee, St. Paul and Pacific Railroad. Line 1: Commencing at the southeast corner of said West Half of the Southwest; thence North 00 degrees 08 minutes 33 seconds East, assumed bearing, along the east line thereof 1753.82 feet to the point of beginning of the land to be described; thence North 79 degrees 32 minutes 50 seconds West 1337.44 feet to the west line of said West Half of the Southwest Quarter and said line there terminating. Line 2: Commencing at the southwest corner of said West Half of the Southwest Quarter; thence North 00 degrees 02 minutes 34 seconds West, assumed bearing, along the west line thereof 1006.13 feet to the point of beginning of the line to be described; thence South 68 degrees 56 minutes 20 seconds East 154.28 feet; thence easterly, along a tangential curve r Resolution 2001- which is concave to the north, having a radius of 882.00 feet, central angle of 44 degrees 04 minutes 24 seconds, 678.46 feet; thence North 66 degrees 59 minutes 14 seconds East 333.02 feet; thence easterly along a tangential curve which is concave to the south, having a radius of 882.00 feet, central angle of 13 degrees 36 minutes 52 seconds, 209.58 feet to the east line of said West Half of the Southwest Quarter and said line there terminating. Subject to a public road easement for Blaine Avenue and all other easements, if any. Containing 26.74 acres. Parcel B: That part of the West Half of the Southwest Quarter of Section 21, Township 115, Range 19, Dakota County, Minnesota which lies southerly of the following described line: Commencing at the southwest corner of said West Half of the Southwest Quarter; thence North 00 degrees 02 minutes 34 seconds West, assumed bearing, along the west line thereof 1006.13 feet to the point of beginning of the line to be described; thence South 68 degrees 56 minutes 20 seconds East 154.28 feet; thence easterly, along a tangential curve which is concave to the north, having a radius of 882.00 feet, central angle of 44 degrees 04 minutes 24 seconds, 678.46 feet; thence North 66 degrees 59 minutes 14 seconds East 333.02 feet; thence easterly along a tangential curve which is concave to the south, having a radius of 882.00 feet, central angel of 13 degrees 36 minutes 52 seconds, 209.58 feet to the east line of said West Half of the Southwest Quarter and said line there terminating. BE IT FURTHER RESOLVED, the approval of this lot split is subject to: Incorporation of recommendations relative to street alignments, right -of -way and easements by the Interim City Engineer ADOPTED this 7" day of August, 2001, by the City Council of the City of Rosemount.
