We have a set of plans and specifications on file in my office for your examination. This project is the second phase of the reconstruction of CSAH 42. The first phase was completed two years ago with the McNamara 2 " Addition project. The Dakota County's participating in 55% of the cost of the project. Consequently we need to have the attached cost share agreement approved with the County. This project consists of revising the street to an urban section through adding curb and gutter and storm sewer. The street will be widened to provide for shoulders similar to the first phase. The bid opening date has been set for August 31, 2001 at 10:00 a.m. at the Community Center. RECOMMENDED ACTION: MOTION TO ADOPT A RESOLUTION RECEIVING PLANS AND SPECIFICATIONS, AUTHORIZING ADVERTISEMENT OF BIDS AND APPROVING THE COST SHARE AGREEMENT WITH DAKOTA COUNTY FOR CSAH 42 (DIAMOND PATH TO SHANNON PARKWAY) STREET AND UTILITY IMPROVEMENTS, CITY PROJECT #327. COUNCIL ACTION: 1 0 CITY OF ROSEMOUNT DAKOTA COUNTY, MINNESOTA RESOLUTION 2001 - A RESOLUTION RECEIVING THE PLANS AND SPECIFICATIONS, AUTHORIZING ADVERTISEMENT OF BIDS AND APPROVING PROJECT COST SHARING AGREEMENT WITH DAKOTA COUNTY FOR CSAH 42 (DIAMOND PATH TO SHANNON PARKWAY) STREET AND UTILITY IMPROVEMENTS CITY PROJECT #327 WHEREAS, the City Council of the City of Rosemount have ordered the preparation of plans and specifications for CSAH 42 (Diamond Path to Shannon Parkway) Street and Utility Improvements, City Project 9327 and such plans and specifications have been presented to this Council for approval: NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Rosemount, Minnesota: Such plans and specifications are hereby approved and ordered placed on file in the office of the City Clerk. 2. The City Clerk shall prepare and cause to be inserted in the official City newspaper and the Construction Bulletin an advertisement for bids upon the making of such improvements under such approved plans and specifications for City Project #327. 3. The advertisement shall be published in each of said publications at least once not less than three (3) weeks before the date set for opening bids, shall specify the work to be done, shall state the bids will be publicly opened on August 31, 2001 at 10:00 o'clock a.m. at the Rosemount Community Center in said City and that no bids will be considered unless sealed and filed with the City Clerk and accompanied by a cash deposit, cashier's check, bid bond or certified check payable to the City Clerk for five (5 %) percent of the amount of such bid. Cathy Busho, Mayor ATTEST: Linda Jentink, City Clerk Motion by: Voted in favor: Seconded by: Voted against: DAKOTA COUNTY DEPARTMENT OF TRANSPORTATION AGREEMENT FOR ENGINEERING CONSTRUCTION BETWEEN THE COUNTY OF DAKOTA THE CITY OF ROSEMOUNT FOR COUNTY PROJECT NO. 42 -88 CITY PROJECT NO. 327 FOR THE Reconstruction and widening of County State Aid Highway 42 from County State Aid Highway 33 (Diamond Path) to Shannon Parkway in Rosemount, Dakota County. County Project No. 42 -88 April 26, 2001 THIS AGREEMENT, made and entered into by and between the County of Dakota, referred to in this agreement as "the County "; and the City of Rosemount, referred to in this agreement as "the City ", WITNESSETH: WHEREAS, it is considered mutually desirable to reconstruct and widen County State Aid Highway 42 to add paved shoulders and curb and gutter from County State Aid Highway 33 to Shannon Parkway in Rosemount; and WHEREAS, the County and the City have included this project in their Capital Improvement Programs to share project responsibilities. NOW, THEREFORE, it is agreed that the County and the City will jointly participate in the project costs associated with engineering, construction, and related activities as described in the following sections: 1. Engineering Engineering costs for the roadway construction shall be split based on the County and City share of the final construction costs. 2. Roadway Construction Items The construction costs of the following items for the reconstruction and widening of County State Aid Highway 42 shall be shared in the amount of 55% by the County and 45% by the City: a.) Clearing and grubbing; County Project No. 42 -88 April 26, 2001 b.) c.) d.) e.) f.) g.) h.) i ) j ) Removal and salvage; Grading, Base, and Surfacing; Curb and gutter; Medians; Shouldering; Retaining walls; Turf establishment; Pavement markings and signing; Mobilization, field office and laboratory, and traffic control; k.) Sidewalks and bikeways; 1.) Mitigation required by state and federal permits m.) Storm sewer and other drainage facilities eligible for County State Aid funding based on contributing flows; n.) Replacing and restoring fences, landscaping, and driveways; o.) Centerline drainage culverts and bridges; p.) Reconstructing or adjusting sanitary sewer, storm sewer and detention ponds, watermains and appurtenances due to roadway construction; q.) Relocating or adjusting privately owned utilities when not performed at the expense of the utility; r.) Landscape plantings less than five feet tall; s.) The County's share of water pollution control best management practices, based on contributing flows, 3 County Project No. 42 -88 April 26, 2001 meeting National Urban Runoff Protection (NURP) standards; and t.) Replacing signal loop detectors. 3. Citv Utilities. Except as stated in Sections 1 & 2 of this agreement, the City shall pay all other costs for new storm sewer, storm water ponding and other drainage facilities, NURP facilities, sanitary sewer and watermains and appurtenances constructed as part of this project and shall be responsible for their maintenance. The City shall be responsible for the cost and maintenance of roadway lighting. 4. Plans and Spec ifications. The City will prepare complete grading, paving, storm sewer, and other municipal utility plans and specifications consistent with State -Aid design standards, the Dakota County Transportation Plan, and the City's utility standards and specifications. County approvai of the plans and specifications is necessary prior to advertising for bids. 5. Payment The City will act as the paying agent for costs of engineering and for all payments to the Contractor. Payments to the Contractor will be made as the Project work progresses and when certified by the City Engineer. The City, in turn, will bill the County for the County's share of the engineering and construction as specified in this agreement. Upon presentation of an itemized claim by one agency to the other, the receiving agency shall reimburse the invoicing agency for its share of the costs incurred 4
