The Bloomfield Addition plat included the dedication of drainage and utility easements for future
ponding areas located in the northeast portion of the site. These easements were necessary to allow
for the discharge of public storm sewer into future ponding areas. With the completion of grading
activities in this area, the drainage areas are better defined. The existing easement conflicts with the
4 t " Addition plat. We are requesting the vacation of the existing easement. Centex Homes will
provide a new easement for the ponding area prior to the execution of the vacation.
Staff is recommending approval of the easement vacation.
RECOMMENDED ACTION: MOTION TO ADOPT A RESOLUTION CAUSING EASEMENT
VACATION IN OUTLOT C, BLOOMFIELD ADDITION.

A RESOLUTION CAUSING EASEMENT VACATION IN
OUTLOT C, BLOOMFIELD ADDITION
WHEREAS, a public hearing on the vacation of the easement described below was scheduled and
held before the City Council of the City of Rosemount on December 4, 2001 after due publication
as required by law, and all interested persons were given an opportunity to be heard; and
WHEREAS, the Council has determined that it is in the public interest to vacate such easement.
NOW THEREFORE BE IT RESOLVED, that the following drainage and utility easement
hereby is vacated, to wit:
That part of a drainage and utility easement contained in Outlot C, BLOOMFIELD, according to
the recorded plat thereof, Dakota County, Minnesota, described as follows:
Commencing at the northwest corner of said Outlot C, said corner common with the northeast
corner of Outlot D, of said BLOOMFIELD; thence North 66 degrees 50 minutes 07 seconds
East, assumed bearing along the north line of said Outlot C, a distance of 430.00 feet to the
point of beginning of the tract of land to be described; thence continuing North 66 degrees 50
minutes 07 seconds East, a distance of 453.82 feet; thence South 23 degrees 09 minutes 53
seconds East, a distance of 552.31 feet; thence South 51 degrees 15 minutes 58 seconds East,
a distance of 476.75 feet; thence South 76 degrees 50 minutes 07 seconds West, a distance of
114.07 feet; thence North 78 degrees 09 minutes 53 seconds West, a distance of 498.00 feet;
thence North 64 degrees 09 minutes 53 seconds West, a distance of 170.00 feet; thence South
33 degrees 50 minutes 07 seconds West, a distance of 150.00 feet; thence South 86 degrees 50
minutes 07 seconds West, a distance of 115.00 feet to a point hereinafter referred to as Point
"A "; thence continuing South 86 degrees 50 minutes 07 seconds West, a distance of 115.00
feet; thence North 18 degrees 09 minutes 53 seconds West, a distance of 154.00 feet; thence
North 12 degrees 50 minutes 07 seconds East, a distance of 480.00 feet to the point of
beginning.
Together with a 20.00 foot drainage and utility easement contained in Outlot C, BLOOMFIELD,
according to the recorded plat thereof, Dakota County, Minnesota, the centerline of which is
described as follows:
Beginning at aforesaid Point "A "; thence South 06 degrees 07 minutes 05 seconds West, a
distance of 330.15 feet to the south line of said Outlot C and said centerline there terminating.
The sidelines of said easement are to be prolonged or shorted to terminate at the above described
drainage and utility easement and said south line of Outlot C.
Together with an 80.00 foot drainage and utility easement contained in Outlot B and Outlot C,
BLOOMFIELD, according to the recorded plat thereof, Dakota County, Minnesota, the

centerline of which is described as follows:
Commencing at the southeast corner of said Outlot C; thence South 89 degrees 31 minutes 28
seconds West, along the south line of said Outlot C, a distance of 1453.39 feet to the point of
beginning of the centerline to be described; thence South 57 degrees 53 minutes 51 seconds
West, along said south line of Outlot C, a distance of 157.37 feet and centerline there
terminating.
The sidelines of said easement are to terminate 90 degrees from the point of beginning and the
point of terminus.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Rosemount that the
City Clerk is instructed to record a certified copy of this Resolution with the County Auditor,
County Recorder and the Registrar of Titles of Dakota County and to take any such additional steps
as are required to effect the vacation and the recording thereof.

TO WHOM IT MAY CONCERN:
NOTICE IS HEREBY GIVEN, that the City Council of
the City of Rosemount will conduct a public hearing on
Tuesday, December 4, 2001 in the Banquet Room of the
Community Center, 13885 South Robert Trail, beginning at
