Action: Recommendation of approval with modified condition (3 -0) SUMMARY This lot split is a preliminary step towards a longer -term goal of developing the Abbott property. The 40-acre Abbott property will be split into a ten acre parcel for the farmstead, and the thirty acres will be available for residential development. The thirty-acre parcel is not "land- locked ". There is access available to Birchwood Avenue at the southeast corner of the property. However, this connection is not intended to be the primary access to the property, which would enable development. The extension of Connemara Trail from the west will be the primary access into the immediate area for development. Development fees will be charged when the property is re- subdivided in anticipation of future development. PLANNING COMMISSION PUBLIC HEARING On November 27, 2001, the Planning Commission conducted a public hearing as required. No one other than the applicants attended or participated. Staff added language to the recommended motion, "or until St. Joseph's Church dedicates right -of -way for the west half of Birchwood Avenue." This revised language will allow the developer to proceed with apreliminary plat application for the property. RECOMMENDED ACTION: Motion to adopt a resolution approving the lot split for Heritage Development of Minnesota, Inc. CITY COUNCIL ACTION: CITY OF ROSEMOUNT DAKOTA COUNTY, MINNESOTA RESOLUTION 2001- A RESOLUTION APPROVING THE LOT SPLIT FOR HERITAGE DEVELOPMENT OF MINNESOTA, INC. WHEREAS, the Planning Department of the City of Rosemount received an application from Heritage Development of Minnesota, Inc. for approval of a division of property, said property legally described as: All that part of the West %2 of the East' /2 of the SW 1 /a of Section 21, Township 115, Range 19, Dakota County, Minnesota, except the north 661.53 feet of said section. WHEREAS, the Planning Commission of the City of Rosemount conducted a public hearing on November 27, 2001, as required by the subdivision ordinance, for the purpose of receiving testimony regarding the requested lot division; and, WHEREAS, the Planning Commission adopted a motion to recommend approval of the lot division to the City Council with conditions; and, WHEREAS, on December 4, 2001, the City Council of the City of Rosemount reviewed the recommendation forwarded by the Planning Commission; NOW, THEREFORE, BE IT RESOLVED, the City Council of the City of Rosemount hereby approves the division of the above referenced parcel resulting in the following described parcels: Parcel A All that part of the West' /2 of the East' /2 of the SW' /4 of Section 21, Township 115, Range 19, Dakota County, Minnesota, except the north 661.53 feet of said section, and further excepting the West 10 acres thereof. Parcel B: The west 10 acres of the West %2 of the East %2 of the SW' /4 of Section 21, Township 115, Range 19, Dakota County, Minnesota, except the north 661.53 feet of said section. BE IT FURTHER RESOLVED, the approval of this lot split is subject to: 1. Restriction on further subdivision until Connemara Trail is being constructed to the edge of the property or until St. Joseph's Church dedicates right -of -way for the west half of Birchwood Avenue. r �e Resolution 2001- ADOPTED this 4"' day of December, 2001, by the City Council of the City of Rosemount.
