Comprehensive Plan Amendment, Appeal of Variance Decision, and Appeal of Site Plan Review Decision to expand truck trailer parking. AGENDA SECTION: Public Hearing PREPARED BY: Kyle Klatt, Senior Planner AGENDA NO. 7.a. ATTACHMENTS: None APPROVED BY: LJM RECOMMENDED ACTION: Staff recommends the City make the following motions: 1. Motion to postpone consideration of Comprehensive Plan Amendment to change the future land use designation of Lot 1, Block 1 and Outlot B of Rich Valley Industrial Park from RC – Regional Commercial to GI – General Industrial. 2. Motion to open the public hearing concerning an appeal of variance and site plan decisions made by the Board of Appeals and Adjustments and Planning Commission and to continue the public hearing until the April 4, 2017 City Council meeting. SUMMARY The City Council is being asked to postpone taking action on a request by Wayne Transports, Inc., for a Comprehensive Plan Amendment to change the future land use designation of Lot 1, Block 1 and Outlot B of Rich Valley Industrial Park from RC – Regional Commercial to GI – General Industrial. The applicant has also filed an appeal of related decisions made by the Board of Appeals and Adjustments concerning a variance request and the Planning Commission concerning a site plan review for a parking expansion project on the same property. The Council is being asked to delay consideration of the appeals as well. The applicant is requesting City Council deliberations occur when a full Council is present. Approval of a Comprehensive Plan Amendment requires a 4/5ths majority of the Council and therefore would require unanimous approval if all Councilmembers were not present at the meeting. It is staffs understanding that at least one Councilmember will be absent for the next two meetings, and the applicant is unable to be present for the March 21, 2017 meeting. Staff is therefore recommending that the City Council continue the public hearing and deliberation of the items until the April 4, 2017 meeting in accordance with the proposed motions listed above. CONCLUSION AND RECOMMENDATION Postpone City Council review of the Comprehensive Plan Amendment and continue the public hearing concerning appeals of Board of Appeals and Adjustment and Planning Commission decisions regarding variances and site plan review.
