Revised Grading Plan -A APPROVED BY: J Applicant: Solberg Aggregate Compnay Property Owner: Koch Petroleum Group Location: West side of U.S. 52, 3 /4 mile north of CSAH 42 Zoning: General Industrial SUMMARY This application is a request from Solberg Aggregate Company to modify their grading plan for the mining operation currently permitted on property owned by Koch Petroleum Group. It is the same essential request made with previous permit renewals, but denied by Council. Therefore, this is a separate request which should not be considered a renewal, but a modification to the grading plan. City Council members present at the Committee of the Whole work session in February indicated that Council would be willing to consider individual requests concerning ongoing mining operations. Because this request is viewed as a comparatively minor change, no public hearing is required. MORATORIUM The adopted moratorium took effect on June 23, 2000, and prohibits new mineral extraction permits. It seems apparent that the moratorium does not affect previously approved mineral extraction permits. REVISED GRADING PLAN The mining operation essentially scrapes off the material on top of the bluff are north of the old railroad crossing (now interrupted) on U.S. 52. The revised grading plan will result in a slightly steeper grade by creating more of a bevel at the crest of the bluff. A "lip" will mark the edge of the bluff to control erosion. The change is from an almost flat grade of 1% slope to a barely perceptible slope of about 3 %. The amount of material to be removed with the modified grading plan is estimated at 175,000 cubic yards. Without the grading plan modification, the amount of material is estimated at about 30,000 cubic yards. As previously stated, the agreement with Koch is to cease all operations in this area by the end of 2003. RECOMMENDED ACTION: Motion to amend the mineral extraction permit for Solberg Aggregate Company to allow the revised grading plan as the required grading and restoration plan to be attached to the mineral extraction permit as Exhibit A.
