BY: Bret A Weiss, P.E., Interim City .Engineer AGEN ATTACHMENTS: Resolution , Response Letter to Piekarski APPROVED BY: i OEM The proposed construction project was delayed at the last meeting until the Utility Commission previewed the possible addition of reconstructing Danville Avenue from Dodd Boulevard to Upper 145 Street. During the May 7t Utility Commission meeting, the Utility Commission did recommend completion of the project along Danville Avenue as part of the 2001 Street & Utility Reconstruction project. In the interest of time and an effort to have this project completed in the 2001 construction season, we have completed the plans for the Danville portion to a point that if the Council chooses to move forward with the Danville project, Council could .choose to approve the plans and spec's at this meeting and authorize the Ad for Bid for the entire project. Delaying the project any further would place the project in jeopardy of completion in 2001. The public hearing will be held for the property owners who originally were notified of only an overlay assessment. This completion of the watermain the entire length of Danville will mean that all the property owners will be assessed for a street reconstruction project. Mr. Tom Piekarski attended the Utility Commission meeting and identified a list of questions that he has requested be answered. We asked Mr. Piekarski to put those questions in letterform and we would respond accordingly. The attached responses are available for your review. It is likely that Mr. Piekarski will be in attendance at the meeting to discuss the answers to these questions. RECOMMENDED ACTION: MOTION TO ADOPT A RESOLUTION ORDERING THE PROJECT, ORDER PLANS AND SPECIFICATIONS, APPROVE PLANS AND SPECIFICATIONS AND AUTHORIZE ADVERTISEMENT FOR BIDS FOR THE 2001 STREET AND UTILITY RECONSTRUCTION IMPROVEMENTS, CITY PROJECT #326. COUNCIL ACTION: S I CITY OF ROSEMOUNT DAKOTA COUNTY, MINNESOTA RESOLUTION 2001 - A RESOLUTION ORDERING THE PROJECT, ORDERING THE PLANS AND SPECIFICATIONS, RECEIVING THE PLANS AND SPECIFICATIONS AND AUTHORIZING ADVERTISEMENT OF BIDS FOR THE 2001 STREET AND UTILITY RECONSTRUCTION IMPROVEMENTS CITY PROJECT #326 WHEREAS, the City Council has received and accepted the Feasibility Report on March 20, 2001 for City Project #326; and NOW THEREFORE BE IT RESOLVED, that the City Council of the City of Rosemount hereby orders the improvements of the 2001 Street and Utility Reconstruction Improvements, City Project #326. BE IT FURTHER RESOLVED, that the City Council of the City of Rosemount orders the preparation of plans and specifications for said improvements of City Project No. 326. BE IT FURTHER RESOLVED, by the City Council of the City of Rosemount, Minnesota: 1. Such plans and specifications are hereby approved and ordered placed on file in the office of the City Clerk. 2. The City Clerk shall prepare and cause to be inserted in the official City newspaper and the Construction Bulletin an advertisement for bids upon the making of such improvements under such approved plans and specifications for City Project #326. 3. The advertisement shall be published in each of said publications at least once not less than ten (10) days before the date set for opening bids, shall specify the work to be done, shall state that bids will be publicly opened on June 13, 2001 at 10:00 o'clock a.m. at the Rosemount Community Center in said City and that no bids will be considered unless sealed and filed with the City Clerk and accompanied by a cash deposit, cashier's check, bid bond or certified check payable to the City Clerk for five (5 %) percent of the amount of such bid. Why was the watermain not run, so that my household could hook up, many years ago when the sewer line was run? This question has been addressed on other occasions, most recently at the Utility Commission meeting by Mr. Harry Willcox, who was on the Council at the time of the development of your property. The only response we have to this issue is that at the time the sewer was installed it was not cost - effective to install the watermain. This is related to the number of benefited parcels versus the total cost of the improvement. The City of Rosemount has changed their method of assessment so that you pay a set rate according to the length of your property and the City of Rosemount picks up any extra costs that cannot be assessed and would normally have been charged to the benefited property owners. 2. Does hooking up to City water improve my property value? In general, connection to City water and sewer service does increase the value of a residential property in many different ways. The watermain assessment that is proposed against your property is being done so in accordance with State Statute Chapter 429, which allows you to dispute the assessment if you can prove it does not increase the value of your property by an equal amount. J 3. Were the 3 homeowners, my property and the two adjacent to my property, asked to hook up to City water? As of the writing of this letter, nobody has been asked to hook up to City water. However, all three residences will be in the same situation that they will be required to hook up to City water within two years of the installation of the pipe. 4. Is there a charge if no water is used? Yes there is a fixed quarterly $8.90 charge for each water account and an $8.80 quarterly Surcharge for single - family water meter maintenance and infrastructure. 5. If I hook up to City water, how many faucets must I have hooked up to City water? I have attached a copy of the Plumbing Code that states "if a public water supply system is accessible, the water distribution system must be connected to it, unless otherwise permitted by the Administrative Authority. A water well taken out of service because the person is connecting to a public water supply must either be maintained for a use such as irrigation or sealed and abandoned in accordance with the Minnesota Water Well Construction Code." :Therefore, all plumbing for potable water use must be connected to the public water system. 6. What ruling or rule states that the entire house, except outside faucets, has to be hooked up? Please refer to Ordinance 1.12.b. Basically stating the paths between private and City water may not cross. See answer to question number 5. 7. Is the City Council/Utility Commission going to force me to hook up to City water within 2 years? 5 years? 10 years? unlimited? As was stated at the Utility Commission meeting, the City ordinance states that you have two years to hook up to City water after the pipe has been installed. To -date the City has no record of going to court to force someone to hook up to the City water system. However, it is likely that the City may test the well water to make sure that there is no immediate concern with the quality of water being provided. If it is determined that the well is a health hazard, the City would take steps to force connection to the public water system. 8. Is hooking up to City water a service provided by the City of Rosemount? The act of providing safe, potable water to the residents of Rosemount is a service provided by the City or Rosemount. 2 9. How much is my assessment going to be, for the road and water? The assessment roll as prepared includes a $2,156 assessment for the watermain installation, plus $2,400 for the street assessment. 10. How much is the WAC (water access charge)? The charges included when you connect to City water would include a sewer /water permit of $47.50, plumbing permit of $47.50, WAC charge $2,266.00, meter purchase of $300 for a total of $2,661.00. The cost of connecting to your home would also be your expense. 11. How much money is the City going to offer for the land they need for the bike path? The City has ordered an appraisal of the land proposed to be acquired. Upon receipt of the appraisal, the City will tender an offer. We hope this letter adequately addresses your concerns.
