This item was requested to be placed on the agenda by the Developer, D.R. Horton (see
attached letter). In 2000 the City entered into a Subdivision Agreement with D.R. Horton to
complete Phase 1 and 2, Evermoor 4t' Addition, otherwise known as the Crosscroft area.
Phase 1 is currently under construction. The northern portion of this site drains through a
series of ponds adjacent to Shannon Park Elementary and ultimately connects to Marcotte
Pond. Currently the outlet connection between Marcotte Pond and the Evermoor Development
on the east side of Shannon Parkway is sandbagged and is not operational. With the capacity
that is available on the east side of Shannon Parkway, it is not anticipated that the sandbags
will be removed until the lift station is inplace. The majority of Phase 2, Evermoor 4t'' Addition,
drains south and east ultimately into Schwarz Pond, however no connection to Schwarz Pond
has been completed at this time.
Since the last Council meeting, significant effort has been undertaken by the Developer to
address erosion issues. Further areas that were previously seeded last year are starting to
show signs of vegetation. We feel the Developer has and will continue to make a concerted
effort to deal with erosion control measures on the site. Because this project is not anticipated
to be assessed, the project does not need to be bid in accordance with Chapter 429 bidding
rules, however the Developers Agreement utilizes assessments to the property as a final means
of financial protection should if be needed. Therefore, the Developer has provided the attached
letter stating that they accept responsibility for the bids that are received should a shorter than
normal bid period be utilized. If the Council chooses to move forward with this project, it
would likely be combined with the proposed Marcotte Forcemain project, if that project is also
ordered in an effort to hopefully realize some overall cost savings.

RESOLUTION 2001-
A RESOLUTION RECEIVING THE PLANS AND SPECIFICATIONS
AND AUTHORIZING ADVERTISEMENT OF BIDS FOR
EVERMOOR 4 TH ADDITION STREET AND UTILITY IMPROVEMENTS, PHASE 2
CITY PROJECT #333
WHEREAS, the City Council of the City of Rosemount have ordered the preparation of plans and
specifications for Evermoor 4 Addition Street and Utility Improvements, Phase 2, City Project #333 and
such plans and specifications have been presented to this Council for approval:
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Rosemount, Minnesota:
1. Such plans and specifications are hereby approved and ordered placed on file in the office of the City
Clerk.
2. The City Clerk shall prepare and cause to be inserted in the official City newspaper and the
Construction Bulletin an advertisement for bids upon the making of such improvements under such
approved plans and specifications for City Project #333.
3. The advertisement shall be published in each of said publications at least once not less than three (3)
weeks before the date set for opening bids, shall specify the work to be done, shall state the bids will
be publicly opened on June 1, 2001 at 10:00 o'clock a.m. at the Rosemount Community Center in
said City and that no bids will be considered unless sealed and filed with the City Clerk and
accompanied by a cash deposit, cashier's check, bid bond or certified check payable to the City Clerk
for five (5 %) percent of the amount of such bid.

Re: Waiver of Chapter 429 Statue Bidding Process — Evermoor 4t Addition,
Phase 2
Dear Mr. Weiss:
We as property owners of 100% of the petitioning /benefiting properties of
Evermoor 4t understand under the 429 process we may request the city waive
the Public Hearing process, formal bidding requirements and assessment
appeal process. We also understand that by reducing the advertisement for
bid period we may incur increased project costs.
On behalf of Contractor Property Developers Company (CPDC) and D.R.
Horton Homes we would like to formally request the city authorize the project
with a two week advertisement in an effort to expedite the project. We accept
the risk and or cost implications that this may impose upon the project.
