Rural Residential Rural Residential Convert duplexes to single family (proposed lots 1 and 2), split parcel and re -align proposed lots 2 & 3. Granted Variances for lot area and side yard setback for 12238; recommended approval of the plat (4 -0) Two non - conforming duplexes currently exist on a single parcel along the east side of South Robert Trail. They date from 1963 and 1972. The parcel contains a "pan- handle" that would benefit the neighboring property to the south. The request for administrative plat is based upon splitting the "two- duplex" parcel into two lots for single - family use, and realigning the common boundary line with.the Gustafson lot. Lot area variances are required for the three lots. The incentive to the city is to - legitimize the structures by converting them into single - family use, thus creating an opportunity for owner occupation, and eliminating two deteriorating rental properties. The southerly property would be improved by absorbing the "pan - handle ". The properties must function independently with septic systems and wells. It would become non - conforming as staff is not recommending a variance. However, it does preclude, a drainage and utility easement along the lot line. Therefore, a ten foot wide drainage & utility easement will be recommended for the adjacent edge of Lot 1. PLANNING COMMISSION PUBLIC HEARINGS No one commented at the public hearing, and the applicant was in agreement with the Staff recommendation. The Commissioners granted the needed variances for lot area and side yard setback, acting as the Board of Appeals and Adjustments. The Commissioners then adopted a motion to recommend approval of the plat as presented. The only questions concerned the garage that would remain non- conforming. RECOMMENDED ACTION: Motion to adopt a resolution approving the administrative plat for 12228, 12238 and 12310 South Robert Trail CITY COUNCIL ACTION: CITY OF ROSEMOUNT DAKOTA COUNTY, MINNESOTA RESOLUTION 2001- A RESOLUTION APPROVING THE ADMINISTRATIVE PLAT FOR 12228, 12238 and 12310 SOUTH ROBERT TRAIL WHEREAS, the Community Development Department of the City of Rosemount received an application from Mike Kelzenberg for approval of the Administrative Plat for properties located at 12228, 12238, and 12310 South Robert Trail in Rosemount, Minnesota; and WHEREAS, on December 11, 2001, the Planning Commission of the City of Rosemount reviewed the Administrative Plat for 12228, 12238, and 12310 South Robert Trail and adopted a motion to recommend approval to the City Council; and WHEREAS, on December 18, 2001, the City Council of the City of Rosemount reviewed the Administrative Plat for 12228, 12238, and 12310 South Robert Trail. NOW, THEREFORE, BE IT RESOLVED, the City Council of the City of Rosemount hereby approves the Administrative Plat for 12228, 12238, and 12310 South Robert Trail, subject to the following: 1. Granting of variances to lot area for all three lots and setbacks for Lot 2. 2. Conformance with requirements for individual sewer treatment systems and wells. 3. Converting the two duplexes to single family use in accordance with building code and zoning standards. 4. Incorporation of recommendations of the City Engineer concerning drainage and utility easements. 5. Payment of G.I.S. fees. 6. Approval of the Minnesota Department of Transportation as necessary. ADOPTED this 18' day of December, 2001, by the City Council of the City of Rosemount.
