Sewage System Maintenance System Ordinance AmendmentA CITY OF ROSEMOUNT EXECUTIVE SUMMARY FOR ACTION CITY COUNCIL MEETING DATE: December 18, 2001 AGENDA ITEM: Sewage System Maintenance AGENDA SECTION: New Business PREPARED BY: Mick Kaehler, Building Official AGEND ATTACHMENTS: Ordinance Amendment- Exhibit A APPROVED BY: In 1996 when the Individual Sewage Treatment System (ISTS) ordinance was adopted, it initially provided for a two -year cycle for the maintenance of a septic system. The two -year cycle was the recommendation of Met Council. Shortly after adoption of the ordinance Met Council changed its recommendation to a three -year cycle for maintenance. Since we had just adopted a two -year maintenance cycle, it was decided not to amend the ordinance but to address it at a later date after residents had proceeded through the original timetable as set forth at the informational meetings that were held. The attached draft ordinance changes provide for the time frame requirement for ISTS maintenance to be changed to a three -year cycle. With Rosemount being one of the first cities to adopt a maintenance program, there were no cities available to gain insight from. County Ordinance 113 requires for each sewage tank system that is pumped, a pump maintenance record be completed; and a copy of this record be sent to the County within 30 days from the date of pumping. The program was set up for the pumpers to notify the county when they serviced a system. The County would update their database and notify the City of Rosemount. This created a serious time tag from the time of the original pumping to the point the resident received their maintenance permit. Realistically, it took residents 30 to 90 days to receive maintenance permit. This time frame stretched out in some instances to 160+ days. This is not acceptable. Given this element, we are proposing to develop our own database and send a response card to the resident 30 -60 days prior to the expiration date of their maintenance permit. When their system is serviced, the pumper would fill out the card and mail it to the City of Rosemount. This would eliminate waiting for the County to update their database and in turn notify us. In addition the residents would receive their maintenance permit in a more timely fashion. Appropriate language changes have been incorporated into our ordinance. We have also included language changes in Title 9 to eliminate Protective Inspections Division and replace it to Building Inspections Division. RECOMMENDED ACTION: Adopt an amendment to the maintenance and operating regulations of individual sewage treatment systems. COUNCIL ACTION: CITY OF ROSEMOUNT STATE OF MINNESOTA ORDINANCE NO. AN ORDINANCE AMENDING CITY CODE TITLE 9 CHAP'T'ERS 1 Through 7, RELATED TO BUILDING CODE THE CITY COUNCIL OF THE CITY OF ROSEMOUNT, ORDAINS AS FOLLOWS: SECTION 1 . Title 9, Chapters 1 through Chapter 7: Title 9, Chapters 1 through 7: any reference to "Protective Inspections Division" will now be replaced with `Building Inspections Division." SECTION 2. Title 9, Chapter 6, On -Site Sewage Treatment System Regulations, Section 9: MAINTENANCE AND OPERATING REGULATIONS OF EXISTING ISTS: A. Residential Maintenance Permit: The owner of every residential dwelling with an ISTS system must obtain an ISTS maintenance permit from the City's Pr-eteaive Inspections Division. An ISTS maintenance permit shall be issued by the City's Building Inspections Division only upon successful completion and proper recording of the sewage system maintenance log slit in accordance with subsection C of this Section. The log record must be completed in its entirety and all information recorded must be verified in writing by the signature and date of the licensed pumper /inspector completing the maintenance. The permits(s) shall be deemed revoked if the system becomes a failed ISIS. SECTION 3. This Ordinance shall be effective immediately upon its passage and publication.
