This is a housekeeping item for the Carrousel Plaza Townhomes plat. As part of the platting
process for the Carrousel Plaza Townhomes plat, Heritage Development had requested the
vacation of an existing drainage and utility easement on Outlot A of Carrousel Plaza South. This
small portion was left out during the initial Public Hearing in November, 2000.
The easement to be vacated is a drainage and utility easement commencing at the southeast corner
of Outlot A, Carrousel Plaza South then N 41 43' 08" W 132.12 feet to the point of beginning then
N 02 15' 01 " E 6.74 feet the S 87° 13' 37" W a distance of 76.96 feet then S 87 44' 59" E
76.66 feet to the point of the beginning, according to the recorded plat thereof, Dakota County,
Minnesota.
Because the easement was dedicated for public use (drainage & utilities), a public hearing is
required to vacate it.
Staff is recommending approval of the easement vacation.
RECOMMENDED ACTION: MOTION TO ADOPT A RESOLUTION CAUSING EASEMENT
VACATION ON THE CARROUSEL PLAZA SOUTH PLAT, OUTLOT A.

RESOLUTION 2001 -
A RESOLUTION CAUSING EASEMENT VACATION IN
OUTLOT A, CARROUSEL PLAZA SOUTH
WHEREAS, a public hearing was scheduled and held before the City Council of the City of
Rosemount on July 2, 2001 after due publication as required by law, and all interested
persons were given an opportunity to be heard; and
WHEREAS, it appears the current easement serving a public purpose is based upon the
property in a predevelopment state, and will be replaced by a modified easement for
public purpose that will be incorporated with the development plat.
NOW THEREFORE BE IT RESOLVED, that the following drainage and utility easement
hereby vacated, to wit:
Commencing at the southeast corner of Outlot A, Carrousel Plaza South then N 41 43'
08" W 132.12 feet to point of beginning then N 02 15' 01 " E 6.74 feet then S 87 13'
37" W a distance of 76.96 feet then S 87 44' 59" E 76.66 feet to the point of the
beginning, according to the recorded plat thereof, Dakota County, Minnesota
BE IT FURTHER RESOLVED, that the City Attorney shall prepare a notice of completion of
the proceedings and necessary Quit Claim Deeds which shall contain the name of the
City, identification of the vacation and a statement of the time of completion thereof, and
shall present the same to the County Auditor and then file a copy with the County
Recorder.
ADOPTED this 2nd day of July, 2001.
