At the public hearing for the 2001 Street and Utility Reconstruction Improvements, City Project
#326, the right -of -way acquisition along the Piekarski property was discussed. Originally we
were proposing to acquire a 17 -foot strip along the entire length of the lot, however after
further review, we are proposing to just acquire a small parcel on the corner of Dodd Boulevard
and Shannon Parkway. The pathway will be curved around this lot to avoid the property
acquisition.
Mr. Piekarski would like to trade the property for the ability to not hook -up to City water.
Considering that water hook -ups are stipulated by Ordinance, we have chosen not to negotiate
that issue. He has stated that he will not provide the land under any other circumstances,
which is the reason we are requesting the authorization to proceed with condemnation.
RECOMMENDED ACTION: MOTION TO ADOPT A RESOLUTION AUTHORIZING
ACQUISITION OF EASEMENT BY EMINENT DOMAIN.

RESOLUTION AUTHORIZING ACQUISITION OF
EASEMENT BY EMINENT DOMAIN
WHEREAS, the City of Rosemount ( "City ") is a municipal corporation and subdivision of the State of
Minnesota organized and operating under Minnesota law, and is authorized by Minn. Stat. § 412.211
and § 465.01 to acquire real estate by exercising the power of eminent domain under and pursuant to
Minn. Stat., Ch. 117; and
WHEREAS, under Minn. Stat. § 412.221, subdivision 6, the City Council has the power to change or
widen public streets and to lay out, repair and improve streets and other public ways; and
WHEREAS, the Council has determined that it is necessary and in the interests of the public to acquire
easements as hereafter described for street, utility, pathway and drainage purposes over the property at
the address of 14800 Dodd Boulevard in the City of Rosemount (the "Subject Property "), which
easements are described on Attachment One to this Resolution, which is hereby made a part hereof (the
"Easements "), and
WHEREAS, the City staff has attempted to negotiate an agreement with the owner of the Subject
Property but has been unsuccessful in doing so; and
WHEREAS, the City desires to construct the right of way improvements in the easements during the 2001
construction season.
NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Rosemount:
The City Council hereby finds that it is necessary and in the public interest to acquire a temporary
construction easement and a permanent easement for street, utility, pathway and drainage purposes as
described on the attached Attachment One over the Subject Property.
2. The City Attorney and Staff are authorized and directed to commence eminent domain proceedings to
acquire a temporary construction easement and a permanent easement for street, utility, pathway and
drainage purposes over the Subject Property, pursuant to Minnesota Statutes, Section 117.042 and to
pay to the owners or into court, a sum of money to secure compensation to the owners of the Property,
which amount shall be equal to the City's approved appraisal of value as determined by staff.
The easement to be acquired is a non - exclusive permanent easement for public street, utility, pathway
and drainage purposes.

That part of the following described parcel of land in the City of Rosemount.
The following described tract, piece or parcel of land situate, lying and being in the County of
Dakota and State of Minnesota, to -wit: -
Commencing at the intersection of the center line of the Dodd Road and the East line of the
Southwest quarter (SW '/4) of Section Thirty (30), Township One Hundred and Fifteen (115),
Range Nineteen (19), thence running south along the east line of said quarter section Sixteen (16)
rods, thence West Ten (10) rods, thence North to the center line of said Dodd Road; thence
Northeasterly along the center line of said Dodd Road to the place of beginning, all according to
the Government Survey thereof.
Which lies within the following permanent easement for street, utility, pathway and drainage
purposes:

A strip of land 5.00 feet in width over the above - described property, the northwesterly line of
said strip is contiguous with a line drawn parallel with and distant 33.00 feet southeasterly of

Enclosed is the estimated furniture budget for your building
renovation / expansion project as requested for tomorrow's
meeting.
The grand total is $225,494 and includes everything
related to the furniture, except for sales tax.
You will need to obtain a price for the moving of existing
furnishings which are being reused and for moving of
fax personal possessions in the work stations, private offices
and shared areas.
An electrician will be needed to connect the building power
source to the open office furniture systems. You will also be
responsible for any data / communication cabling which may
be located in the base of the open office panel system.
Installation estimates are based on non -union labor that is
provided during normal business hours. Please let me know
if you will require a quote for "union" and / or "overtime"
installation services.
