This project is an extension of the 1999 CSAH 42 Reconstruction project from Chippendale Avenue to Shannon Parkway. The project is similar to the 1999 project, which created 8' shoulders in an urban street design. This item is a request for Council to adopt a resolution receiving the Feasibility Report, approving the project and ordering the plans & specifications for City Project #333. Staff recommends that City Council takes the action as described below. NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF ROSEMOUNT, MINNESOTA: The Council will consider the improvements in accordance with the report and the assessment of abutting property for all or a portion of the cost of the improvements pursuant to Minnesota Statutes, Chapter 429 at an estimated cost of the improvements of $839,835.00. 2. EXECUTIVE SUMMARY ' The CSAH 42 Street and Utility Reconstruction Project, Diamond Path to Shannon Parkway is an extension of the CSAH 42 project constructed in 1999, Shannon Parkway to Chippendale Avenue. The projects are very similar with regard to the emphasis on ' widening to provide shoulders and the installation of storm sewer, however this project does not include any additional access to CSAH 42. 1 The proposed improvements include the construction of CSAH 42, between Diamond Path and Shannon Parkway (2500 -feet) to an eighty -eight foot (88') wide full urban section roadway. This portion of CSAH 42 is currently a rural section roadway. The project includes widening the existing roadway to include eight -foot (8') shoulders, bituminous mill and overlay the existing street, B418 concrete curb and gutter, storm sewer, and replacement of the existing pathway along the north side of CSAH 42. The estimated total project cost is $839,835, which includes a 10% contingency and 30% indirect costs. Funding for the project is provided from contributions from the City's Storm Sewer Core Fund, the City's CIP Fund, and a contributing share of the CSAH 42 improvements by Dakota County to pay for street and storm sewer improvements. The improvements can be completed, including all lifts of bituminous and all restoration items, in 2001. This project is feasible, necessary and cost - effective from an engineering standpoint and should be constructed as proposed herein. INTRODUCTION 2.1 Authorization On January 15, 2001, the Rosemount City Council authorized the preparation of a Feasibility Report for the CSAH 42 Street and Utility Reconstruction Project. This project has been designated as City Project No. 327. 2.2 Scope This project will include the reconstruction of CSAH 42 from Diamond Path to Shannon Parkway. This reconstruction will consist of widening the eastbound and westbound pavement to accommodate and eight -foot (8') shoulder, milling and overlaying the existing pavement and adding B418 concrete curb and gutter. Storm sewer improvements will be necessary for the CSAH 42 drainage area with the conversion of the roadway section from rural to urban. 2.3 Data Available Information and materials used in the preparation of this report include the following: City of Rosemount Record Plans City of Rosemount Topography Maps City of Rosemount Storm Water Management Plan Field Observations of the Area Field Survey City of Rosemount - CSAH 42 Street and Utility Reconstruction Project Feasibility Report - City Project No. 327 WSB Project No. 1306 -002 2 ,w, WS && 3. GENERAL BACKGROUND 3.1 Project Location The CSAH 42 Street and Utility Reconstruction Project is located on CSAH 42 from Diamond Path to Shannon Parkway. (See Figure 1) The entire project location is located in Sections 30 and 31. 3.2 Existing Conditions 3.2.1 Roadway CSAH 42 is currently a rural section roadway with curb and gutter existing only on the north side of the westbound traffic lane. The existing street utilizes ditches and minimal storm sewer to drain the roadway surface and provide storm water conveyance. The roadway surface on CSAH 42 is in fair condition. CSAH 42 currently consists of a 24 -foot (24') wide roadway surface in both the eastbound and westbound directions, along with left and right turn lanes at Diamond Path and Shannon Parkway. 3 .2 .2 Storm Sewer The proposed project is located in the Wachter Lake Drainage District (WA) and the Shannon Pond Drainage District (SP) as noted in the Rosemount Stormwater Comprehensive Plan. The existing storm sewer system for the project area is limited to collection at the following locations: • The turn lane from westbound CSAH 42 to northbound Diamond Path (constructed by Dakota County in 2000) has a series of catch basin inlets. There is also a catch basin located in the southeast corner of the intersection which collects the stormwater in the south ditch. These inlets collect the stormwater and convey it to the storm sewer system in Diamond Path which discharges into Wensmann Pond. • Minimal storm sewer inlets are located along the north curb line and center median. These inlets drain the north curb line and median to the ditch on the south side of CSAH 42. • A storm sewer stub (36 ") was provided during the 1999 CSAH 42 Reconstruction Project in the southwest quadrant of the CSAH 42 and Shannon Parkway to drain the south ditch line of CSAH 42. 3 .2 .3 Pathways Currently, eight -foot (8') pathways on the north and south side of CSAH 42 exist between Diamond Path and Shannon Parkway. The pathway on the north side of CSAH 42 is in poor condition and will need to be replaced. The pathway on the south side of CSAH 42 is generally in good condition. However, there are some portions of the pathway that will need to be replaced. City of Rosemount - CSAH 42 Street and Utility Reconstruction Project Feasibility Report - City Project No. 327 WSB Project No. 1306 -002 /� L Yl� �7B ,g�! 3 ' 4 PROPOSED IMPROVEMENTS This report addresses the street and utility improvements necessary to update CSAH 42 from a rural section to an urban section as well as widening the existing roadway and providing lateral storm sewer. 4.1 Street (See Figures 2 -5) Proposed improvements to CSAH 42 involve upgrading the existing street to an urban section with the addition of concrete curb and gutter, paved shoulders, and storm sewer. The westbound lanes will be shifted south to allow for a shoulder for most of the length of the street. CSAH 42 will be constructed to a width of eighty -eight feet (88'), transitioning to ninety -six (96') in areas with turn lanes. The eastbound and westbound directions will be thirty -four (34') wide, with a total width of fifty -two feet (52') wide in areas with turn lanes. CSAH 42 will have a one and one - half -inch (1 1 /2 ") bituminous overlay pavement placed ' over the existing pavement. In areas where turn lanes are constructed, the street section will consist of eight inches (8 ") of bituminous, twelve inches (12 ") of gravel base, and twenty -six inches (26 ") of select granular borrow. ' B -418 concrete curb and utter will be laced along the south shoulder and the median. g p g Most of the existing B -618 concrete curb and gutter located along the north side of the westbound drive lane will remain in place. The median will be concrete in the nose area where the median width is less than ten feet (10'). In the wider median areas, a grass median is proposed. 4.2 Storm Sewer (See Figures 2 -5) The storm sewer system for CSAH 42 will replace the existing ditch and culvert system. The adjacent storm sewer on Diamond Path and Shannon Parkway has been sized to ' accommodate the runoff from CSAH 42 and direct it south to Wensmann Pond and Pond WA -600, respectively. The storm sewer improvements include the construction of lateral storm sewer lines to serve the project area and accommodate state -aid standards. Specifically, lateral storm sewer facilities will be designed to carry the storm water runoff from a 10 -year rainfall event. Catch basin spacing will be designed in accordance with current state -aid standards. The proposed storm water collection facilities are as follows: ' City of Rosemount - CSAH 42 - Street and Utility Reconstruction Project /�/ /�+� ' Feasibility Report - City Project No. 327 WSB Project No. 1306 -002 & A =so 4 1 0 CSAH 42 (Diamond Path to 400 -feet east): ' The stormwater from this area is proposed to be collected in a lateral storm sewer system and discharged into the existing storm sewer at Diamond Path which flows south into Wensmann Pond. ' CSAH 42 (400 -feet east of Diamond Path to Shannon Parkway) The stormwater from this area is proposed to be collected in a lateral storm sewer system and discharged into the existing storm sewer system at Shannon Parkway which flows south to Pond WA -600. The south ditch line is too low to be I discharged to the south curb line and will therefor remain as a shallow ditch with storm sewer used to collect the runoffs. ' 4.3 Sidewalks and Trails (See Figures 2 -5) The proposed improvements include the reconstruction of an eight -foot (8') wide bituminous pathway along the north side of CSAH 42. Also, minor portions of the trail on the south side of CSAH 42 will require reconstruction. 4.4 Permits /Approvals Permits will be required for this project from Dakota County and Mn/DOT State Aid for improvement to CSAH 42. Dakota County would like the improvements funded and, therefore, approved by State Aid for CSAH 42. A permit is also required from the Minnesota Pollution Control Agency for the storm water runoff. 4.5 Rights -of -Way /Easements No additional right -of -way is anticipated for construction of CSAH 42. The opinion of cost incorporates anticipated 2001 construction costs and includes a 10% continency factor for all related indirect costs. The indirect costs are estimated at 30% and includes legal, engineering, administrative and financing items. The summary of the project cost is as follows: Since Dakota County will be paying the City directly, they will contribute 18% engineering on top of their share of the construction cost. They will not participate in any of the project capitalized interest costs. Funding Funding for the project will be provided through the 2001 CIP funds, the Storm Sewer Core Fund and Dakota County Highway Department. The Dakota County funding will be provided to the City in 2002, in accordance with the Dakota County Capital Improvement Program (CIP). A summary of the funding of specific items is as follows: 5.2.1 Storm Sewer: The project costs associated with the storm sewer improvements will be funded by the City and County. Based on State Aid requirements, CSAH 42 storm sewer construction will be financed by Dakota County at a rate of 55% of State Aid approved sharing rates, with the remainder funded by the City for all storm sewer within the CSAH 42 right -of -way. 5.2.2 Streets: CSAH 42 will receive a 55% cost contribution for construction from Dakota County and a 45% cost contribution from the City. These percentages apply to all aspect of CSAH 42 construction. City Project No. 327 consists of converting CSAH 42 from a rural section to an urban section and improving the local drainage system. Included with the project improvements are storm sewer and street widening /overlaying in accordance with the City of Rosemount's comprehensive plans. It is the recommendation of WSB & Associates, Inc. that City Project No. 327 is feasible, necessary and cost - effective from an engineering standpoint. We recommend construction of the proposed improvements as detailed in this report. On Friday we walked the site with Steve Crawford of WSB & Associates, Inc. (Field Representative) and discussed the use of temporary sediment ponds, check dams, silt fence and temporary and permanent cover to protect and stabilize the area from erosion. We will be coming to the site to -day, to evaluate the effectiveness of the structures installed by the contractor. We concentrated on the area near your property. We are overwhelmed by size by the development. We suspect based on what we saw on Friday that there are likely other violations. Our plan is to work on the most problematic areas first. We need to partner with Steve Crawford (the project's Inspector who will be on site all day) to encourage the developer to follow their detailed erosion control plan. We will provide the city any back -up necessary to get the project in compliance as quickly as possible. I will keep you updated on our progress. I noted that two city trucks were at the wetland in your front yard, staffing a pump. I tried to contact city Engineer Weiss, who was not in. I left message on voice -mail. I spoke a bit with Brian Watson of SWCD about the issue. I also had lunch with Allison Morris and Tim Brown yesterday, both ex- Rosemount water resources staff people. They gave me some additional background. There is no way to legally extend our jurisdiction to the wetland in the front of your home along Shannon Parkway. It clearly is /was not connected to 19 -223 below it's ordinary high water mark. You may wish to contact the DNR Area Wildlife Manager Diana Regenshied at 952 -492 -5266. It was the DNR Wildlifers who assisted back in the early 90's when you originally dug out the pond. We also request the removal of all sediment that has washed into our property and that steps are taken to ensure that it does not occur in the future. We have stated many times in the past our expectation is that the City of Rosemount and Contractor Property Developers will take whatever action is necessary to protect existing properties from storm water runoff damage. The City of Rosemount must complete feasibility studies and construct and complete all storm water solutions prior to further development and increased runoff. We are requesting that no further streets be put in and no building permits be issued for any area that the permanent storm water solution is not in place and working. This should include all lift stations, increased holding ponds, etc. as required by the Engineer's recommendations. We should not move forward until all the problems identified by the Minnesota Pollution Control Agency and the Department of Natural Resources are corrected and steps are taken to ensure no further problems occur. We are holding the City of Rosemount, it's officials, and Contractor Property Developers Company responsible for past, current and future damages caused by storm water runoff, including loss of value to our property.
