Guide Plan Desig: Commercial Current Zoning: C -4, General Commercial Planning Comm. Action: None — as a comparatively minor revision, the item is treated as administrative without a public hearing. SUMMARY On behalf of KFC, Chris Deanovic is requesting an additional driveway that leads directly to the fast food site in the northwest corner of Outlot C. The proposed driveway scales approximately 40 feet from Claret Avenue on the north side of the private drive that traverses the site connecting Claret and Cimarron Avenues. This request is inconsistent with the preliminary plat as approved, and is not supported by City staff. Therefore, the applicant is pursuing this request directly to the Council with a staff recommendation of denial. The driveway concerns staff because it replicates a situation that currently exists with the Holiday station along Chippendale Avenue. Traffic entering and exiting the site has the potential for causing congestion at the intersection because of the driveways proximity to the corner and a lack of vehicle stacking space between the driveway and the intersection. In the opinion of staff, further design refinement of the parking lots and driveways can provide KFC with reasonable access, while maintaining the two driveway intersections along the private drive consistent with the approved preliminary plat. Staff would go so far as to suggest that the westernmost intersection could be shifted closer to Claret, so that it aligns with the gaps between the buildings on both the north and south sides. RECOMMENDED ACTION: Motion to adopt a resolution denying the preliminary plat revision based upon findings of fact. CITY COUNCIL ACTION: Of CITY OF ROSEMOUNT DAKOTA COUNTY, MINNESOTA RESOLUTION 2001- J) (Z,�F A RESOLUTION FOR DENIAL OF A PRELIMINARY PLAT REVISION FOR WASHINGTON HEIGHTS BASED UPON FINDINGS OF FACT WHEREAS, the Community Development Department received an application for a preliminary plat revision for an additional driveway within a commercial development called Washington Heights that had received preliminary plat approval on August 7, 2001; and, WHEREAS, the request is minor in nature that does not require Planning Commission review and recommendation; and, WHEREAS, The City Council considered the preliminary plat revision request with staff identified concerns provided. NOW, THEREFORE, BE IT RESOLVED, the City Council of the City of Rosemount hereby denies the preliminary plat revision requested by Hillcrest Homes based upon findings of fact: FINDINGS OF FACT 1. The proposed driveway is inconsistent with the preliminary plat drawings as approved on August 7, 2001. 2. The proposed driveway fails to provide adequate separation from the intersection with Claret Avenue, a situation which has been shown by existing examples to promote congestion at the intersection by traffic ingress and egress onto the site served by the proposed driveway. 3. Ryan Engineering, the engineering consultant has failed to demonstrate how the approved concept development could function with an alternative design relying on the approved driveway system with minor modifications. 4. The Cities Engineering Consultant has specifically recommended against the proposed driveway as a result of its proximity to Claret Avenue and the lack of vehicle staking space available in the distance separating the driveway from Claret Avenue. ADOPTED this 2nd day of October, 2001 by the City Council of the City of Rosemount.
