Gerald Abbott Approximately 30 68 single family (detached) lots Urban Residential R -1, Low Density Residential Recommendation of denial (2 -1) This single - family residential concept review was requested by the Developer to identify design concerns and revision needs prior to investing in the detailed engineering design that goes into a preliminary plat. Ultimately, the intent is a variance -free plat that will go through the preliminary plat process without the need for Planned Unit Development. Development of the property is made possible by the St. Joseph Church and Educational Center to the west and the anticipated construction of Connemara Trail. However, many design issues relating to access to Connemara Trail and interconnections to surrounding properties suggest that portions of the concept area may have to be redesigned, or may be premature altogether. The attached memo provides further detail. PLANNING COMMISSION PUBLIC HEARING AND ACTION Three neighboring property owners expressed their reservations regarding the development. The concerns ranged from additional traffic and the design to impacts on the recent and undeveloped land. The Planning, Commissioners were cautioned about redesigning the concept, even though they were willing to discuss broad - ranging revisions. Subsequently, two of the Commissioners present supported the recommendation to deny the concept as premature rather than entertain an indefinite tabling. The dissenting Commissioner was willing to recommend in favor of the indefinite extension. RECOMMENDED ACTION: Motion to direct staff to prepare findings of fact in support of denial of the concept for Biscayne Pointe Fourth Addition. Public Hearing: Biscayne Pointe Fourth Addition- Concept PUD Vice- Chairperson Weisensel confirmed that the recording secretary has placed on file with the City the Affidavit of Mailing and Posting of a Public Hearing Notice and Affidavit of Publication concerning the public hearing on the Concept PUD for Biscayne Pointe Fourth Addition. Mr. Pearson presented the concept plan for Biscayne Pointe Fourth Addition, located north of Biscayne Pointe development, '/a mile east of Biscayne Avenue and east of the proposed site for St. Joseph's. Connections to Connemara Trail were reviewed. The Parks & Recreation Commission feels that two lots in the southern portion of the development should be absorbed into the existing park. Several issues remain unresolved, including street alignment and ponding. These issues cannot be resolved within the 60 day statutory period. Staff believes this concept plan is premature . Discussions continued concerning the Connemara Trail location and spacing between intersections. Vice - Chairperson Weisensel opened the meeting to the applicant. Tom Von Bische addressed issues related to the location of Birchwood Avenue and suggested that it run along the property line. Because the drainage pond also services the church property, he suggested that the pond be moved to the western boundary. Because his development will be assessed for Connemara Trail, he feels the development should have the right to access onto Connemara Trail Mr. Pearson explained it is too early to comment on Mr. Von Bische's suggestions. Extensive design changes cannot be accomplished in a meeting. Planning Commission Regular Meeting Minutes August 28, 2001 Page 3 Vice- Chairperson Weisensel opened the public hearing. Shawn Kurth 2217 Birch St. W., expressed concerns with increased traffic, safety for children at the park, and with drainage as a result of the high elevation of the subject property. He would prefer to see a more natural setting than additional housing. Don Flach 2100 135 St. W., doesn't want to see this project rushed. Development of this property would leave his property to the east landlocked. Mr. Pearson addressed concerns with traffic and elevation. Alaina Kapp 2201 Birch St. W., commented on the odd shape of the development and inquired about development of surrounding properties. MOTION by Carr to close the public hearing. Seconded by Napper. Ayes: Napper, Carr, and Weisensel. Nays: 0. Motion carried. MOTION by Carr to recommend that the City Council deny the concept for Biscayne Pointe Fourth Addition because it is premature. FROM: Rick Pearson, City.Planner DATE: August 22, 2001 RE: Biscayne Pointe Fourth Addition BACKGROUND CITY HALL 2875 — 145th Street West Rosemount, MN 55068 -4997 Phone: 651 - 423 -4411 Hearing Impaired 651- 423 -6219 Fax: 651 - 423 -5203 This property lies east of the St. Joseph's site and has been under option by Heritage Development for over a year. Staff's position in the past has been that development has been premature. The construction of Connemara Trail is integral to the development, and will provide primary access in and out of the development. Issues remain to be solved, especially intersection alignments on Connemara Trail which may or may not occur on this property. CONCEPT REVIEW The Developer has asked for a concept review to stimulate discussion regarding this area given the complexity of issues that need to be resolved. Connemara Trail will not be built until next yer, and therefore, the preliminary plat package including all of the engineering of grading,. utilities and detailed street design will come later. The proposed land use is single family lots consistent with all applicable standards. Park land contiguous with land dedicated with Biscayne Pointe and a storm -water pond will also be included. STREET DESIGN The property is long and narrow, with the streets generally forming a grid oriented north and south. Connemara Trail is shown close to the location recommended by W.S.B., the Cities' Engineering consultants. Access from Connemara occurs both north and south but off -set about 300 feet. The north half of the development has connections to the north and west for future development continuity. No connections other than Connemara Trail occur to the east. The southerly half of the property has a connection into the Biscayne Pointe development as planned, with potential for access into the southeast corner of the St. Joseph's site. Two cul -de- sacs are shown on the south half with some lots that align with a four acre park that includes the storm -water pond. ENGINEERING STREET CONSIDERATIONS The Interim City Engineer has recommended that the concept be modified to shift and consolidate the street connections to Connemara Trail. The westerly connection is 450 feet from TO: Planning Commission August 28, 2001, PC Reviews — Heritage Development Concept Review Page 2. an anticipated connection with the St. Joseph's site. Minimum separation of streets and driveways is.600 feet. Connections to the future easterly neighborhoods is also recommended to be consistent with established City Council policy. A resulting re- design may have lessor no direct connection to Connemara Trail, with access occurring through adjacent properties. PARK AND PONDING CONSIDERATIONS The Parks & Recreation Director has indicated that the park does not completely correspond with the land dedicated with Biscayne Pointe. Therefore, the two adjacent lots on the end of the cul- de -sac should be converted to park. The lots could shift elsewhere — for example, the street could go straight through to the east and one or two more lots could be on the north side of the street. The Parks and Recreation Commission will be discussing the park issue at their meeting on Monday evening. CONCLUSION AND RECOMMENDATION Generally, staff believes that this entire area should be examined in further detail and decisions need to be made about access to Connemara Trail. Designing this property without relating it to the two adjacent properties could be problematic. Since Connemara Trail will not be built until next year, there is time to work through these issues. Unless the Developer / Applicant is willing to indefinitely suspend the 60 day review period for extensive plan refinements or revisions, then a recommendation to deny the concept because it is premature would be appropriate. AN ORDINANCE RELATING TO DRIVING AND PARKING REGULATIONS; AMENDING ROSEMOUNT CODE 8 -2 THE CITY COUNCIL OF THE CITY OF ROSEMOUNT, MINNESOTA ORDAINS AS FOLLOWS: Section 1. City Code 8 -2 -2 C is amended to read as follows: C. Seasonal Parking Restrictions: No person shall park a vehicle or permit it to stand upon any public street, highway or alley during the following times: 1. between the hours of 2:00 a.m. and 6:00 a.m. between November 1 and April l of each calendar year. 2. at any time after a snowfall, wind or other weather condition has resulted in an accumulation of snow of two inches (2 ") or more in depth on the public street, highway or alley until the street, highway or alley is plowed curb to curb. Section 2. ADOPTED this Rosemount.
