This request is based upon the developer's request to adjust lot lines within ten existing lots located in the 30 lot
detached - townhouse area between Birger Pond and Evermoor Parkway. The adjustments are needed because
the houses are somewhat larger than originally anticipated, and the change allows the houses to meet the
required six -foot side setbacks. Without the changes, a PUD amendment would be needed to reduce the
setbacks to five feet. The important point is that the change does not result in variances and the result is still
consistent with the PUD. Since the developer still owns the lots, and no new parcels are being made, it is being
treated as a "common boundary line relocation" rather than a subdivision. Therefore, as long as the change is
consistent with the PUD, there is no reason for the City to not allow the change to occur. This type of request
would usually go straight to the City Council. However, with so much attention being given to the Evermoor
development, it seems appropriate for the Planning Commission to be appraised of the request.
This process is essentially the same as a final plat, which does not require a public hearing. It is consistent with
the approved preliminary plat (and PUD).
PLANNING COMMISSION REVIEW
The Planning Commission received an explanation of the corrective plat, which is a type of replat on August 14.
Council member Klassen related details of a discussion with the City Attorney regarding the procedure. Council
Member Klassen was concerned that the procedure was not based upon established policy. However, City
Attorney LeFevere explained that the intent of the applicable section of the subdivision ordinance was being
followed if not specifically, and that the procedure was supported by the ordinance. Chairman Casper asked if
other cities had similar procedures. While other cities all have slightly different versions of subdivision
ordinances, the procedure is supported by State Statutes as verified by the City Attorney.
RECOMMENDED ACTION:
Motion to adopt a resolution approving the corrective plat for Innisfree.

RESOLUTION 2001-
A RESOLUTION APPROVING
THE CORRECTIVE PLAT OF EVERMOOR INNISFREE
WHEREAS, the Community Development Department of the City of Rosemount received an
application from Contractor Property Developers Company for approval of the corrective plat of
Evermoor Innisfree located in Rosemount, Minnesota; and
WHEREAS, on August 14, 2001, the Planning Commission of the City of Rosemount reviewed
the corrective plat of Evermoor Innisfree and adopted a motion to recommend approval, subject
to conditions, to the City Council.
WHEREAS, on August 21, 2001, the City Council of the City of Rosemount reviewed the
corrective plat of Evermoor Innisfree.
NOW, THEREFORE, BE IT RESOLVED, the City Council of the City of Rosemount hereby
approves the corrective plat of Evermoor Innisfree, subject to:
1) Payment of G.I.S. fees for the revised lot boundary lines.
2) Incorporation of recommendations of the Interim City Engineer relative to easements as
necessary for the corrective plat.
ADOPTED this 21S` day of August, 2001 by the City Council of the City of Rosemount.
