ATTACHMENTS: Draft Resolution, Location Map, Final Plat -*: APPROVED BY: Reductions I - I i e Applicant & Property Owner(s): Contractor Property Developers Company Location: Ten lots on either side of Clover Lane (east of Shannon Parkway, south of Connemara Trail Number of Lots: 10 total Current Zoning: R -1, Low Density Residential Planning Commission Action: Recommendation of Approval (4 -0) SUMMARY This final plat concerns ten lots arranged along both sides of an extension of Clover Lane as it will be extended north, from the Shannon Hills development (next to Carroll's Woods Park) and directly south of the water tower. Connemara Trail will be extended to provide a northerly access into the neighborhood. A dominant feature ofthis plat is a pipeline, which extends through the neighborhood at a diagonal from southwest to northeast. The result is generally significantly larger lots in terms of area and depth. The lots have been checked for conformance with R -1, Low Density Residential standards and the Evermoor PUD. Lot 5, Block 2, a corner lot is 100 feet wide instead of 105 feet. The additional width is required because it is a corner lot along side a collector street. It appears that adjustments could be made to the two adjacent lots to solve the problem. Jay Liberacki representing the Developer is indicated that the plat will be revised accordingly. Final Plats do not require public hearings when they are consistent with the approved preliminary plat (and PUD). Otherwise, previously unidentified variances would have to be processed as new applications. PLANNING COMMISSION REVIEW On August 14, 2001, the Planning Commission reviewed the final plat with minimal concerns. The "isolation" of the final plat area was somewhat surprising to the Commissioners, that the area is considered part of the first phase. RECOMMENDED ACTION: Motion to adopt a resolution approving the final plat for Wicklow Addition. CITY COUNCIL ACTION: CITY OF ROSEMOUNT DAKOTA COUNTY, MINNESOTA RESOLUTION 2001- A RESOLUTION APPROVING THE FINAL PLAT FOR EVERMOOR WICKLOW ADDITION WHEREAS, the Community Development Department of the City of Rosemount received an application for final plat approval submitted by Contractor Property Developers Co.. for Evermoor Wicklow Addition, as required by ordinance for the purpose of a residential development on land legally described as: That pat of the Southeast Quarter of Section 19, Township 115, Range 19, Dakota County, Minnesota, described as follows: Commencing at the northeast corner of Lot 1, Block 3, COUNTRY HILLS THIRD ADDITION, according to the recorded plat thereof, Dakota County, Minnesota, said point being on the west line of the East 2000.00 feet of said Southeast Quarter; thence North 00 degrees 45 minutes 37 seconds West, along said west line, a distance of 80.00 feet to the actual point of beginning of the land to be described; thence North 89 degrees 55 minutes 22 seconds East, along a line parallel with the south line of said Southeast Quarter, a distance of 300.00 feet; thence South 00 degrees 45 minutes 37 seconds East, a distance of 40.00 feet; thence north 89 degrees 55 minutes 22 seconds East, a distance of 20.20 feet; thence easterly along a tangential curve, concave to the north having a radius of 660.00 feet, a central angle of 12 degrees 04 minutes 37 seconds and an arc distance of 139.12 feet; thence South 00 degrees 22 minutes 16 seconds West, not tangent to last described curve, a distance of 140.60 feet; thence South 53 degrees 59 minutes 42 seconds East, a distance of 324.27 feet; thence South 00 degrees 04 minutes 38 seconds East, a distance of 193.08 feet to the south line of said Southeast Quarter; thence South 89 degrees 55 minutes 22 seconds West, along said south line, a distance of 713.18 feet to the said west line of the East 2000.00 feet of the Southeast Quarter; thence North 00 degrees 45 minutes 37 seconds West along said west line, a distance of 550.09 feet to the point of beginning and there terminating. WHEREAS, the Planning Commission of the City of Rosemount reviewed the final plat application for Evermoor Wicklow Addition at their regular meeting on August 14, 2001; and, WHEREAS, the Planning Commission adopted a motion to recommend approval of the final plat to the City Council as required by the Subdivision Ordinance, subject to conditions; and, WHEREAS, the City Council of the City of Rosemount reviewed the final plat application as required by the Subdivision Ordinance on August 21, 2001. NOW, THEREFORE, BE IT RESOLVED, the City Council of the City of Rosemount hereby approves the final plat for Evermoor Wicklow Addition, subject to: r Resolution 2001- 1. Modification of Lot 5, Block 2 to eliminate the lot width variance. 1. Execution of a subdivision agreement to secure public infrastructure including streets and utilities; 2. Incorporation of recommendations of the Interim City Engineer relative to drainage, easements, grading, public streets and utilities; 3. Payment of all platting, G.I.S., Park Dedication, applicable City Review fees and trunk/area fees as specified in the current fee schedule resolution.
