Jaques 15130 Dartmoor Ct. and set Consent Public Hearing PREPARED BY: Rick Pearson, City Planner AGEND #6 ATTACHMENTS: Appeal letter APPROVED BY: V SUMMARY On August 14, 2001, the Board of Appeals & Adjustments denied a variance for Ms. Margaret Jaques at 15130 Dartmoor Ct. The variance was requested to construct a six -foot high fence in her yard adjacent to December Trail. Because her property "backs up" to a lot fronting on December Trail, her fence is limited to 42" high within the street -side yard, which corresponds to her neighbors. The appeal letter is attached. The zoning ordinance specifies that the City Council conduct a public hearing within thirty days of receiving the appeal. Potential public hearing dates are September 4 and 18. RECOMMENDED ACTION: Motion to schedule a public hearing for September 4 or 18, 2001 starting at 7:30 pm. or as soon as possible thereafter to hear an appeal of a decision of the Board of Appeals & Adjustments CITY COUNCIL ACTION: i S August 16, 2001 Mayor /City Council C/O Rick Pearson City of Rosemount 2875 145 Street West Rosemount, MN 55068 -4997 To whom this may concern, My husband and I are unsatisfied with the decision the planning commission made regarding our fence variance. First of all, I would like a site map(s) to include the following houses; 15128 Danville Ave. 15253 Danville Ave. 15315 Danbury Ave. 15340 Darjeeling Ct. 15325 Darjeeling Ct. 15145 Dartmoor Ct. Ideally I would like individual ones as well as the kind that show block layouts. This way I can validate that these six fences on these properties are on "Corner Lots" where their rear yard abuts the adjacent properties front yard. If possible, I would also like to know if they did in fact pull permits for their fences or how they ended up being built, as you are pretty sure there were no variance requests. Thank you very much.
