Backyard composting allows residents the opportunity to divert organic waste from landfills. The proposed ordinance regulates the size, location and maintenance of the compost bin and identifies materials prohibited from the compost container. RECOMMENDED ACTION: Motion to approve an Ordinance relating to composting; amending Rosemount City Code Title 5 4% a' CITY OF ROSEMOUNT ORDINANCE NO. AN ORDINANCE RELATING TO COMPOSTING; AMENDING THE ROSEMOUNT CODE OF ORDINANCES BY ADDING NEW CHAPTER 4 TO TITLE 5 THE CITY COUNCIL OF THE CITY OF ROSEMOUNT, MINNESOTA ORDAINS AS FOLLOWS: Section 1 . The Rosemount Code of Ordinances is amended by adding new Chapter 4 to Title 5 as follows: CHAPTER 4 COMPOSTING 5 -4 -1 Composting: Composting shall be allowed only in Residential and Agriculture Zoned Districts. All composting shall be subject to the following requirements: A. Definitions. 1. Composting Controlled microbial degradation of source separated organic waste to yield a humus -like product or mulch to be used as a soil amendment. 2. Food Waste Vegetable, fruit and other organic %N - aste resulting from the handling, preparation, cooking and consumption of food, except for meat, bones, whole eggs and dairy products. 3. Mixed Municipal Solid Waste Garbage, refuse and other solid waste from residential, commercial and community activities that the generator of the waste aggregates for collection. 4. Organic Waste Yard waste and food . waste. It also includes community available compost ingredients. 5. Source Separated Organic waste that is separated from mixed municipal solid waste at the source by the waste generators for composting in a container. 6. Yard Waste Garden wastes, leaves, lawn cuttings, sawdust, weeds, non -woody shurb and tree prunings and twigs no larger than 1/4 inch diameter. CLL- 191343v 1 1 RS215-4 U B. Location 1. The compost container must be in the rear yard at least ten feet (10') from all property lines and no closer than twenty feet (20') to any residential dwellings, except the dwelling on the property at which the compost container is located 2. No compost container may be placed within twenty -five feet (25') of any body of water or area designated as flood plain or shoreland. No compost container may be placed within wetland buffer areas as defined in the most recent version of the Rosemount Comprehensive Wetland Management Plan. 3. Composting containers shall be located and designed so that seepage from the compost will not run off into public or private streets, storm sewers, drainage ditches, water retention basins, streams or lakes. C. Prohibited Materials The following materials shall not be placed in a composting container: meat, bones, whole eggs, dairy products, unshredded branches or logs, weeds heavily loaded with seeds, plastic, synthetic fiber, human or pet wastes, diseased plants and any other mixed municipal solid waste. No herbicides or pesticides shall be added to a composting container. A Composting Container All composting must occur in a container constructed of wood, wire mesh, concrete block, or a combination thereof or in a commercially available compost bin designated for composting organic waste. E. Composting Container Size Composting containers shall not exceed one hundred fifty (150) cubic feet in volume for those lots of ten thousand five hundred (10,500) square feet or less. For those lots of more than ten thousand five hundred 0 0,500) square feet, composting containers shall not exceed two hundred fifty (250) cubic feet in volume. The maximum height of the composting container shall be five (5) feet. F. Maintenance The compost shall be periodically tamed and watered to incorporate air and CLL- 191343v 1 RS215 -4 2 r properly mix «et and dry material and to promote a rapid degradation of the composting material. G. Nuisance A compost container must not be established or maintained in such a manner as to create an odor or other nuisance and any - composting shall be suspended or terminated if at any time the City determines a nuisance exists or that conditions exist constituting a fire hazard or health hazard, or if there is a threat to surface or groundwater from run -off or leaching. Section 2 . This ordinance shall be effective upon its passage and publication according to law. 2001.
